SECTION 01100 – SUMMARY OF WORK

PART 1 - GENERAL

1.1 PROJECT DESCRIPTION

1.2 WORK COVERED BY CONTRACT DOCUMENTS

A. Work consists of the following: Office Renovation

1. Abbreviated Project Summary: Architectural, Structural, Mechanical, Electrical, Fire Protection, Telecommunications, Technical Security Systems and Furniture Design and Installation.

1.3 SALVAGE

A. Items of salvageable value listed below and items indicated to be salvaged on the drawings shall remain the property of the U.S. Government and shall be placed in storage on site as selected by the COR. Salvaged items are as follows:

1. Electrical and security alarms and devices, and other items as indicated on the Drawings

B. All items shown as being removed and salvaged shall be removed without damage. The

Contractor shall coordinate packing and transporting salvaged equipment and devices to be stored in secured storage areas with the COR/Post.

1.4 STORAGE AND REMOVAL OF MATERIALS AND EQUIPMENT

A. The Contractor shall be responsible for the receipt and placement of materials and equipment to be reinstalled into secure storage areas at the site as directed by the COR.

B. The Contractor shall be responsible for the removal and disposal off the site of excess materials and debris resulting from the Work.

C. Debris shall be disposed of off the site daily.

D. Debris shall not be disposed of by transfer to Post containers.

E. Upon completion of the Work, or when requested by the COR, the Contractor shall remove all equipment and surplus materials and leave the site a clean condition satisfactory to the Contract Documents.

1.5 EXISTING WORK

A. Before the start of construction, notify the COR of any existing work, not otherwise detailed or specified, requiring alteration or temporary removal and replacement to perform the Work of the Contract.

B. The Work remaining in place which is damaged or defaced during this Contract shall be restored to its original condition at the end of the Work.

1.6 USE OF PREMISES

A. General: Contractor shall have limited use of premises for construction operations as indicated on Drawings by the Contract limits.

B. Use of Site: Limit use of premises to Work in areas indicated. Do not disturb portions of

Project site beyond areas in which the Work is indicated.

1. Limits: Confine construction operations to area of floor/s as indicated.

a. Government will provide designated storage area on embassy compound for storage of construction materials.

2. Government Occupancy: Government shall occupancy Project site. Government shall be operational during the construction.

3. Driveways and Entrances: Keep driveways, parking garage, loading areas, and entrances serving premises clear and available to Government, Government's employees, and emergency vehicles at all times. Do not use these areas for parking or storage of materials.

4. All deliveries to Site shall be coordinated with Post to minimize use of driveways and entrances and space and time requirements for storage of materials and equipment on-site.

C. Use of Existing Building: Maintain existing building in a weathertight condition throughout construction period. Repair damage caused by construction operations. Protect building and its occupants during construction period.

1.7 ENVIRONMENTAL PROTECTION

A. The Contractor shall control the spread of dust resulting from the Work. This shall include the use of temporary dust enclosures as outlined in Contract Documents.

B. The Contractor shall notify the COR and Post 24 hours in advance of starting any procedures that will produce strong odors, C. The Contractor shall control construction noise as far as practicable. Only rotary drilling and core drilling through concrete slabs shall be permitted. The use of such drills or the use of impact tolls shall be used only when permitted by the COR and Post.

1.8 GOVERNMENT'S OCCUPANCY REQUIREMENTS

A. FBI Occupancy: The FBI will occupy the construction area during entire construction period.

Coordinate with Post during construction operations to minimize conflicts and facilitate Government usage. Perform the Work so as not to interfere with Government's operations.

Maintain existing exits, unless otherwise indicated.

1. Maintain access to existing walkways, corridors, and other adjacent occupied or used facilities. Do not close or obstruct walkways, corridors, or other occupied or used facilities without written permission from Government and authorities having jurisdiction.

2. Provide 72 hours' notice to COR and Post of activities that will affect Government's operations.

B. Government Occupancy of Completed Areas of Construction: Government reserves the right to occupy and to place and install equipment in completed areas of building before Substantial Completion, provided such occupancy does not interfere with completion of the Work. Such placement of equipment and partial occupancy shall not constitute acceptance of the total Work.

1. Contractor will prepare a Certificate of Substantial Completion for each specific portion of the Work to be occupied before Government occupancy.

2. Before partial Government occupancy, mechanical and electrical systems shall be fully operational, and required tests and inspections shall be successfully completed. On occupancy, Government will operate and maintain mechanical and electrical systems serving occupied portions of building.

