About this file

This is a conditional commitment letter for water service issued by the Tampa Water Department to Hillsborough County for a new construction development at 6799 El Capitan Drive involving a 17-unit single-family subdivision. The project requires the developer to install approximately 1,010 linear feet of 8-inch water main, a 1-inch irrigation meter with stub-outs and meter boxes for seventeen 3/4-inch domestic meters, and two public fire hydrants. The conditional commitment is valid for one year from October 23, 2023, and modifications to the project causing increased water demand or deviations from the approved service method could void the commitment. The developer is responsible for all design, permitting, and construction of water facilities, excluding the water meter installation, and must comply with Tampa Water Department Technical Manual standards. A pre-construction meeting with the City's Construction Engineering & Inspections Division must be scheduled at least ten working days before construction commences, and the wet tap connection to the City's water main must occur only after construction plans are approved and the pre-construction meeting is completed.

The total water fees due are $1,965, comprising a $155 installation charge for the 1-inch meter, $200 inspection fee for the irrigation service, $600 in public fire hydrant assembly inspection fees, and $1,010 for the main extension inspection fee; connection fees are waived for the developer-installed main extension. All fees must be paid prior to the release of Water Department holds on the building permit and before plan review commences. The developer must obtain a Hillsborough County right-of-way permit, Florida Department of Environmental Protection and Hillsborough County Health Department approvals, and must execute a Transfer of Ownership agreement to transfer facility ownership to the City upon completion. The developer assumes all liability during construction, must provide pressure testing and bacteriological clearance, install backflow prevention assemblies, and submit as-built record drawings; additionally, a thirteen-month guarantee period applies to cover defects in workmanship and materials.

Re: UTL-23-0001687, Conditional Commitment for Water Service, El Capitan Drive, 6799 El

Capitan Drive, (New Construction of Infrastructure for a 17-Unit Single-Family Subdivision / Developer Install of Approximately 1,010 LF of 8-Inch Water Main, a 1-Inch Irrigation Meter, Stub-outs and Meter Boxes for Seventeen (17) 3/4-Inch Domestic Meters, and Two (2) Public Fire Hydrants)

Dear Hillsborough County:

Your application for water service for the above-referenced project has been reviewed and approved by the Tampa Water Department. This letter shall serve as our conditional commitment to provide water service for the proposed project. In accordance with Sec. 26-74 of the City Code, this conditional commitment is contingent upon your satisfaction of all conditions specified herein and all other applicable requirements of the City Code and Tampa Water Department Technical Manual as further explained below.

The Water Department has determined that water service shall be provided by extending approximately 1,010 LF of 8-inch water main along the west side of El Capitan Drive from the existing 8-inch water main located within the north side of El Capitan Drive to the south side of El Capitan Drive, then east to the dead-end. It shall be your responsibility to determine if the proposed method of connection and service is feasible.

This conditional commitment for service is valid for one (1) year from the date of this letter. Modifications to your project causing an increase in water demand or a deviation from the approved method of service could void this conditional commitment. Any changes must be submitted for our review. An extension may be obtained by submitting a written request to the Water Department for an extension at least two (2) weeks prior to the expiration date of this conditional commitment. If a request for an extension has not been submitted and approved prior to the expiration date, the conditional commitment will be void and a new application for service must be submitted.

Water Department fees associated with this project must be paid in accordance with required deadlines and may be paid by visiting the City’s online permitting website at ACA.TampaGov.Net.

The ensuing conditions listed below apply to the City’s conditional commitment for water service for this project, including but not limited to, Water Department holds on the Building Permit issuance and/or Certificate of Occupancy, water fees, construction requirements and close-out requirements. It is your responsibility to read and understand the conditions outlined in this conditional commitment.

CONDITIONS OF CONDITIONAL COMMITMENT FOR SERVICE

GENERAL REQUIREMENTS

1. Plat Revision Required – Based on the latest copy of the draft preliminary plat provided, the right-of-way within the proposed project is labeled as “private”. In order for this commitment to be valid, the plat will need to be revised to show the right-of-way as “public”. Should the final plat show a “private” right-of-way, a revised commitment will be required.

