About this file
This document is a GRAMA Claim of Business Confidentiality form issued by the Utah State Archives in accordance with Utah Code Section 63G-2-305(1) and (2), related to the Utah State Board of Education (USBE) Request for Proposals for Utah Professional Practices Advisory Committee (UPPAC) Investigators. The form allows companies submitting proposals to assert claims of business confidentiality for specified categories of information, including non-public financial statements, specific employee names and contact information, customer or client lists, and other proprietary data. Companies may claim protection for trade secrets as defined under Utah Code Section 13-24-2 or for commercial and non-individual financial information where disclosure could reasonably result in unfair competitive injury. The form requires companies to provide a concise statement of reasons supporting their confidentiality claim and must be signed by an authorized representative on behalf of the submitting company.
The document serves as a procedural mechanism for protecting sensitive business information submitted in response to the UPPAC Investigators RFP while maintaining compliance with Utah's Government Records Access and Management Act (GRAMA). Companies claiming business confidentiality must demonstrate that the information derives independent economic value from not being generally known and that reasonable efforts have been made to maintain its secrecy. Additionally, the claiming party must establish that their interest in prohibiting access outweighs the public's interest in obtaining access. This form is referenced in accordance with Section 63G-2-309 and provides a standardized process for handling confidential submissions during the competitive procurement process for external, independent investigators to be used on a rotating basis for UPPAC hearings.
