Section J, Attachment 1: Request for Proposal for Seed Project -

Your firm is requested to submit a proposal on the Scope of Work that is being considered for inclusion into the above referenced solicitation.

This is not a Notice to Proceed with this work; it is only a Request for Proposal (RFP).

General Instructions:

The title of this project is: IPC Demonstration Space / Cooling Optimization and IT UPS The estimated days it will take to complete this project are: 120 days from issuance of Notice to Proceed (NTP) The magnitude of this project is: Between $500,000 and $1,000,000 Infection Control: Contractor’s shall comply with the infection control permit applicable to this project, specifically the Class III requirements, 1 thru 11.

Clauses/Provisions are incorporated into this RFP:

· FAR 52.222-6 Construction Wage Rates Requirements (May 2014) – WA180045 dated 9/21/2018 is applicable to this project.

· FAR 52.228-1 Bid Guarantee (Sep 1996) – 20% of Proposal Price, or $3 million, whichever is less

· FAR 52.228-15 Performance and Payment Bonds – Construction (Oct 2010) – apply to this project

· FAR 52.236-27 – SITE VISIT (CONSTRUCTION) (FEB 1995) – ALT I (FEB 1995)

1. SELF-PERFORMED WORK AND LIMITATIONS ON SUBCONTRACTING

This procurement is a 100% Small Business set-aside. FAR 52.219-14 (JAN 2017) is incorporated herein by reference. Offerors are to complete and submit with their proposals the worksheet provided below.

Definitions: (from 13 CFR 125.6):

Cost of the contract. All allowable direct and indirect costs allocable to the contract, excluding profit or fees.

Cost of contract performance incurred for personnel. Direct labor costs and any overhead which has only direct labor as its base, plus the concern's General and Administrative rate multiplied by the labor cost.

Cost of materials. Includes costs of the items purchased, handling and associated shipping costs for the purchased items (which includes raw materials), off-the-shelf items (and similar proportionately high-cost common supply items requiring additional manufacturing or incorporation to become end items), special tooling, special testing equipment, and construction equipment purchased for and required to perform on the contract. In the case of a supply contract, the acquisition of services or products from outside sources following normal commercial practices within the industry are also included.

Personnel. Individuals who are “employees” under §121.106 of this chapter except for purposes of the HUBZone program, where the definition of “employee” is found in §126.103 of this chapter.

Subcontracting. That portion of the contract performed by a firm, other than the concern awarded the contract, under a second contract, purchase order, or agreement for any parts, supplies, components, or subassemblies which are not available off-the-shelf, and which are manufactured in accordance with drawings, specifications, or designs furnished by the contractor, or by the government as a portion of the solicitation. Raw castings, forgings, and moldings are considered as materials, not as subcontracting costs. Where the prime contractor has been directed by the Government to use any specific source for parts, supplies, components subassemblies or services, the costs associated with those purchases will be considered as part of the cost of materials, not subcontracting costs.

RATING DEFINITION NOTE

(E) Exceptional
Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/ Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good
Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory
Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal
Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory
Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