3. On occupancy, Government will assume responsibility for maintenance and custodial service for occupied portions of building.

1.9 WORK RESTRICTIONS

A. On-Site Work Hours: The Work shall be generally performed inside the existing building will consist of six ten working hour days include nights and weekends so as to minimize impact to Post. Ten hour day excludes (1) 30 minute meal but shall include (2) 15 minute breaks, (1) before and (1) after the meal break. Additionally, the majority of the Work during the work week shall be performed during non-business working hours at night.

1. Weekend Hours: As arranged by COR and Post.

2. Night Hours: 1800 – 0600 or as coordinated with COR/Legat Personnel/Post.

3. Hours for Utility Shutdowns: Weekends only, as arranged by COR/Post/PM.

4. Hours for Core Drilling: Only allowed after normal business hours or on weekends.

B. Existing Utility Interruptions: Do not interrupt utilities serving facilities occupied by

Government or others unless permitted under the following conditions and then only after arranging to provide temporary utility services according to requirements indicated:

1. Notify COR and Post not less than three days in advance of proposed utility interruptions.

2. Do not proceed with utility interruptions without COR’s and Post’s written permission.

Any damages incurred by Government of Contractor’s unscheduled or non-approved utility shutdown will be the responsibility of the Contractor and deducted from the total contract sum.

1.10 PHASING PLAN

A. The Contractor shall provide a phasing plan to provide minimal disruption of Post operations during construction. The Contractor shall, before beginning the Work, meet with the COR to approve a mutually acceptable phasing plan.

1.11 SPECIFICATION FORMATS AND CONVENTIONS

A. Specification Format: The Specifications/ Project Manual are organized into Divisions and Sections using the latest CSI/CSC's "MasterFormat" numbering system.

1. Section Identification: The Specifications use Section numbers and titles to help cross-referencing in the Contract Documents. Sections in the Specifications are in numeric sequence; however, the sequence maybe incomplete because all available Section numbers are not used. Consult the table of contents at the beginning of the Specifications to determine numbers and names of Sections in the Contract Documents.

2. Division 1: Sections in Division 1 govern the execution of the Work of all Sections in the Specifications.

B. Specifications Content: The Specifications use certain conventions for the style of language and the intended meaning of certain terms, words, and phrases when used in particular situations. These conventions are as follows:

1. Abbreviated Language: Language used in the Specifications and other Contract

Documents is abbreviated. Words and meanings shall be interpreted as appropriate.

Words implied, but not stated, shall be inferred as the sense requires. Singular words shall be interpreted as plural and plural words shall be interpreted as singular where applicable as the context of the Contract Documents indicates.

2. Imperative mood and streamlined language are generally used in the Specifications.

Requirements expressed in the imperative mood are to be performed by Contractor.

Occasionally, the indicative or subjunctive mood may be used in the Section Text for clarity to describe responsibilities that must be fulfilled indirectly by Contractor or by others when so noted.

a. The words "shall," "shall be," or "shall comply with," depending on the context, are implied where a colon (:) is used within a sentence or phrase.

SECTION 011050 - CONSTRUCTION SECURITY

1.1 INTRODUCTION TO SPECIAL SECURITY

A. General Explanation: In addition to being one of the nontechnical unit-of-work sections of these Specifications, for requirements to be performed by the Construction Contractor; this Section and its attachments comprise one of the principal forms of explanation for provisions which will ensure the security of: 1) classified information, 2) national security-related activities, and 3) personnel assigned to facilities at the Site.

1. Project Description: Office Modification, Post specific. All Work is as described by Section 011000 - "Summary", by the Construction Contract Documents hereof, and elsewhere.

2. Unless noted otherwise by T.O., all design Work shall be performed by minimum Secret Cleared U.S. Citizens and all construction Work shall be performed by TS Cleared U.S.

Citizens.

3. Local Labor: Not necessarily by way of limitation, and as specified in greater detail elsewhere in these Contract Documents, no Foreign National Personnel will be allowed at locations where work is in progress.

4. Vehicle Drivers: Drivers may be from designated countries, except Libya; and, if so, must be accompanied by a cleared American employee of Construction Contractor; unless a specific written waiver is issued by SSM or RSO through COR, in advance, for the specific category of Work and for a recorded period of time.

