ADMINISTRATIVE REQUIREMENTS

1.1 SUBMITTALS

Government approval is required for submittals with a "G" designation; submittals not having a "G" designation are for Contractor Quality Control approval. The following shall be submitted in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

SD-01 Preconstruction Submittals

The Contractor shall provide a separate activity in the Project Schedule for commissioning.

1.2 PROJECT SCHEDULING AND REPORTING (DEC 1998)

1.2.1 Project Schedule

The Contractor shall submit for approval a Project Schedule in accordance with specification Section 01 32 01.00 10 PROJECT SCHEDULE showing the manner in which he intends to prosecute the work.

1.2.2 Software Package and Equipment

The Contractor shall utilize a scheduling software to implement the requirements of Section 01 32 01.0010 PROJECT SCHEDULE. The program and data must be Windows compatible. These requirements are not intended to restrict the Contractors selection of an automated scheduling system but to establish a format which will allow use of the same program with government computers and automated information systems. The Contractor will provide at least one program installation and maintenance on a standalone government hardware complete with all program and data files. In accordance with Government instructions for system acquisition. Such installation shall be maintained for the duration of the project until fiscal completion and shall allow analysis of the project schedule by government personnel or agents without further cost to the Government. The Contractor will be required to submit a submittal register, transmittal log and schedule that are compatible with the Corps of Engineers Quality Control System (QCS).

1.2.3 Commissioning Option

If authorized in writing by the FBI Contracting Officer, the Contractor shall provide activities in the Project Schedule for the commissioning of each of the mechanical and electrical systems listed in Section 01 80 00 COMMISSIONING. Commissioning shall start only after all related work has been completed and all O&M manuals have been submitted and approved by the Government. However, in the development of the project schedule the contractor shall include sufficient time for the performance of all commissioning activities identified.

1.3 PAYMENTS TO CONTRACTORS:

The FBI shall not pay for on-site or off-site stored materials. Material shall only be paid for as the material is put in place/installed into the project and as the job progresses. This payment will only be made as satisfactory job progress is being made. See FAR clause 52.232-5 and Supplementary Provisions, paragraph 1.10 – 52.232-5.

1.4 PURCHASE ORDER:

One readable copy of all purchase orders for material and equipment, showing firm names and addresses, and all shipping bills, or memoranda of shipment received regarding such material and equipment shall be furnished to the Contracting Officer as soon as issued. Such orders, shipping bills or memoranda shall be so worded or marked that all material and each item, piece or member of equipment can be definitely identified on the drawings. Where a priority rating is assigned to a contract, this rating, the required delivery date, and the scheduled shipping date shall also be shown on the purchase order. At the option of the Contractor, the copy of the purchase order may or may not indicate the purchase price. (CENAB-CO-E)

1.5 EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE

See 52.249-5000, Basis for settlement of proposals and FAR Part 49.

Allowable cost for construction and equipment in sound workable conditions owned or controlled and furnished by a contractor or subcontractor at any tier shall be based on actual costs data for each piece of equipment or groups of similar serial and services for which the government can determine both ownership and operating costs from the contractor’s accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor’s accounting records, costs for that equipment shall be based upon the applicable provisions of EP1110-1-8 Construction Equipment Ownership and Operating Expenses Schedule, Region East. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the Contracting Officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.

Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d) (ii) and Far 31.205-36. Rates for equipment rented from an organization under common control, lease- purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established proactive of leasing the same or similar equipment to unaffiliated leases.

When actual equipment costs are proposed and the total amount of the pricing action exceeds the small purchase threshold, the Contracting Officer shall request the contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. The data shall be submitted on Standard Form 1411, Contract Pricing Proposal Cover Sheet.

1.6 NEGOTIATED MODIFICATIONS

Whenever profit is negotiated as an element of price for any modification to this contract with either prime or subcontractor, a reasonable profit shall be negotiated.

1.7 PARTNERING: (NOV 92)

In order to most effectively accomplish this contract, the Government is willing to form a cohesive partnership with the Contractor and its subcontractors. This partnership would strive to draw on the strengths of each organization in an effort to achieve a quality project done right the first time, within budget and on schedule. This partnership would be bilateral in make-up and participation will be totally voluntary. The partnering process is expected to be two days in duration and shall be initiated before the Initial Design Conference.

