The previous solicitation you reference was canceled and has no impact to 15F067-19-R0000004 RMACC. As written thoughout the solicitation, the Government is only specifying its intent for the minimum number of awards for IDIQ contracts per Region/Pool.

Reference "C.3.1 REGION 1: Region 1 will consist of large and small businesses located throughout the Continental United States (CONUS) who will bid on projects with estimated values greater than $12,000,001, not including fit-out costs." and "Table 1 RMACC REGIONS"

Use 1 inch for the top and bottom margins and 1 inch for the left and right margins and is inclusive of the header/foot information.

Section L.15.3, Volume I, Tab C: Past Performance states: "Projects should have achieved at least the level of substantial completion within the last five (5) years, be located within 200 miles of the region/pool named and be of similar size/scope/dollar value"

Since so much of the work in Region 1 Unrestricted is planned for Redstone Arsenal, is our assumption that the 200 mile radius of Redstone Arsenal for the Past Performance Example Projects must be maintained. We recommend that 200 mile radius for projects be from Huntsville, so experience can show that the Prime Contractor knows the market and has a proven track record of experience in the region. In other words, PPQ projects submitted must be performed within a 200 mile radius of Redstone Arsenal (and not all CONUS) for Region 1 Unrestricted responses?

The RFP requires projects submitted to demonstrate past performance "be located within 200 miles of the region/pool named…" For Region 1 which will include projects throughout the continental United States (CONUS), may past projects be located anywhere within CONUS or should they be limited to those within 200 miles from the Redstone Arsenal, Huntsville, AL?

Regarding Design firm's projects, does only the design need to have been completed within the past five years, or also the construction of the project?

Given the recent Thanksgiving Holiday and pending Christmas Holiday, and the difficulty of securing PPQs from clients who are often unavailable at this time of year, please consider a one week extension to the proposal due date.Section L.15.3 Past Performance

Page 56 of the RFP states that Offerors shall submit "an electronic copy (CD or DVD) and five (5) duplicate hardcopy sets, whereas Table 2 on page 57 states 6 Total Hard Copies for Volume 1. Please clarify the number of hard copies to be submitted.

Section L.15.3 Past Performance Is it acceptable to submit previously completed PPQs or CPAR evaluations from our clients in lieu of soliciting new PPQs?

The instructions state to use 1" margins on the top and bottom. Please clarify whether this 1" margin is in addition to the Headers and Footers, or only in addition to the text.

As the Region 1 pool is for "Emphasis on supporting Redstone Arsenal and other projects throughout the CONUS", please clarify whether experience projects have to be within 200 miles of Redstone Aresenal, or could be anywhere within the

CONUS.

Multiple Awards - "The Government intends to award a minimum of three (3) IDIQ contracts per region/pool." This is changed from the October RFP that stated up to five (5) contracts. Does this change indicate that the Government might contemplate making more than 5 awards per pool, or is the preference now to have a smaller pool?

Section L.15 Table 2

According to Table 2, the Tab F Organizational Conflict of Interest information is included in Volume 1, but we are only to provide 2 copies. Should this be included in Volume II, which requires two copies, rather than Volume I, which requires 6 copies?

Section L.15.3 Past Performance

The instructions state that "Experience by other corporate entities or JVs not named on the Standard Form (SF) 1442 is prohibited and will not be evaluated." We are a wholly-owned subsidiary of a larger corporation, and we perform projects under both our own name and under our parent corporation's name. The relevant projects we need to submit include both. Please confirm that this is acceptable, as long as we clearly state that we are the entity that performed the work.

Section L.15.3 Past Performance Attachment 10 Corporate Performance Reference appears to be specific to Design firm experience, and does not include a block 29, as referenced in the instructions. Should there be a different form for construction projects?

Section L.15.3 Past Performance We have found that different agencies define "substantial completion" differently, with respect to project relevance criteria. Would a project that is 90% complete be considered to have achieved substantial completion?

The RFP requires submission of Attachment 5 PPQ for relevant projects. Several of our clients for our relevant past performance prefer we utilize previously completed PPQs provided while others have informed us they cannot complete the requested PPQ form in addition to a completed CPARS evaluation. Please confirm that a previous completed PPQ or completed CPARS evaluation is acceptable for submission to document our Past Performance.

Section L.15.3 Past Performance Please clarify whether our 3 Past Performance projects should be for entire IDIQ contracts, or for specific projects, i.e.

task orders, under an IDIQ type contract, as the instructions use both terms.

The requirement will be changed to read: "The Offeror shall provide present/past performance for a maximum of three (3) projects for the Prime Contractor.

The paragraph will be revised to specify "Contractor key personnel"; two (2) page limit with the lastfive years. The Contractor shall determine its key personnel. All other requirements remain as written. see Amendment 0002

Section H Special Contract Requirements not provde a definition of "foreign ownership" as FAR Part

9.108 Prohibition on Contracting With Inverted Domestic Corporations and FAR clauses in the soliciation to address such situations of "foreign ownership" i.e. (not all inclusive) FAR 52.209-2 Prohibition on Contracting with Inverted Domestic Corporations--Representation and 52.209-10 Prohibition on Contracting with Inverted Domestic Corporation.

A TS FCL shall be required for all awarded IDIQ contracts. While the Government will sponsor non- TS Cleared, certain restrictions apply to Region 3. Offerors who are deemed the highest rating and within the competitive range for Region 3 Phase II must have an active TS FCL at time of proposal submission in order to receive documents for competition within in the final phase.

Contract Data Requirement List (CDRLs). There are no CDRLs for Phase I of the solicitation.