5. General Prohibition: Except as otherwise specifically permitted, neither use Designated-country citizens, firms, materials, vessels, or ports-of-call for any aspect of construction, nor for introduction into a CAA of this Project. Request exceptions in writing through COR. Government reserves the right, in its sole discretion, to determine the suitability of Contractor's personnel at the Site and elsewhere where the Work is in progress.

1.2 SUMMARY

A. General Description: The Work of this section involves interfaces with a number of security-related Government entities, always coordinated through the COR; and includes, but not by way of limitation, the handling of classified information, restricted procurement logistics, security procedures for access to site and segregated portions of the Work, screenings/clearances/briefings/debriefings for personnel/consultants/visitors involved in the Work, accommodating surveillance and inspection by Government of Work at the Site and elsewhere in fabrication / transit / receiving / storage / installation / protection, and restrictions upon related actions and use of facilities. These provisions are applied to the Work at several different levels of secrecy/classification/protection.

1.3 DEFINITIONS

A. General: Contact the COR, for definitions of both acronyms and words/terms which are used with specific meanings related to this security program.

B. For the purpose of this project the CAA is located on Post specific floor of Post specific building.

1.4 PERFORMANCE REQUIREMENTS

A. Comply with Government's requirements for participating in the Project security procedures as specified, and as requested subsequent to award of the Contract. Afford unrestricted access to the Work, for authorized surveillance and inspection by Government entities, as determined by the COR to be required for assurance of security. Perform security-related Work as directed by the COR, coordinating with separate contractors, Government, and Government-engaged security consultants. Maintain secrecy and security, and avoid compromise of classified information and products, though unauthorized disclosures of and accesses to the Work and its associated documentation. Maintain appropriate security clearances, from Government, for personnel requiring access to limited, controlled, and protected areas.

1. Government reserves an unlimited right to impose security and logistical requirements on

Contractor's performance of Work, including administrative procedures as necessary to ensure compliance, as directed by/through the COR; also by SSM, RSO.

2. Comply with Post's policies, regulations and procedures regarding conduct, behavior, and security; and extend this requirement to personnel of subcontractors and others at the Site, as requested by the COR.

1.5 SUBMITTALS

A. Security Clearances: Where clearances are required for subcontractors, inspection/test laboratories, consultants, tradespersons, laborers, and others performing work in limited-access/controlled/protected areas of work; submit information required for securing such clearances well in advance of time such accesses will be needed. Comply with COR's requests.

PART 3 - EXECUTION

3.1 PERSONNEL AND CLEARANCES

A. Security Clearances, General: Except as otherwise indicated, obtain security clearances which are to be processed by USG. Obtain proper security clearances for: 1) Persons involved with performance of Work, both at the Site and elsewhere (when identified as work of Project), wherever Work is in progress and destined for use in CAAs; and 2) Persons exposed to or

Page 16 of 129 011050 - 3 requiring access to confidential materials/information/equipment. Provide COR-approved security protection facilities capable of safeguarding security to the highest classification of the material/information/equipment being access and protected. Except as otherwise indicated, obtain for each person requiring security clearance, through investigation and clearance, a security level at least equal to the highest classification of material/information/equipment to which he/she has access and exposure.

1. Proper Security Clearance Levels: In general, the minimum level of security clearance is

"SECRET," except where a higher level is indicated or subsequently required by Government.

a. Provide "TS" clearance level for project managers, general superintendents, and

ALL other personnel requiring access to or exposure to classified materials/information/equipment. As individually authorized by COR, personnel with SECRET clearance may have access/exposure to classified materials/information.

b. Provide COR-approved facilities safeguarding capabilities, equivalent to "SECRET" classification, wherever SECRET materials/ information is to be accessed or exposed.

2. Require cleared (American) personnel who will be assigned to foreign location(s) including the Site, and who will have access to classified information, to participate in a security briefing by the Site Security Manager (SSM), relating to the handling and protection of classified information; and to sign-and-return Form SF-312 "Classified Information Nondisclosure Agreement." Onsite superintendant is required to receive a security briefing by the FBI/FLSD Security Unit prior to deployment.

3.2 NON-FRATERNIZATION POLICY

A. All cleared U. S. citizen contractor personnel will comply with DOS (89 State ALDAC 330541 and Change 1, 91 State 232998 - CONFIDENTIAL) and Post specific policies regarding non-fraternization and contact reporting. These policies are available to Contractors during visits to the Post.

3.3 SECURITY CLEARANCES AND INVESTIGATIONS

A. Facility Security Clearances: All Contracting firms requiring access to classified information will have a facility security clearance as required by DD FORM 254.

