About this file
This is an AIA Document B101-2017 Standard Form of Agreement Between Owner and Architect, executed by Waukesha County for professional architectural and engineering services related to a comprehensive study of the Waukesha County Administration Center. The agreement establishes the scope of services to be performed by the selected architect/engineering firm, including schematic design, design development, construction documents, procurement phase services, and construction phase administration. The project timeline requires completion of the study by October 1, 2026, with the selection of the firm anticipated for April 2026. The Waukesha County Department of Public Works will manage the process, and the study may be accomplished through the use of sub-consultants or joint ventures, provided eligibility requirements are satisfied. The agreement incorporates the Owner's Request for Proposal and the Architect's response as binding exhibits, and references AIA Document A201-2017 General Conditions of the Contract for Construction as the basis for construction phase services.
The agreement provides for compensation based on methods to be determined from the architect's proposal, with additional services and supplemental services compensated separately upon written authorization by Waukesha County prior to commencement of work. All additional work beyond the scope of basic services must be authorized in writing with fees determined before work begins and calculated using hourly rates submitted in the pricing document. The architect is required to maintain comprehensive insurance coverage including $1,000,000 Commercial General Liability, $1,000,000 Automobile Liability, and $1,000,000 Professional Liability per claim. The agreement is governed by Wisconsin law with exclusive venue in Waukesha County Circuit Court, and the architect must comply with all federal, state, and local nondiscrimination laws. Reimbursable expenses beyond standard allowances require advance authorization from Waukesha County, and five percent of total compensation will be retained until final completion of the construction phase.
