About this file
This document summarizes questions and responses related to a solicitation for a Regional Multiple Award Construction Contract issued by the Department of Justice Federal Bureau of Investigation Headquarters Division. The solicitation seeks construction services including design-build, design-bid-build, and early contractor involvement for projects located throughout the continental United States as well as within 200 miles of Redstone Arsenal and the National Capital Region. Offerors must demonstrate relevant past performance through no more than three project examples and provide resumes for key personnel. Questions clarify requirements for proposals, past performance submissions, security clearances, and treatment of teaming partners and subcontractors. Responses address these inquiries and in some cases revise the solicitation's instructions.

Submission of CPARS is not acceptable. We have access to the CPARS database.
N33 See amendment 0002 revising paragraph L15.3 Past Performance removing the requirement for submission of
Attachment 5 for subcontractors.
Section L15.3
Section L8
Past Performance - The RFP states that "Projects should be… located within 200 miles of the region/pool named…." As the
Region 1 pool is for "Emphasis on supporting Redstone Arsenal and other projects throughout the CONUS", please clarify whether experience projects have to be within 200 miles of Redstone Arsenal, or could be anywhere within the CONUS.
Multiple Awards - "The Government intends to award a minimum of three (3) IDIQ contracts per region/pool." This is changed from the October RFP that stated up to five (5) contracts. Does this change indicate that the Government might contemplate making more than 5 awards per pool, or is the preference now to have a smaller pool?
RFP Section L, L15.3
The RFP requires submission of Attachment 5 PPQ for relevant projects. Several of our clients for our relevant past performance prefer we utilize previously completed PPQs provided while others have informed us they cannot complete the requested PPQ form in addition to a completed CPARS evaluation. Please confirm that a previous completed PPQ or completed CPARS evaluation is acceptable for submission to document our Past Performance.
Section L.15.3 Past Performance
Please clarify whether our 3 Past Performance projects should be for entire IDIQ contracts, or for specific projects, i.e. task orders, under an IDIQ type contract, as the instructions use both terms.
Region 1: Experience projects can be anywhere on the CONUS; Region 2: Experience projects must be within 200 miles of Redstone Arsenal (RSA) region centered in Huntsville, AL and the National Capital Region (NCR), including but not limited to, the FBI Academy in Quantico, VA, FBI Headquarters in Washington, DC and the Criminal Justice Information
Services (CJIS) Division in Clarksburg, WV)
The RFP requires projects submitted to demonstrate past performance "be located within 200 miles of the region/pool named…" For Region 1 which will include projects throughout the continental United States (CONUS), may past projects be located anywhere within CONUS or should they be limited to those within 200 miles from the Redstone Arsenal, Huntsville, AL?
Regarding Design firm's projects, does only the design need to have been completed within the past five years, or also the construction of the project?
Given the recent Thanksgiving Holiday and pending Christmas Holiday, and the difficulty of securing PPQs from clients who are often unavailable at this time of year, please consider a one week extension to the proposal due date.Section L.15.3 Past Performance

Section L.15.3 Past Performance
We have found that different agencies define "substantial completion" differently, with respect to project relevance criteria.
Would a project that is 90% complete be considered to have achieved substantial completion?

Section L8
L.14 Delivery Instructions
Page 56 of the RFP states that Offerors shall submit "an electronic copy (CD or DVD) and five (5) duplicate hardcopy sets, whereas Table 2 on page 57 states 6 Total Hard Copies for Volume 1. Please clarify the number of hard copies to be submitted.
Section L.15.3 Past Performance Is it acceptable to submit previously completed PPQs or CPAR evaluations from our clients in lieu of soliciting new PPQs?
Section L.15.3 Past Performance
The instructions state to use 1" margins on the top and bottom. Please clarify whether this 1" margin is in addition to the
Headers and Footers, or only in addition to the text.
Section L.15 Table 2
According to Table 2, the Tab F Organizational Conflict of Interest information is included in Volume 1, but we are only to provide 2 copies. Should this be included in Volume II, which requires two copies, rather than Volume I, which requires 6 copies?