B. Classified Storage Capability: Contractor firms requiring access to classified information at their offices in the U. S. will have approved storage capabilities as required by the Government.

Storage of classified project material at any site overseas, other than the Post, the final construction Site, and the SSA, is PROHIBITED.

C. Personnel Clearances: All Contractor Personnel who require access to classified project material, information, or equipment will be Cleared U.S. Citizens. It is the sole responsibility of

Page 17 of 129 011050 - 4 the Contractor to ensure that a sufficient number of Cleared U.S. Citizen Contractor Personnel are available to perform the work of this contract.

D. Clearing Process:

1. Personnel clearances will be coordinated between the Contractor and the COR.

2. It is the responsibility of the Contractor to notify the COR when security clearances have been granted and send a copy of the 4311 to The Government.

E. Security Briefings:

1. All Cleared U.S. Citizens Contractor Personnel who will be assigned to work on this Contract will receive an Executive Order 12356 Security Briefing from their facility security officer, relating to the handling and protection of classified information, and sign Standard Form 312 [Classified Information Nondisclosure Agreement].

2. All Contractor Personnel will be provided a briefing regarding host county and Post specific security policies by the Regional Security Officer (RSO).

F. Overseas Transfer of Classified Documents:

1. All classified and protectively marked LOU, construction documents or related materials will be coordinate with COR for The Government for transmission overseas.

G. Loss/Compromise of Classified Information:

1. Any suspected loss or compromise of classified material will be immediately reported to the COR.

3.4 CAA MATERIALS AND TRANSIT SECURITY

A. General:

1. The security requirements detailed in this Section apply to the procurement, shipment, inspection and storage of all CAA Materials. Procurement actions based on these security requirements will be in consonance with the Federal Acquisition Regulations (FAR) and DOS Acquisition Regulations (DOSAR).

2. It is the responsibility of the Contractor to arrange with the COR, the transportation of all CAA Materials to the SSA, any Support Sites and between the SSA, any Support Sites and the Final Construction Site in accordance with the Specifications set forth in this Section.

3. The U.S. Government reserves the right, in its sole discretion, to inspect any CAA Materials destined for use in this project, and to determine if any materials have been compromised and cannot be used in the project. If the compromise of CAA Materials result from the acts or omissions of the Contractor, the Contractor will be responsible for all associated costs.

4. Off-Site precast or prefabricated products shall not be used in the construction of CAA unless previously approved by the COR.

B. Specific CAA Bill(s) of Materials:

1. The Contractor will prepare a specific BOM listing all CAA Materials and submit it to the

COR for approval within 120 days of receipt of the contract Notice to Proceed (NTP). The COR will review and comment on the BOM within 30 days.

2. The Contractor is responsible for submitting a comprehensive and detailed BOM. The Contractor will be responsible for any additional cost resulting from the submission of an incomplete or insufficient BOM.

a. Use and purpose of BOM. For security purposes, the BOM is an essential document to gain COR approval of the Contractor’s intended procurements of CAA Materials.

In particular, COR review of the BOM will verify that: 1) the Contractor has identified all CAA Materials that must be purchased in the U.S. and securely shipped: and 2) all other CAA Materials to be procured by the Contractor are inspectable in accordance with procedures established by The Government.

b. The BOM also establishes a comprehensive record of all materials that are incorporated or placed into the CAA.

3. BOM Contents: For each CAA Material, the BOM will:

a. Identify each CAA Material and the quantity of the material with sufficient detail to differentiate it from all other similar CAA Materials and Non-CAA Materials.

b. Identify the total quantity of each item to be used in the CAA. For those items so identified which will also be used for non-CAA portions of the project, provide the quantity of those items which will be used in the CAA.

4. Proposed BOM Changes and Additions: The Contractor will submit to the COR for approval any proposed changes or additions to the BOM when they are identified but at least 20 days prior to procurement of materials. The COR will notify the Contractor of the results of his review within 20 days of the receipt of the BOM change or additional CAA Materials it identifies in a BOM without having to wait for the COR review and approval.

5. Unless noted otherwise by T.O., the Contractor shall keep receipts for all items listed on

BOM/SOV exceeding $75 USD. The Contractor shall provide receipts at Government’s request.

