About this file
This is a proprietary information disclosure form from the City of Arlington, Texas, Office of Procurement related to a Fleet Maintenance Services contract solicitation. The document outlines the City's requirements for vendors submitting proposals to identify any materials they consider proprietary and wish to protect from public disclosure under the Texas Public Information Act. All submissions become public property upon receipt, and vendors must clearly mark each page containing proprietary information with the word "PROPRIETARY" in all capital letters highlighted in yellow at the bottom center of the page at the time of submittal. The City will make reasonable efforts to protect marked proprietary information from disclosure to the extent permitted by law; however, the final determination of what information must be disclosed rests with the Texas Attorney General.
Vendors must list all page numbers believed to contain proprietary information in the provided chart and may note whether only specific sections on a page qualify as proprietary. Notably, pricing information cannot be marked as proprietary and will be made publicly available in a bid/proposal tab following review of all submissions; by submitting a response, vendors agree that pricing is not proprietary and may be released. Failure to properly identify and mark proprietary information will result in all unmarked sections being deemed non-proprietary and made available upon public request.
