Solicitation No. 1630J6-17-R-00001 Amendment No. 5

1. Original publication of the RFP and amendments to the subject RFP show conflicting issue dates. The original RFP date was issued on October, 26, 2017. A Microsoft Word version of the original RFP shows an issue date of September 12, 2017. Will the Government clarify the correct issuance date for the purposes of establishing proposal validity dates?

The original RFP date was issued on October, 26, 2017.

2. Amendment 4 states:

Section G.12 of the Solicitation refers to “demand for payment for failure to maintain staffing levels.” The contractor shall have a maximum vacancy rate not exceeding 4% and a specific number of days to fill certain positions. Financial damages will not be assessed at the value specified for the vacant position within the first 30 days of the vacancy.

However, the center operator may not bill the Government for the vacant position.

Damages will be assessed at the rate of 50 percent of the value specified for the vacant position from days 21 through 60. Damages will be assessed at the full value specified for the vacant positions after 60 days. Damages will be assessed and subtracted from a subsequent voucher.

Section G.12 shows four (4) positions with 30 days for each position.

Is there a specific number of days the Government is referring to other than 30 days in Section G.12?

Within the first 30 days, will the Government allow billing one of the specified positions if the position is vacant for 28 days but is filled on the 29th day?

Will the Government clarify how it will not assess financial damages for the first 30 days as shown in the second paragraph, but then assess damages on days 21 thru 60 as shown in paragraph 3 with the period of days 21 thru 30 overlapping each other?

Section G.12 is hereby revised:

The Contractor shall have a maximum vacancy rate not exceeding 4%. The Contractor has the specified days to fill the following positions:

Position Days

Center Director 30

Senior Residential Counselor 30

Security Personnel 30

Academic Supervisor 30

Demand for payment will not be assessed at the value specified for the vacant positions within the first 30 days of the vacancy. Demand for payment will be assessed at the rate of 50 percent of the value specified for the vacant position from days 31 through 60. Demand for payment will be assessed at the full value specified for the vacant positions after 60 days. Demand for payment will be assessed and subtracted from a subsequent voucher.

3. Question 9 on Amendment 3 reads:

Refer to the Price Detail Template (Attachment J-1), and specifically to tab for Line 27- Travel & Training. The cost for this line item is included on the "CR NTE" tab. Can the Government please clarify? Is it the Government's intention to have the contractor estimate these costs identified as "NTE, amount to be set at award"? We note that other costs on the "CR NTE" tab (Food, Utilities and Fuel) do not have a separate tab included in the Price Detail Template.

The following appears on Amendment 3 as the answer to Question 9: “Offerors are to provide cost estimates for all of the line items listed. If there's no separate tab, then the cost should be placed where the line item appears."

However, the answer to Question No. 2 reads: "Not-to-exceed (NTE) amounts will be provided after contract award. Offerors will not propose amounts for these line items."

Will the government clarify the apparent conflict between the answers to Question No. 2 and Question No. 9 on Amendment 3?

The following not-to-exceed (NTE) amounts are hereby incorporated into the RFP:

2-year Base Period:

Line Item 07 (Food): $959,955

Line Item 12 (Other Medical Expense): $238,141

Line Item 19 (Other Facilities Maintenance Expense): $884,901

Line Item 21 (Other Security Expense): $9,938

Line Item 23 (Utilities and Fuel): $452,852

Line Item 26 (Motor Vehicle Expense): $8,076

Line Item 27 (Travel and Training): $27,620

4. The answer to Question No. 31 on Amendment 3 indicates there are PRH changes pending. These changes are assumed to have a bearing on Firm Fixed Price (FFP) areas of performance. Will the Government issue bilateral modifications to the contract when and if changes are made to the PRH which affect the FFP areas of performance?

The Government will issue bilateral contract modifications when changes are made to the Job Corps Policy and Requirements Handbook (PRH).

5. On Attachment J-1, position title cells in labor-related line item tabs are restricted to only accept entries that are listed in the “Position by Title and Holidays” tab. Will the Government please provide a version of Attachment J-1 that includes all required positions including all applicable Career Technical Training (CTT) instructors?

Offerors may propose other positions in the narrative section of Staff Resources or provide a separate worksheet.

6. On Attachment J-1, the Government refers to the difference between cost and sale price as “fee” on many of the line item tables. Fee is a term used exclusively for cost-reimbursable contracts and represents the difference between total cost and price. Many of the line items are fixed price and the term “profit” is not used. Will the Government clarify what the term “fee” represents on firm-fixed-price line items?

The term “fee” in Attachment J-1 shall refer to the following amendments:

Section G.3.1 is hereby revised:

Under the terms of this combination fixed fee and cost reimburseable contract, the contractor shall have the opportunity to earn a technical performance incentive fee and a technical performance excellence bonus for center operations, and for Outreach/Admissions (OA), and Career Transition Services (CTS), if applicable, based on achievement of goals. The technical performance incentive fee shall range from 0% to 2.4% of total direct and indirect costs, excluding fee, CRA, equipment, CTST, and demonstration projects.

Performance measures may fluctuate from year to year based on performance history for the preceding program year. The maximum available technical performance incentive fee will not exceed 2.4%.

The contractor’s performance and the amount of technical performance incentive fee earned shall be determined annually after the close of the contract year based on achievement of Program Year goals within the Job Corps’ Outcome Measurement System (OMS). Each contractor’s performance will be evaluated based on the portion of the contract year that occurred during the Program Year for which the performance measure was in effect.

In order to motivate and reward excellence in performance, those contractors whose performance exceeds the top of the National Performance Range will be eligible to earn a technical performance excellence bonus. Under the resultant terms of this contract, the performance measure will identify incentive fee payment levels as follows for Center Operations:

Center Operations:

Contract Year

Minimum Cost

Incentive Fee (0%)

Minimum Technical

Performance Incentive Fee (0%)

Average/ Target Cost

Incentive Fee

(2.0%)

Average/ Target

Technical Performance

Incentive Fee (1.2%)

Maximum Cost

Incentive Fee

(4%)

Maximum Technical

Performance Fee

(2.4%)

If applicable under this RFP and the resultant contract, the technical performance incentive fees for OA and CTS shall be as follows:

Outreach and Admissions and Career Transition Services:

Contract Year

Minimum Technical

Performance Incentive Fee

(0%)

Section G.3.2 (Payment of Cost Incentive Fees) is hereby incorporated:

Upon completion of the contract year, the Contracting Officer will determine the amount of cost incentive fee earned by the contractor using the cost incentive fee calculation identified in the table above. At the end of each performance period, the Contracting Officer will issue a contract modification to increase the estimated cost and funding on the contract’s cost incentive fee line. Upon receipt of the modification, the contractor would include the additional cost incentive fee earned on the next monthly invoice. If there is no additional fee earned, the Contracting Office will advise the contractor accordingly.

7. Refer to Attachment J-1. In all Personnel expense lines, there are no columns for non-exempt overtime hourly rates or hours. To pay non-exempt personnel for overtime hours in accordance with U.S. Department of Labor, an overtime rate of 150% is to be paid for any/all overtime hours worked. Will the Government clarify how overtime rates and hours for non-exempt personnel are to be incorporated into the deliverables as only using the "Unburdened Direct Labor Rate" column will not provide the correct results in the Total columns.

Offerors may provide a separate worksheet to show the correct results.

File details come from the government source that posted it.