C. Procurement of CAA Materials

1. Mandatory U.S. Procurement: The following CAA Materials must be procured in the U.S., consolidated at a Contractor’s Central Receiving or Consolidation Point (CRP), and securely shipped to the Final Construction Site.

a. Materials for use in other parts of the CAA; Any of the following materials which are specifically identified for incorporation into or which are intended to remain in the areas designated in the project construction documents as the CAA must be procured, handled, shipped, and stored in accordance with Subparagraph 3.4.C.1 above.

2. Unrestricted Procurement: All other materials intended to be incorporated into or which are intended to remain in the CAA may be purchased I) in the U.S.; ii) locally as directed by the COR and Post; iii) in any third country except for countries identified as Critical Threat on the DOS Composite Threat List. However, all materials must be listed on a BOM which must be approved by the COR (see Paragraph 3.4.B). These Unrestricted Procurement materials do not need to be consolidated at the Contractor’s CRP.

a. Delivery, inspection and storage of unrestricted procurement materials: Upon delivery to the Final Construction Site (or as soon a possible thereafter), Unrestricted Procurement materials will be inspected by the U.S. Government and then placed in the SSA until needed for construction. The materials will be inspected by:

1) DS approved inspection techniques.

2) Random selection of Unrestricted.

3) Procurement Materials at site.

4) Both of the above.

If a material can not be inspected or randomly selected (see below), the Contractor will be required to procure that material in the U.S. and securely ship the material.

The Contractor must submit a BOM for all CAA Materials to the COR to ensure that all materials that the Contractor intends to obtain through Unrestricted Procurement are inspectable or randomly selectable.

b. Random Selection: Random Selection of materials is not permissible in which all work is to be performed in CAA spaces. Random Selection applies to all Unrestricted Procurement Materials used on a project, except Raw Materials (See Paragraph c. below). Random Selection is a process by which a percentage of Materials which are common throughout the project and not unique in type, size, color or design for specified areas (e.g. CAA) are selected from materials purchased

Page 20 of 129 011050 - 7 in bulk and shipped to the SSA or Final Construction Site without security restrictions. Random selection will be based on the total quantities of an order and will take place immediately upon receipt of the full or partial shipments that make up the order. The selection of any specific CAA Material from each shipment cannot exceed 35% of any shipment received. The total amount of specific material selected cannot exceed 35% of the total amount of material to be used on the project. The material must be placed in secure storage immediately after selection.

c. Raw Materials: Any of the following raw materials or equipment which will be used in the construction of the CAA may be purchased without security restrictions and procedures. However, the Contractor will notify the COR where the materials will be purchased at least ten (10) days prior to the purchase of the materials. The Contractor must receive approval from the COR prior to purchase.

D. Secure Procedures For Materials for Use In Other Parts Of The CAA

1. The security procedures detailed in this Paragraph and Paragraphs 3.4.E, through 3.4.G apply to the procurement, shipment and storage of all materials listed in paragraph 3.4. C.1, MANDATORY U.S. PROCUREMENT, and any other materials subsequently identified as CAA Materials that must be purchased in the U.S. and securely shipped to the Final Construction Site.

2. Control of CAA Materials: Uninspectable CAA Materials will be Controlled from the time they are first identified as being destined for the Post defined in these documents (this occurs at the Contractor’s Central Receiving/Consolidation Point), through transport and placement in a SSA and installation at the Final Construction Site.

3. Consolidation and Packing of CAA Materials at the Central Receiving/Consolidation Point (CRP); The Contractor will arrange for a CRP within the U.S. for all CAA Materials that must be procured in the U.S.. This CRP must be certified as a secure warehouse by the U.S. Government prior to its utilization for this contract. The minimum security requirements for this CRP are contained in Attachment 3 to this Section.

4. Non-U.S. Procured Materials: Unrestricted Procurement Materials do not require consolidation at a CRP in the U.S.

5. Containers: In the case of shipment by containers, it will be the Contractor’s responsibility to provide Air or Sea Containers, to prepare these Containers in accordance with this Section, and to ensure that CAA Materials are consolidated and packed in these Containers.

The following guidelines and procedures apply to Containers:

a. Sea Containers Selection

1) Only corrugated steel Containers are acceptable.

2) No holes in the Container are permitted.

3) Containers may have no more than six patches. All patches will be continuously welded, and the weld will be evident both inside and outside the container.

4) Dents or rust spots are acceptable if they do not jeopardize the light and water tightness of a container.

5) All bars, doors and locking mechanisms will be fully operable.

6) All Containers will be light and water tight.

7) Container floors will be solid. There can be no splits completely through the wood.