2. Open Accounts – Please be advised that if there are any active water accounts within your project area, they must either be closed or must be in your name prior to payment of any fees issued under this conditional commitment. You may contact the City of Tampa. Utility Services Call Center at (813) 274-8811 to ensure that this takes place.

Additionally, once the utility account associated with the referenced project has been initiated, the account may not be transferred to a new account holder until all close-out requirements set forth in this conditional commitment have been satisfied.

3. On-Site Private Ownership (In-ground Meter) – All water facilities constructed on private property downstream of the water meter service box for the in-ground meter will be owned and maintained by the property owner. The City shall own and maintain all water facilities upstream of and including the meter box.

4. Subdivision Conditions – This conditional commitment is for the construction of the water facilities only. A separate application for water service will be required for each house that is constructed within the development, including model homes.

The building of model homes in advance of completing the water distribution system will be permitted subject to the City of Tampa’s Subdivision regulations. However, no connections will be permitted to the water distribution system nor will Certificate(s) of Occupancy be released until the distribution system is completed and all close-out requirements set forth in this conditional commitment of water service have been satisfied.

Before the Water Department can process an application for water service for a house within the development, a copy of the final plat that includes the addresses for each lot must be submitted. This information is required to verify the address on the water application.

5. Federal, State, and Local Regulation Compliance – You hereby covenant and agree that you shall comply with all Federal, State and local laws, rules, ordinances, and regulations applicable to your work under this conditional commitment, including but not limited to, the City of Tampa Ethics ordinance, all applicable sections in Chapter 26, City of Tampa Code that prohibit hydrant tampering and illegal connections, and all applicable State statutes that prohibit the use of devices or equipment that result in the benefit of utility service without proper payment.

Additionally, if reclaimed water is to be utilized, you acknowledge that by using reclaimed water you understand and will abide by the requirements set forth by Chapter 403, Florida Statutes, Chapter 62.610, Florida Administrative Code - Reuse of reclaimed water and land application; and shall comply with all other Federal, State and local laws, rules, codes, ordinances, regulations, and policies applicable to the use of reclaimed water; and must obtain, at your own expense, all permits, licenses, or other authorization necessary for the prosecution of the applicable work.

6. Environmental Contamination – New water facilities to be owned and maintained by the City must be free of all environmental contamination. If it is determined at any point during construction that the proposed public water facilities are not free of environmental contamination, the Developer will be responsible for all site improvements and remediation, including within the public right-of-way, required as determined by the City prior to final acceptance.

ADDITIONAL PERMITTING

7. Hillsborough County Limits – The referenced project is located within the City of Tampa Water Department service area but outside of City limits. All on-site construction is regulated by the Development Services Department of Hillsborough County. A hold on the building permit has been reserved for the City of Tampa Water Department. The hold shall not be removed until all applicable fees outlined by this conditional commitment have been paid. A hold shall remain on the Certificate of Occupancy until all close-out requirements set forth in this conditional commitment have been satisfied (if applicable). For questions regarding Hillsborough County building permits, you may contact the County at (813) 272-6680 or WaterDept@HillsboroughCounty.Org.

8. Right-of-Way Permit (Hillsborough County) – This project involves the private construction of public water facilities within the Hillsborough County right-of-way. This conditional commitment is contingent on you obtaining the necessary permits to construct the proposed facilities within the municipality’s right-of-way. The construction plans for the project must be approved by the Water Department before the permit can be submitted. For questions regarding Hillsborough County’s right-of-way use permits, you may contact Hillsborough County at (813) 274-6500 or ROWPermits@HillsboroughCounty.Org.

9. Florida Department of Environmental Protection (DEP) / Florida Department of Health in Hillsborough

County Permit (HCHD) – In addition to our approval, please be advised that the proposed water distribution system may require approval by the Hillsborough County Health Department. These permit applications are completed by the Engineer of Record and are signed by the Water Department. A copy of both permit applications with the most up to date City of Tampa Water Department information have been attached for your use. The Water Department will not provide the required signature for the applicable permit application until the water fees are paid and the construction plans are approved. Additionally, a signature will not be provided by the Water Department on the Certificate of Completion until all applicable close-out documents and requirements have been submitted and approved. For more information regarding submittal requirements and application fees, please contact the HCHD at (813) 559-4244 or Noel.Corson@FLHealth.gov.