Section L.15.3 Past Performance
The instructions state that "Experience by other corporate entities or JVs not named on the Standard Form (SF) 1442 is prohibited and will not be evaluated." We are a wholly-owned subsidiary of a larger corporation, and we perform projects under both our own name and under our parent corporation's name. The relevant projects we need to submit include both.
Please confirm that this is acceptable, as long as we clearly state that we are the entity that performed the work.
Section L.15.3 Past Performance
Attachment 10 Corporate Performance Reference appears to be specific to Design firm experience, and does not include a block 29, as referenced in the instructions. Should there be a different form for construction projects?

RFP 15F067-19-R0000004 0006 RMACC, Responses to Inquiries January 11, 2019
Section L15.5, page 61
There are conflicting answers to the question regarding the two sealed envelopes for Tab E. Q85 seems to indicate that the two envelopes are for (1) original and (1) copy of all documentation. Q99 indicates that the one envelope is for the KMPL and the other for the ARQ.
Amendment 0002, which governs over the Q&A, now seems to indicate that (4) sealed envelopes are required "one(1) containing the completed KMPL and one (1) containing the completed ARQ. It shall also include two (2) separate sealed envelopes containing a copy of the completed KMPL, and a copy of the completed ARQ." Please confirm that 4 sealed envelopes are to be included in the Original Volume 1, or provide additional clarification.
Section L.15.3 Past Performance
Due to the fact that answers to questions and Amendment 0002 were not released until, effectively, one day before the
Christmas holiday, and Offeror's project selection could not be finalized until the government provided clarifications on relevance and PPQs, we now respectfully ask for another extension to the due date in order to allow additional time to solicit the required PPQs.
Region 1: Experience projects can be anywhere on the CONUS; Region 2:
Experience projects must be within 200 miles of Redstone Arsenal (RSA) region centered in Huntsville, AL and the
National Capital Region (NCR), including but not limited to, the FBI Academy in Quantico, VA, FBI Headquarters in
Washington, DC and the Criminal Justice Information Services (CJIS) Division in Clarksburg, WV.
The requirement will be changed to read: "The Offeror shall provide present/past performance for a maximum of three
(3) projects for the Prime Contractor. Region 1: Experience projects can be anywhere on the CONUS; Region 2: Experience projects must be within 200 miles of
Redstone Arsenal (RSA) region centered in Huntsville, AL and the National Capital Region (NCR), including but not limited to, the FBI Academy in Quantico, VA, FBI Headquarters in Washington, DC and the Criminal Justice Information
Services (CJIS) Division in Clarksburg, WV. see Amendment 0002
The paragraph will be revised to specify "Contractor key personnel"; two (2) page limit with the last five years. The
Contractor shall determine its key personnel. All other requirements remain as written. see Amendment 0002
See FAR Part 9.108 Prohibition on Contracting With Inverted Domestic Corporations and and other FAR clauses/provisions in the solicitation that address "foreign ownership" i.e. (not all inclusive) FAR 52.209-2
Prohibition on Contracting with Inverted Domestic Corporations--Representation and 52.209-10 Prohibition on
Contracting with Inverted Domestic Corporation. No proposals will be evaluated before the proposal due date.
A TS FCL shall be required for all awarded IDIQ contracts. While the Government will sponsor non-TS Cleared, certain restrictions apply to Region 3. Offerors who are deemed the highest rating and within the competitive range for Region
3 Phase II must have an active TS FCL at time of proposal submission in order to receive documents for competition within in the final phase.
Contract Data Requirement List (CDRLs). There are no CDRLs for Phase I of the solicitation.
It is up to the contractor to determine how to prepare its matrix. See the revised Table 2 and 3 for placements; see
Amendment 0002
24 See the revised Table 2 and 3 for placements; see Amendment 0002
25 Unless an amendment is issued to the solicitation, these requirements remain as written.
26 The agency and office for which the design/construction project was or is being performed.
27 The Table of Contents is not included in the page count.
28 Yes, for three (3) projects only using Attachment 5 Past Performance Questionnaire.
The Offeror shall provide present/past performance for the prime contractor for applicable present/past projects. Past performance shall demonstrate present/past performance on projects of the similar size, scope, cost, and complexity
(IDIQs for Design-Build, Design-Bid-Build construction, renovation, new construction) . . . . Disregard the reference to block 29; see Amendment 0002.