8) There can be no loose floorboards. Loose floorboards must be fastened with screws and splits or damaged areas covered with 16mm (5/8”), 1220mm (4’- 0”) by 2440mm (8’-0”) plywood panels, perpendicular to the length of the container securely attached with screws.

9) Each Container floor will be swept clean prior to inspection and acceptance by the U.S. Government. The Contractor will ensure that all floorboards have all screws intact, that the floor contains no holes or splits, and any repairs are made as described in paragraph 8) above.

b. Sea Container Preparation Method, Prepare the Container by cleaning the interior surface as necessary to ensure total adhesion of the paint. Paint the interior of the Container with a paint meeting specifications (Federal Specification TT-E-489H, dated August 22, 1988) and in accordance with the manufacturer’s instructions. In order to preclude the establishment of a regular pattern, consecutive Containers will not be painted the same colors. Only pastel colors will be used for this purpose, alternating various manufacturers’ pigments to obtain these pastel colors.

c. Air Containers Selection

1) Only Air Containers constructed entirely of metal with forklift bases are acceptable.

2) No holes in the Container are permitted.

3) Air Containers may have no more than three (3) patches. All patches must be riveted. All patches must be caulked inside and outside of the container.

4) Air Containers will have only one (1) door with at least one (1) recessed locking hasp. The door and locking hasp will be fully operable.

5) All Air Containers must be light and water tight. Dents and rust spots are acceptable if they do not jeopardize the lift and water tightness of the container.

Air Container Preparation Method: Prepare the Container by cleaning the interior surface as necessary to ensure total adhesion of materials to be used to ensure light tightness.

d. Air and Sea Container Loading: Contractor will allow U.S. Government representative(s) access to the Contractor’s CRP for a visual Container inspection after preparation of the Container but prior to loading of the Container. A container may be rejected by the U.S. Government representative if it does not meet the requirements in paragraph 3.4.D.5 of this Section. For Sea Containers only, the Contractor will provide a paint chip sample of the paint applied to each Container to the U.S. Government representative.

e. Air and Sea Container Loading: When the Contractor has determined the date the

Container(s) will be ready for loading and the dunnage wall construction will be completed, the COR will be advised a minimum of ten (10) working days prior to the loading date to permit a U.S. Government representative unimpeded access to inspect the Container prior to actual loading to ensure compliance with the requirements of this Section. On the working day following completion of Container packing and wall construction by the Contractor, the Contractor will permit a U.S.

Government representative unobserved and unimpeded access to each sea Container for a minimum of four (4) hours (Air containers require a minimum of two (2) hours) for final preparation prior to shipment.

f. Installation of Dunnage Walls

1) Sea Containers - After loading Containers, the Contractor will build a dunnage wall inside the container allowing at least 915mm (36”) of space between the wall and the doors of the container using the Specifications provided by the COR. Should the dunnage wall not be built according to the Specifications provided, the Contractor will be required to rebuild the dunnage wall according to this Section at the Contractors expense.

2) Air Containers: The shipper will provide the materials for the dunnage wall which will be installed by the Contractor. The dunnage wall will be constructed of 16mm (5/8”) plywood in a minimum of two (2) sections.

Installation methods are to be provided by COR.

g. Marking and Packing the Contents of the Contain. Boxes and crates loaded into a

Container will be marked only with a project identification number and a box number. It will be the Contractor’s responsibility to ensure that all CAA Materials are properly packed to preclude any damage during shipment.

h. Packing List. At the CRP, the Contractor will ensure that each Container has a complete packaging list. A copy of this packaging list will be conspicuously affixes to the interior of the dunnage wall.

i. Shipping Documents. Immediately upon packing a Container, the Contractor will ensure that all required customs documents are sent to the COR, to arrive at least fourteen (14) calendar days prior to arrival of the container at the Post. The Contractor will provide the originals of the bill of lading, pro form an invoice, and certificate of origin, to the COR. These documents will contain the following information:

1) Description of items.

2) Quantities.

3) Cost of items.

4) Weights of individual packages/boxes.

5) Volumes or Dimensions of individual packages/boxes.

E. Shipping Procedures

1. Secure Shipment. The Contractor may not securely ship U.S. procured CAA Materials identified in a BOM, or BOM Change, without having the COR’s security review and approval- coordination only.

a. Secure shipments of CAA materials may be done in one of two ways upon U.S.

