A non-mandatory pre-proposal meeting will be held virtually via Microsoft Teams, with attendance strongly encouraged as the only direct forum for clarification from Town staff.

The Town reserves the right to reject any and all proposals, waive non-material irregularities, and retain other consultants to provide the same or similar services at its sole discretion. No minimum amount of work or compensation is promised to the retained consultant, and the Town intends to re-use work products as needed. The selected proposer for Owner's Representative services is explicitly ineligible to be awarded the Mid-Town Seawall Replacement Progressive Design-Build Project (RFQ No. 2026-012), establishing a clear separation between the oversight and execution roles. Proposers may not withdraw their proposals for 180 days from the opening date. Award shall be made to the proposer offering the best value to the Town, with the Town serving as the sole judge of its best interest. Required deliverables include weekly progress reports, risk register maintenance, reviewed and approved technical documents, regulatory compliance checklists, cost and schedule assessment reports, final pre-development reports with recommendations, and public communication collateral.

Background The Town of Palm Beach needs to replace 2,700 linear feet of the 100-year old seawall positioned on the waterward side of South Ocean Boulevard between Royal Palm Way and

Gulfstream Road. The Town desires to construct a new seawall seaward of the existing seawall.

In 2020, the Town & GHD began the preliminary design phase for the seawall replacement.

A Request for Qualifications (RFQ) and Request for Proposal (RFP) were advertised in 2023, but was ultimately withdrawn from advertisement at the Town’s discretion. It is the

Town’s intent to use submittals and permitting from the GHD design process (Exhibits B and C) as a reference for the Design Build process under RFQ 2026-12. This is a capital project under a progressive DB delivery method to realize synergies between all components, minimize disruptions, and assign a single point of contractual responsibility for the replacement of the Seawall. The Town intends to hire an Owner’s Representative to work on the Town’s behalf closely with the selected Design Build contractor.

Separately, the Town is in the design phase of a few projects near the Mid-Town Seawall.

The design of these projects will be 100% complete during the design-build process. The

Town intends to review the potential to add these projects to the Owner’s

Representative’s scope of work for construction management. Below is a list of these projects and a description.

1. Mid-Town Beach Linear Park – this project includes hardscape elements including benches and sidewalk, along with landscape elements, along the landward side of the new seawall and to the curbline.

2. Mid-Town Beach Bathrooms – this project includes major renovation to the existing bathrooms located at the east end of Chilean Avenue along the seawall.

3. Paving and Infrastructure Improvements along South Ocean Blvd – this project includes stormwater infrastructure repairs and milling and resurfacing South Ocean Boulevard from Royal Palm Way to just south of Gulfstream Road.

Scope of Work

The scope of work consists of but is not limited to the following for the Mid-Town Seawall project:

• Project Management and Coordination o The selected firm will act as the Town’s technical and strategic representative in all discussion with the Design-Build team.

o Facilitate communication and coordination between the Town, the Design-Build team, regulatory agencies, and other stakeholders.

o Assist in contract negotiation between the Design-Build team and the

Town during all phases of the process o Provide weekly progress reports to the Town, summarizing activities, decisions, and outstanding issues.

• Technical Oversight o Review and validate all technical deliverables submitted by Design- Build team including engineering designs, specifications and construction methodologies o Ensure the proposed design solutions comply with the Town’s standards, safety concerns, schedule requirements, regulatory requirements and future needs.

o Conduct technical risk assessments and identify potential challenges to the project’s feasibility, schedule and budget.

• Regulatory and Permitting Support o Provide expertise on regulatory requirements related to this construction, including environmental and coastal laws.

o Coordinate with the Design-Build team to identify and meet all permitting requirements during the project.

• Cost and Schedule Management o Evaluate cost estimates and schedules prepared by the Design-Build team, ensuring they are realistic and align with the Town’s budget.

o Recommend cost-saving measures and value engineering opportunities without compromising safety, quality, or project objectives.

o Monitor schedule adherence and identify risks or delays early, providing recommendations for corrective actions.

• Design Optimization o Acts as a technical advisor to ensure the bulkhead design incorporates best practices in engineering, sustainability and resilience against climate impacts.

o Work closely with the Design-Build team to optimize construction phasing to minimize disruption to residents and visitors.

o Evaluate innovative design and construction techniques proposed by the Design-Build team to ensure they provide long-term value, while also reviewing to confirm where there are deviations from the Design- Build RFQ and assess if deviations are acceptable.

• Stakeholder Engagement & Communication o Represent the Town in stakeholder meetings to communicate project goals, address concerns, and ensure alignment with project and Town objectives.

o Prepare presentations and documentation for internal and external stakeholders.

o Prepare press releases, make website updates, prepare flyers and communicate with the public throughout project duration.

• Quality Assurance/Quality Control (QA/QC) o Review all design and construction plans for accuracy, completeness, constructability and compliance with project requirements.

o Establish QA/QC protocols and oversee their implementation throughout the project.

• Final Pre-Development Recommendations o Prepare a comprehensive evaluation report after the initial pre-development phase of the Design-Build team’s contract, summarizing the feasibility of the Design-Build team’s proposed approach, including risks, benefits and alignment with project goals.

o Provide recommendations for the Town’s final design approval and move toward the construction phase.

• Deliverables o Weekly progress reports.

o Maintain and manage a risk register.

o Reviewed and approved technical documents from the Design-Build team.

o Regulatory compliance checklist and permitting status updates.

o Cost and schedule assessment reports.

o Final Pre-Development Reports with recommendations.

o Collateral for public communications

The Town intends to retain a consultant for a Non-Exclusive Professional Services Agreement (PSA) with an initial term of two years, with renewable terms for additional project scopes, as needed. No minimum amount of work or compensation is promised to the retained consultant. The Town reserves the right to re-use the work products of the retained consultant and to retain other consultants to provide the same or similar services at its sole discretion.

The scope of work for the Owner’s Representative for the Mid-Town Bathrooms, Linear Park and Infrastructure Improvements will be different from the Mid-Town Seawall Project scope in that these projects will be Design, Bid and Build construction methodology. This scope of work will be negotiated and refined upon completion of the design and bid phases of the project, but will likely include:

• Stakeholder Engagement & Communication

• Limited construction observation and construction administrative tasks, such as Request For Information review, Change Order review, Pay Application review

• Coordination between contractors, engineer of record and the Town for scheduling

• Cost and Schedule management