There is an asterisk indicated in the table. Does these mean the pages for this Tab are unlimited?
TAB C: Past Performance, Page 58
TAB C: Past Performance requires that past performance be provided for the prime contractor and subcontractors. Which particular subcontractors past performance is to be submitted? Just design firm or various subcontractors such as electrical, mechanical, etc.?
This paragraph requires volume number, tab section and page number to be placed at the bottom (foot note) of each page.
Additionally, Paragraph L.7.2, Page 51 and subparagraph permits the Offeror to add additional information at the bottom of each page. All this required/permitted information at the bottom of each page becomes way too much. It is requested that some of the requirements be deleted.
Paragraph L.16 references "Releasing agency and office". Who is this?
This Table states that the page limit for Tab A is one ? A table of contents and a title page is required. Are both of these considered to be one page?
Section L, Paragraph L.15, Page 57
RFP
Section L, Page 52
L15.3 TAB C
Section L.15.3, Volume I, Tab C: Past Performance states: "The Offeror shall provide past performance for the Prime
Contractor and all proposed subcontractors."
Please consider narrowing the proposed Subcontractors we are asked to provide. Since there are so many different project types that will be in this RMACC (e.g. Opps, Tech, Commons) we would like to only submit our information as the Prime Offeror. We believe this benefits the Government. This will allow us to choose team partners and subcontractors that specialize in each of the different types of buildings per Task Orders, such as SCIF Office
Buildings, Fitness Centers, Retail, Repositories, Training Centers, Parking Garages, etc…
RFP L15.4.2.2 Project Management Plan
Section L15.4.2.2 Project Management Plan asks for the following resumes: “Include resumes using Attachment 6 Resume
Template for the following key personnel: Lead Architect, Lead Mechanical Engineer, Lead Civil Engineer, Lead Electrical
Engineer and Senior Project Manager, subcontractors and/or consultants.”
We are concerned that the required resumes are not related to the requirements described in Section C.1 Introduction and C.2
Scope for providing “construction services” and “a wide range of construction and alteration services including…but not limited to Design-Build, Design-Bid-Build, or Early Contractor Involvement (ECI).” As we are asked to provide construction services, we would expect the Government to expect to see qualifications for a Project Executive, Senior PM, Superintendent, Quality
Control Manager, etc. These personnel would assure our excellence in performing construction services as opposed to the asked for Engineers and Architects, personnel whom would come from our Design Partner and only be relevant on the Design-
Build Task Orders released via this RMACC.
Please consider changing the required resumes in Tab D Section L15.4.2.2 Project Management Plan as the current requirements are more suited for an Architect/Engineer (A/E) firm.
RFP F
Section 39.1, Company Threat Assessment states: "All entities referenced in a proposal (Offeror, A/E Team, Construction Firm, and all subcontractors) will be subject to a Company Threat Assessment (CTA) by the FBI to screen for potential Supply Chain
Risk Management issues. If the Contractor or any of its team members are owned or controlled by a foreign person or entity, either in whole or in part, such foreign ownership, control, or influence must be fully disclosed and the Government may require additional information. The Government reserves the right to restrict participation by any foreign-owned entity or require mitigation of foreign control."
Section L.15.5, Volume I, Tab E: Security states: "Participation by foreign owned entities prohibited for the project."
Section L. 15.5 does not provide a definition of what constitutes "foreign ownership" to determine whether or not a firm is "foreign owned". We find that this is not a simple determination given today's global economy and especially for publicly traded companies where "ownership" is actually held among shareholders. Since Section 39.1 indicates all proposed companies must fully disclose any foreign Ownership and a threat assessment will be performed, could the sentence in Section L 15.5 read that participation by foreign Owned entities "may" be prohibited or could this sentence be struck all together? We are accustomed to filling out the threat assessments or FOCI Mitigation Plans when faced with secure projects and we plan on doing the same for this project. Will this approach suffice for this
RFP or will there be some independent early determination by the government as to each firms' status as foreign owned or not?