Government approval:

1) Accompanied Shipments: Accompanied shipments which are securely containerized and under the 24-hour control of DS or other U.S. Government courier or escort officer. The Contractor will ship in accordance with the Contractor’s approved shipping plan; or

2) Technically Protected Shipment: Shipments which are securely containerized with DS-approved transit security technical safeguards installed. The Contractor will ship in accordance with the Contractor’s approved shipping plan.

2. Proposed Shipping Procedures. Within 30 calendar days after the date of obtaining a building permit, the Contractor will provide to the COR a plan for shipping all CAA Materials. This plan will include the following:

a. Location of the Contractor’s CRP.

b. Tentative shipping schedule of all CAA Materials to include planned loading dates of CAA Materials into each Container as well as loading dates of Containers onto identified ships.

c. Port of embarkation.

d. All scheduled or planned intermediate stops and transshipment points.

e. Estimated time and duration that material will be at intermediate stops and transshipment points or ports.

f. Port of debarkation.

g. Names of companies and countries of registry of contemplated air, sea carrier(s) and freight forwarder(s).

h. Description of system to be used to truck Containers so that Container location is available.

i. Description of overland route from point of debarkation to the Final Construction

Site identifying route numbers, border crossings, overnight stops, a detailed description of customs procedures at all border crossings, and estimated time of travel from the port to the SSA or Final Construction Site.

j. Identification of adequate secure storage at the SSA or Final Construction Site.

3. Approval of Proposed Shipping Plan. Within 30 days after the receipt of the proposed shipment plan, Diplomatic Security will provide the Contractor the written notification of his approval or disapproval of the Contractor’s proposed shipping plan.

4. Final Shipping Plan. Once final shipping dates are established, for each shipment, but no less than fifteen (15) working days prior to loading any Container, the Contractor will provide the following shipping information to to DS:

a. Actual date of loading CAA Materials into each Container

b. Schedule date of embarkation.

c. Shipping line.

d. Name and country of registry of the ship.

e. Identification of all intermediate stops and transshipment points or ports.

f. Estimated time and duration that material will be at intermediate stops and transshipment points or ports.

g. Estimated time of arrival at the debarkation point.

h. Any changes to the previously submitted overland shipping information.

5. Approval of Final Shipping Plan. DS will respond with approval or disapproval within seven (7) working days after receipt of the final shipping plan. Approval must be obtained before the Contractor proceeds to ship any CAA Materials. The Contractor’s failure to comply with the approved shipping plan may lead to rejection of some or all of the CAA Materials. Replacement and delay cost will be the sole responsibility of the Contractor.

6. Transshipment Ports

a. Unless approved by DS, no CAA Materials will be transshipped through Countries identified as Critical Threat Countries on the DOS Composite Threat List.

b. Containers will not remain at any port for more than 96 hours before being loaded on a connecting vessel. Any Container that does not conform to these criteria, without prior DOS approval, may be declared compromised and its contents rejected for use in the CAA.

7. The Contractor shall provide rates from at minimum (2) most competitive rates from ocean or air transportation companies.

F. Consignment and Customs Clearance of CAA Materials

1. Consignment. Shipments will be consign as follows:

a. TO BE PROVIDED UNDER SEPARATE COVER BY PROJECT COR

Customs Clearance: The Contractor is responsible for obtaining any necessary custom’s clearances for the countries through which CAA Materials will pass. COR will assist obtaining Host country customs broker agency.

G. Arrival of Secure Shipments and Transport to Site

1. Container Removal from Port: The Contractor will notify the COR of the arrival of securely shipped CAA Material at the local air or sea port. When customs clearance of all such materials has been granted, in coordination with Post, the Contractor will arrange for the transport of the material from the port of debarkation to the SSA and from the SSA to the Final Construction Site. If necessary The CSA/COR will assist to arrange for cleared U.S. Citizen escort personnel to accompany the materials in transit from the port of debarkation to the Final Construction Site.

2. Removal of the Dunnage wall. For each Sea Container, the Contractor shall allow a minimum of four (4) hours and two (2) hours for Air Containers of unimpeded and unobserved access at either the SSA or Final Construction Site for the removal of the dunnage wall and Contractor decertification procedures by U.S. Government representative, Post Regional Security Manager (RSO) or identified by the COR.

a. The Contractor will arrange for secure rooms at the Post for use as the Project’s SSA for storage of CAA Materials. The Contractor will determine the required location and size to adequately handle materials for use in the CAA.

b. The SSA must be under the 24-hour control of U.S. Citizens with DS-approved intrusion detection systems or other DS-approved methods. Certified containers stored on the Final Construction Site protected by the site security systems (MSG Post 1, CCTV, Fence Protection Systems (FPS), other alarms and locking devices) may be used as alternate SSAs until decertified. Uncertified containers appropriately alarmed and secured with DS-approved alarms and locking devices under the protection of the perimeter security systems may also be used as alternative SSAs.