1.8 PERMITS

The permits listed below have been initiated by the Government. The Contractor is responsible for submitting updated concept permits to the respective agencies for final approval. After final approvals by the respective state agencies are received, the Government will furnish approval letters and permits to the Contracting Officer who will furnish the Contractor all such permits before or during construction. The Contractor shall abide by all permit requirements.

a. Erosion and Sediment Control (E&SC) Plans: The Contractor is responsible for submitting a concept plan for DEQ approval, and all subsequent phased development permit applications required to obtain the appropriate DEQ permits. All submittals shall be submitted to the Government for review and approval prior to going to DEQ.

b. Stormwater Management (SWM) Plans: The Contractor is responsible for submitting a concept plan for DEQ approval, and all subsequent phased development permit applications required to obtain the appropriate DEQ permits. c. Notice of Intent (NOI) to comply with the General Permit for construction activities in accordance with EPA's National Pollution Discharge Elimination System (NPDES) stormwater management program. The NOI form and general permit must be obtained by the Contractor. The NOI application shall be reviewed and approved by the Government and MPO prior to submittal to DEQ.

1.9 SITE SECURITY PERSONNEL

Site Security personnel shall be consistent with Government requirements. Specific requirements will be determined based on location and nature of the project. Individual Task Orders will provide specific requirements.

1.10 SITE SECURITY MEASURES

Site Security measures shall be consistent with Government requirements. Specific requirements will be based on location and nature of the project. Requirements will be dictated in each Individual Task Order.

1.11 SECURITY SIGNAGE

Signage, to include signs dealing with security requirements, shall be consistent with Government requirements.

Specific requirements will be determined based on design. Security related signage will be provided by the Government including signs to be posted at all pedestrian/vehicle access control points identifying prohibited items and activities that are not authorized on the construction site.

1.12 PROHIBITED AND RESTRICTED ITEMS

1.13.1 Prohibited Items

The items and activities that are prohibited on the construction site are listed in paragraph PROHIBITED ITEMS in the SCSP. The SSM, however, has the authority to grant waivers on a case- by-case basis. The Government also reserves the right to prohibit additional items not covered in the SCSP. If the Contractor wishes to use powder-actuated tools on the construction site, he shall complete and submit to the Contracting Officer the Use Permit for Powder-Actuated Fastening Systems attached at the end of this section.

1.13.2 Restricted Items

Photographic, video recording equipment, computers, and removable computer memory devices are restricted on the construction site. Waivers to this restriction can only be approved by the SSM.

1.13.3 Photography and Video Recording

a. No photography/video recording shall be permitted on the construction site unless authorized in writing by the SSM and coordinated through the Contracting Officer. This restriction includes all cell phone/PDA cameras.

b. Only FBI personnel shall be authorized to take photographs or video recordings. The Contractor may request photographs or the videoing of work by identifying the work, objects, or areas to be photographed, furnishing the name of the individual and the associated company requesting the recordings. These request must be submitted not less than forty-eight (48) hours in advance. No separate or independent photography or video recording shall be permitted by the FBI.

c. Any person found taking unauthorized photographs or video recordings shall be stopped immediately, may be held for questioning and, at the option of the Government, result in removal of the person from the site. Their camera equipment and photographs may be destroyed with no liability to be incurred by the Government. All resultant costs shall be borne entirely by the Contractor.

1.13.4 Computers and Removal Memory Devices

a. No personal computer, either individually- or company-owned, and/or removable memory device (e.g.

memory sticks, read-write CDs) shall be permitted on the construction site unless authorized in writing by the SSM and coordinated through the Contracting Officer.

b. Requests for using personal computers on-site shall be submitted in writing not less than forty-eight (48) hours prior to bringing them onsite. Request forms are available from the SSM.

c. Unauthorized computers and/or removable memory devices may be seized, and possibly destroyed, by the Government with no liability incurred by the Government. All resultant costs shall be borne entirely by the Contractor.

1.14 PERSONNEL BEHAVIOR

a. An acceptable standard of conduct and dress shall prevail at the construction site at all times. The SSM Security Office, through the Contracting Officer, reserves the right to exclude or remove from the site any person whose dress or conduct is deemed to be inappropriate, careless, uncooperative, or otherwise contrary to the public interest.

b. The use of alcohol or any illegal drugs on the construction site is prohibited. Any person caught consuming alcohol or reports to the site in an intoxicated or impaired condition willbe denied access to the site. Any person caught using illegal drugs on the construction site will be turned over to law enforcement authorities and removed from the construction site.

c. The Government has a zero tolerance policy for harassing behavior and it will not be tolerated on the construction site. Writing or display of offensive language, graffiti, sexual graphics, or offensive bumper stickers will be considered a form of harassing behavior. Any person found to be culpable in incidents of harassment may be immediately escorted from the site and denied further access.

d. All persons entering the construction site shall comply with the Government policy that smoking is permitted in designated areas only. Smoking is prohibited inside all Government facilities.

1.15 GOVERNMENT SURVEILLANCE

During construction, the Government will maintain security surveillance of the construction site. This surveillance may include radio controlled vehicular and/or aerial patrols, CCTV, Government Security Representatives maintaining visual coverage of the site, illumination of the construction site, or by other means at the option of the Government.