Attachment 4 Department of State Security
Requirements for LEGAT OCONUS Work
AND
Attachment 7 General Requirements RMACC
Attachment 4, the Department of State Security Requirements for LEGAT OCONUS Work (Region 3) makes numerous references to required security clearances for overseas work.
Attachment 7, RMACC Division 01 00 00 makes no mention of security clearances.
Please clarify if a security clearance is only required for Region 3, OCONUS work.
Section L.15.3, Volume I, Tab C: Past Performance states: "Projects should have achieved at least the level of substantial completion within the last five (5) years, be located within 200 miles of the region/pool named and be of similar size/scope/dollar value"
Since so much of the work in Region 1 Unrestricted is planned for Redstone Arsenal, is our assumption that the 200 mile radius of Redstone Arsenal for the Past Performance Example Projects must be maintained. We recommend that 200 mile radius for projects be from Huntsville, so experience can show that the Prime Contractor knows the market and has a proven track record of experience in the region. In other words, PPQ projects submitted must be performed within a 200 mile radius of
Redstone Arsenal (and not all CONUS) for Region 1 Unrestricted responses?RFP L.15.3 TAB C

Section L, Paragraph L.12, Page 55
Section L, Paragraph L.15, Table 2, Page 57
Section L, Paragraph L.12.2, Page 55
The first paragraph on Page 52 requires the Offeror to prepare a cross-reference matrix for each of the volumes. This is confusing as to exactly how this matrix is to be prepared with so much information requested. Can an example be presented in the RFP. Also, where is this matrix presented in the Offeror's proposal? Also define CDRLs.
Paragraph L.12.2 discusses a matrix again. Where is this matrix presented in the Offeror's proposal ?
Paragraph L15.3 addresses submission of Attachment 5 Past Performance Questionnaire (Unlimited pages; 3 projects only), Attachment 10 Corporate Performance Reference Questionnaire (2 pages per project), and a copy of teaming/joint venture agreement(s) in accordance with SBA policy. Disregard reference to block 29; see Amendment
0002.
Include resumes using Attachment 6 Resume Template for all Offeror’s Key Personnel including the Offeror’s Program
Manager and Lead Architect. Resumes shall include projects of similar size/scope & dollar value and substantially completed within the last five (5) years. Resumes are limited to two (2) pages per individual and shall not be included in the twenty (20) page limitation. see Amendment 0002.
32 You may include the cover letter if you desire; however, you shall not exceed the page limitations.
33 It is your choice to include the cover letter within your proposal submission or have the reference return it.
Attachment 10 is to be completed for all Attachment 5 Past Performance references. It shall be placed under Tab C as required. Disregard the reference to block 29; it will be removed. see Amendment 0002
All information on pages 2 through 6 shall be completed by each reference; A max of three (3) projects for prime only;
amendment forthcoming
36 A max of three (3) projects for the Prime contractor only.
The Offeror shall only submit the completed Page 1 of Attachment 5 to identify the agency point of contact completing
Attachment 5 PPQ; amendment forthcoming
38 The intent is to evaluate past performance for the prime Contractor only; see Amendment 0002
No, past performance required under paragraph L15.3 using Attachment 5 shall be completed by references only
(commercial companies and/or government agencies for which the work was performed); not the Offeror. It is the governments intent to evaluate past performance for the Prime contractor.
The Government has assess to CPARS data. Attachment 5 shall be completed and submitted by your past performance reference.
The Offeror shall provide present/past performance for the prime contractor only. If the design team is a part of the prime company, then Attachment 10 would be completed for the prime company as a whole; see Amendment 0002
43 Yes, Include two (2) sealed envelopes in each hard copy of the proposal.
Region 1: Experience projects can be anywhere on the CONUS;
Region 2: Experience projects must be within 200 miles of Redstone Arsenal (RSA) region centered in Huntsville, AL and the National Capital Region (NCR), including but not limited to, the FBI Academy in Quantico, VA, FBI Headquarters in Washington, DC and the Criminal Justice Information Services (CJIS) Division in Clarksburg, WV)
45 No, unrestricted with a total of three (3) contract awards; competition open to large and small businesses.
46 Three (3) projects for the Prime Contractor; see Amendment 0002
It states the offeror shall submit key management personnel list and acquisition risk questionnaire for itself and each subcontractor offered in its proposal. page 57 of 84 of the RFp L.15 Phase I Proposal Submission Table 2 Proposal Content &
Organization Tab E Security, under total hard copies it states 2 sealed envelopes. Q) Are we to submit the KMPL's & ARQ's within Tab E Security and in two (2) separate sealed envelopes?