3.5 SECURITY AT PROJECT SITE

A. General Procedures: Utilize security facilities, as provided under Section 15010 hereof "Temporary Facilities," for the purposes intended and as directed by COR/PM. Specifically, comply with Government's instructions for use of secure staging/storage, site enclosure and gates, temporary security lighting, building space enclosure and lockup, devices and systems as established for detection/monitoring/ signaling/alarming, field office facilities including telephones and locked containers for classified information, and interfaces with Government's security forces/facilities/ procedures at the Project Site. Government reserves the right to implement, at various times/stages of work performance, whatever security procedures may be recognized as necessary for its interests; and to perform related tests and inspections as may be required.

1. Cleared Americans: Comply with applicable provisions of "Regulation to Strengthen

Security ... Security and Anti-terrorism Act of 1986," as indicated by these Contract Documents and as requested by Government's security managers through COR. Use only cleared American persons for the security-related installation of systems and equipment, cleared for the following classification, except as otherwise indicated.

a. Classification of TOP SECRET cleared American personnel.

b. As an exception to foregoing American personnel requirements, use of local national tradespersons will be permitted for placement of mechanical equipment on roof of the building; but only following Post specific requirements during times when such persons are under surveillance by Government's CSTs, or COR or cleared Americans.

2. Uncleared Persons: Do not use foreign nationals from Designated countries in the performance of work at Project Site, except as may be specifically authorized by the COR.

Otherwise, the use of uncleared persons, including foreign nationals from other than Designated countries, is subject to the following limitations, which are subject to minor adjustments by the COR depending on circumstances encountered, which may vary during course of performing the work:

a. Limit uncleared persons performing work in CAAs and contiguous areas to times at which persons are under CST surveillance.

3. Work Schedules: Integrated with job progress reporting procedure, as specified in 013000-series sections hereof, provide a weekly, security oriented, abbreviated, work schedule.

Submit to COR, on last working day of each week, the projected listing of work to be performed during the following week; with emphasis on security-related requirements.

Show, for each category of work, the locations and products/materials to be installed; and show anticipated receipt of CAA products, including time of arrival and number of trucks or volume of shipment, and identification of trucks/carriers/ documentation to be expected for arrival at Project Site.

B. Access to Site: In addition to personnel selection and clearance requirements of preceding article in this section, and other requirements for the bringing of CAA products onto the Site, comply with the following security provisions related to Project Site operations and procedures:

1. Identification Badges: Upon approval of each completed employment Form OF-174, Government will issue to employee an identification badge, coded to indicate status and level of security clearance. Require cleared Americans to retain their badges.

Badges/documents will be exchanged as employee departs from the Project Site. Require employees to wear badges displayed, when at the Project Site.

a. Government will provide required badge.

b. Admission to Project Site will be permitted by Government's guard, only after exchange of badge-for-document, and after guard's identification of person requesting admission.

c. Cleared American visitors, when authorized by COR to enter Project Site, will be issued a "cleared visitor badge."

d. Require all employees to surrender ID badges when access to Project Site is no longer authorized or needed; and upon demand of COR (at any time, and in cooperation with SSM).

e. Loss of badge, or repeated failure to comply with required surrender of badge; may, at COR's discretion, result in person being denied access to Project Site for one working day, at no cost to Government; and may require submission/approval of new Form OF-174.

2. Search Procedures: Government reserves the right to conduct a search of belongings, both at the point of entering the Project Site and at the point of leaving. All persons entering and leaving the Project Site will be required to pass through a WTMD device (walk-through metal detector).

3. Provide tool lockers in a protected space inside Project Site; for the convenience of employees who elect to leave personal tools/devices/protective gear at Project Site daily, in lieu of subjecting such items to gate security procedures.

C. Access Procedures at Secure Storage: Locked control of secure storage facility belongs exclusively to Government (specifically to SSM), immediately upon Contractor's completion of temporary storage facility; see Section 15010 hereof. Keyed lock will be provided by Government, and access to key will be limited to cleared American personnel; with SSM-controlled sign out/sign in of key.