FEES & CHARGES

10. General – A summary of all applicable fees may be found on the last page of this document. All fees may be paid online at ACA.TampaGov.Net.

11. Water Connection Fees (Waived) – Water connection fees are based on the flow rate required to serve your parcel based on the information submitted in the application package. A separate connection fee is assessed for each domestic and fire protection system. The Water Department will waive connection fees for new services being fed immediately downstream from a water main owned and maintained by the City for which the construction was financed by the private developer of said facilities. Your proposed project will meet the criteria for the water connection fees to be waived; therefore, no connection fees will be due at this time.

12. Installation Fee – Water Meter (Developer Installed) – You shall be responsible for the design, permitting, and construction of all water facilities, excluding the water meter, required to serve your project. Once construction is completed and approved, the water meter shall be installed by City. The fee associated with the installation of the water meter is listed in the fee table below. This fee must be paid prior to the release of the Water Department holds on the building permit and the Department’s review of the construction drawings.

13. Inspection Fee – The Water Department charges an inspection fee for review of the installation of each individual domestic meter to serve the project, the installation of fire lines, as well as $1 per foot for water main installations. A summary of the applicable inspection fees is found in the table below.

DESIGN / PRE-CONSTRUCTION

14. Construction / Design of Public Water Facilities (Developer Installation) – The entire water distribution system shall be designed and constructed by and at your expense. Plans for the project must be submitted and approved by the Water Department Development Services Section prior to construction. These plans must be signed and sealed by an Engineer licensed in the State of Florida. Please email a PDF of the construction plans to Sarah.Tsang@tampagov.net for review. Once the plans are approved, you will be required to submit four (4) hard copy sets of signed and sealed construction drawings for our use.

All water facilities constructed within the right-of-way must be designed and constructed in accordance with the Water Department Standards. The Standards and the requirements for the construction plans are listed in our Tampa Water Department Technical Manual. A copy of the manual may be accessed on the City of Tampa Water Department’s website at TampaGov.Net/Water. Follow the Water Technical Manual link in the Builder/Developer Section to access the manual. You shall be responsible to design, furnish, construct, and permit the following public facilities:

All other water facilities constructed during the referenced project will be privately owned and maintained by the property owner until final approval and acceptance by the City. Additional design and construction requirements may be determined during the Department’s review of the construction drawings. The review of the construction drawings will not commence until all applicable water fees have been paid in full (excluding 50% of the Contribution in Aid of Construction Fee, if applicable).

15. Pre-Construction Meeting – After the construction documents have been approved by the Water Department and all required permits for your project have been obtained, you must schedule a Pre-Construction Meeting with the City’s Construction Engineering & Inspections Division (CEI) prior to construction commencing. A meeting may be scheduled by emailing CAD-Developer@tampagov.net a minimum of ten (10) working days prior to the intended connection date to coordinate and schedule the tap with the City. The email must have “Request Precon for UTL-xx-xxxxxxx” in the subject line for the email to be forwarded to the correct staff members. Chapter 62-555.360, you are required to install a backflow prevention assembly on all potable, irrigation, and fire lines prior to your activation of your water services. The owner will be responsible for owning, maintaining, and testing all backflow prevention assemblies. A reduced-pressure principal assembly (RP) shall be required on all domestic and irrigation service lines. A double detector check valve assembly (D.D.C.V.A.) must be installed on the dedicated fire line, unless otherwise required in the City’s Cross Connection Control and Prevention Manual. You will be required to have the assembly(ies) tested every year. You must provide the test results to the Water Department within seven (7) calendar days of test completion. You must install the backflow prevention assembly prior to the inspection to be conducted by the Field Quality Section. Neglecting to install this assembly is a violation of the Florida Administrative Code and enforcement action will occur per F.A.C. 62-550, and your water service will be disconnected when this requirement is not met. A hold has been placed on the Certificate of Occupancy / Certificate of Completion for the final inspection and approval of the installed back flow prevention device(s).