L15.3 Volume I - Tab C
We have a great deal of experience working on similar projects as a prime contractor. However, as a small business, submitting projects completed within 200 miles of the region/pool is limiting. Would you consider extending the requirement to
500 miles?

Tab C Past Performance paragraph 1
It states to provide past performance for the Prime Contractor & all proposed subcontractors and to use Attachment 5 Past
Performance Questionnaire for up to three (3) projects. Q) Is the FBI's intention to have three (3) past performance questionnaires for the Prime Contractor in addition to three (3) from our design team?
Paragraph L15.3, Page 58
The third paragraph permits three (3) projects to be submitted using Attachment 5 Past Performance Questionnaire (PPQ). It states that the Offeror is to complete the first page (cover letter) and provide the PPQ to each reference. Should the offeror also complete the information at the top of Page 2 of 6 of the PPQ? Or is this information to be entered/prepared by each reference? This identical information on the cover letter.
Page 58 of 84 of the RFP Section L 15.3 Volume I
Tab C Past Performance, paragraph 3
It states the offeror shall provide the completed Attachment 10 Corporate Performance Reference Information for the individual reference we sent the PPQ's to. Q1) Does this apply for the Prime Contractor and the design team? Attachment X Corporate
Reference Information form says-Design Team & appears to be geard towards the design team. Q2) Can you please clarify if this form is required for both the Prime Contractor & the design team or just the design team?
Page 58 of 84 of the RFP Section L 15.3 Volume I
Tab C Past Performance paragraph 2
Q) Will the FBI permit offeror's to use previously completed Past Performance Questionnaires or CPARS in lieu of the
Attachment 5 Past Performance Questionnaire? Due to the holiday's and the constant request from our client's to complete the
PPQ's we have been having difficulty getting them back because they feel they've already completed them multiple times and don't have the time to continue to complete them.
TAB C: Past Performance, Page 58
One paragraph requires Attachment 10, Corporate Performance Reference Information be provided. The last sentence states the tab is limited to a page limitation of 2 pages per project. What exactly is to be submitted for each project? Is this the same information that is prepared with the Past Performance Questionnaire? Please clarify. Also, clarify "Block 29".
Section L, Paragraph L.15.4.2.2, TAB D:
Management Approach, Page 59
This Paragraph requires resumes on key personnel like Lead Architect, and other. There could be as many as ten (10) resumes to submit if you included the construction superintendent and even subcontractor personnel. TAB D is limited to 20 pages. Are the resumes to be considered part of these 20 pages? Are resumes to be submitted under this TAB or a separate location. It is suggested that a finite list of key personnel be indicated so there is no overkill on resumes.
Paragraph L.15.3 - TAB C Past Performance, There is a cover letter (first page) sent with the prepared PPQ to each reference. Is it necessary for the reference to return the cover letter with the completed PPQ? The cover letter and the PPQ have redundant information.
This paragraph requires the preparation of the PPQ which is to be sent to each reference. The reference completes the PPQ and returns directly to the government. Should a copy of the PPQ that was sent to the references be included at TAB C?
Paragraph L.15.3 - TAB C Past Performance, Paragraph L.15.3 - TAB C Past Performance, The fourth paragraph states that Attachment 10 Corporate Performance Reference Information should be completed and be placed at TAB C. Attachment 10 is titled "Corporate Performance Reference Information - Design Team". It appears that this information is for the design firm and not for information regarding the reference. There is also a mention of "block 29" which is not shown on the PPQ. Please clarify.
It states the offeror shall have up to three (3) projects each to represent the Past Performance for the Prime and all subcontractors. Q) If it's up to three (3) projects can we use two (2) projects that we've completed with our design team together & one (1) as the Prime Contractor? Q2) Is it the government's intention to evaluate both the Prime Contractor & the
Design team separately?
C.3.3 - Table 1
Amendment no. 0002 Responses
The Q&A and Amendment 0002 have many areas of contradiction. At points it says only the prime contractor should submit PPQs for no more than 3 projects (Q&A 89) and then at points (Q&A 57) it states that EACH subcontractor should submit 3 past performances.
Q&A 244 reiterates “No more than 3 projects.” Since this is both a design-bid-build and a design-build MACC, projects should be submitted by both the prime contractor and the proposed design firm (essentially a subcontractor). A clear response needs to be provided regarding exactly how many total number of projects can be submitted.
Table 2, Paragraqph L.15
Table 2, Paragraph L.15 indicates that Attachment 5 is to be presented in Volume 5 at TAB C. Attachment 5 is the PPQ that is sent to each project reference. What part of Attachment 5 is to be presented at TAB C?
L.15.3 - Past Performance
In Table 1, Region 1, the solicitation reads, "A minimum of three (3) large and small businesses greater than $12,00,001." Does this mean there is one slot set aside for small businesses or will 3 large and 3 small businesses be chosen?
The past performance requirements indicate that Offerors submit up to 3 projects. In paragraph three, the section reads, "Offeror shall have up to three (3) projects each to represent the Past Performance for the Prime and all subcontractors." Does this mean the Prime can turn in 3 projects and subcontractors/teaming members can turn in 3 projects? Or does this mean to turn in 1 project from each teaming member, including the prime and teaming member/subcontractor?
47 Attachment 10 is limited to two (2) pages per past performance project; see Amendment 0002
48 No page limit; limited to three (3) projectst; see Amendment 0002
49 Unlimited; See L.15, Phase I Proposal Submission Table 2 in Amendment 0002
50 The past performance shall be submitted for the Prime contractor
51 See revision in Amendment 0002
52 No, Attachment 5 shall be completed and submitted by your past performance reference.
The reference in paragraphs refers to Table 2 Proposal Content and Organization. The format for the electronic copy shall be the same as the hard copies.
Include resumes using Attachment 6 Resume Template for all the Contractors Key Personnel including the Offeror’s
Program Manager and Lead Architect. Resumes shall include projects of similar size/scope & dollar value and substantially completed within the last five (5) years. Resumes are limited to two (2) pages per individual and shall not be included in the twenty (20) page limitation. see Amendment 0002.
55 See paragraph L.9 for confirmation at the Table of Contents is not included in the page count.
56 Confirmed that projects may be within the last five (5) years.
57 The requirement for Tab F Organizational Conflict of Interest will be removed. see Amendment 0002
An amendment is forthcoming to remove the requirement for submission of Tab F Organizational Conflict of Interest document.
Language within the paragraph will be revised to read: "The Offeror shall provide present/past performance for a maximum of three (3) projects for the Prime Contractor."
60 PPQs do not need to be retransmitted if submitted t for the Prime and subcontractor.
61 The pages shall be double-sided where applicable.
62 Paragraph "L.14.2 HAND DELIVERY" is deleted; see Amendment 0002.
Region 1: Experience projects can be anywhere on the CONUS; Region 2:
Experience projects must be within 200 miles of Redstone Arsenal (RSA) region centered in Huntsville, AL and the
National Capital Region (NCR), including but not limited to, the FBI Academy in Quantico, VA, FBI Headquarters in
Washington, DC and the Criminal Justice Information Services (CJIS) Division in Clarksburg, WV)
64 The requirement of 5 years remains as written.
The Offeror requests removing the resumes for key peronnel from the 20 page limit for Tab D - Management Approach. Since the key personnel includes subcontractors and/or subconultants that are committed to being part of the Offeror's team, there is potential for over 10 resumes to be provided.
Tab F Organizational Conflict of Interest Question 6 states "Address how your company will preclude a perception of impaired objectivity by prohibiting transfers of personnel between contracts."
Please confirm the Government's intent by "contracts" is referring to contracts for Regional 1, Regional 2, and Regional 3 and if the Offeror is only pursuing a single Region this question is not applicable.