It is up to the contractor to determine how to prepare its matrix. See the revised Table 2 and 3 for placements; see Amendment 0002

Paragraph L15.3 addresses submission of Attachment 5 Past Performance Questionnaire (Unlimited pages; 3 projects only), Attachment 10 Corporate Performance Reference Questionnaire (2 pages per project), and a copy of teaming/joint venture agreement(s) in accordance with SBA policy.

One paragraph requires Attachment 10, Corporate Performance Reference Information be provided. The last sentence states the tab is limited to a page limitation of 2 pages per project. What exactly is to be submitted for each project? Is this the same information that is prepared with the Past Performance Questionnaire? Please clarify. Also, clarify "Block 29".

The first paragraph on Page 52 requires the Offeror to prepare a cross-reference matrix for each of the volumes. This is confusing as to exactly how this matrix is to be prepared with so much information requested. Can an example be presented in the RFP. Also, where is this matrix presented in the Offeror's proposal? Also define CDRLs.

Paragraph L.12.2 discusses a matrix again. Where is this matrix presented in the Offeror's proposal ?

This paragraph requires volume number, tab section and page number to be placed at the bottom (foot note) of each page. Additionally, Paragraph L.7.2, Page 51 and subparagraph permits the Offeror to add additional information at the bottom of each page. All this required/permitted information at the bottom of each page becomes way too much. It is requested that some of the requirements be deleted.

Paragraph L.16 references "Releasing agency and office". Who is this?

This Table states that the page limit for Tab A is one ? A table of contents and a title page is required. Are both of these considered to be one page?

TAB C: Past Performance requires that past performance be provided for the prime contractor and subcontractors.

Which particular subcontractors past performance is to be submitted? Just design firm or various subcontractors such as electrical, mechanical, etc.?

Section L.15.3, Volume I, Tab C: Past Performance states: "The Offeror shall provide past performance for the Prime Contractor and all proposed subcontractors."

Please consider narrowing the proposed Subcontractors we are asked to provide. Since there are so many different project types that will be in this RMACC (e.g. Opps, Tech, Commons) we would like to only submit our information as the Prime Offeror. We believe this benefits the Government. This will allow us to choose team partners and subcontractors that specialize in each of the different types of buildings per Task Orders, such as SCIF Office Buildings, Fitness Centers, Retail, Repositories, Training Centers, Parking Garages, etc…

RFP L15.4.2.2 Project Management Plan

Section L15.4.2.2 Project Management Plan asks for the following resumes: “Include resumes using Attachment 6 Resume Template for the following key personnel: Lead Architect, Lead Mechanical Engineer, Lead Civil Engineer, Lead Electrical Engineer and Senior Project Manager, subcontractors and/or consultants.”

We are concerned that the required resumes are not related to the requirements described in Section C.1 Introduction and C.2 Scope for providing “construction services” and “a wide range of construction and alteration services including…but not limited to Design-Build, Design-Bid-Build, or Early Contractor Involvement (ECI).” As we are asked to provide construction services, we would expect the Government to expect to see qualifications for a Project Executive, Senior PM, Superintendent, Quality Control Manager, etc. These personnel would assure our excellence in performing construction services as opposed to the asked for Engineers and Architects, personnel whom would come from our Design Partner and only be relevant on the Design-Build Task Orders released via this RMACC.

Please consider changing the required resumes in Tab D Section L15.4.2.2 Project Management Plan as the current requirements are more suited for an Architect/Engineer (A/E) firm.

Section 39.1, Company Threat Assessment states: "All entities referenced in a proposal (Offeror, A/E Team, Construction Firm, and all subcontractors) will be subject to a Company Threat Assessment (CTA) by the FBI to screen for potential Supply Chain Risk Management issues. If the Contractor or any of its team members are owned or controlled by a foreign person or entity, either in whole or in part, such foreign ownership, control, or influence must be fully disclosed and the Government may require additional information. The Government reserves the right to restrict participation by any foreign-owned entity or require mitigation of foreign control."

Section L.15.5, Volume I, Tab E: Security states: "Participation by foreign owned entities prohibited for the project."

Section L. 15.5 does not provide a definition of what constitutes "foreign ownership" to determine whether or not a firm is "foreign owned". We find that this is not a simple determination given today's global economy and especially for publicly traded companies where "ownership" is actually held among shareholders. Since Section

39.1 indicates all proposed companies must fully disclose any foreign Ownership and a threat assessment will be performed, could the sentence in Section L 15.5 read that participation by foreign Owned entities "may" be prohibited or could this sentence be struck all together? We are accoustomed to filling out the threat assessments or FOCI Mitigation Plans when faced with secure projects and we plan on doing the same for this project. Will this approach suffice for this RFP or will there be some independent early determination by the government as to each firms' status as foreign owned or not?

Attachment 4, the Department of State Security Requirements for LEGAT OCONUS Work (Region 3) makes numerous references to required security clearances for overseas work.

Attachment 7, RMACC Division 01 00 00 makes no mention of security clearances.

Please clarify if a security clearance is only required for Region 3, OCONUS work.

Tab F Organizational Conflict of Interest Question 6 states "Address how your company will preclude a perception of impaired objectivity by prohibiting transfers of personnel between contracts."

There could be as many as ten (10) resumes to submit if you included the construction superintendent and even subcontractor personnel. TAB D is limited to 20 pages. Are the resumes to be considered part of these 20 pages? Are resumes to be submitted under this TAB or a separate location. It is suggested that a finite list of key personnel be indicated so there is no overkill on resumes.

Please confirm that the Table of Contents is not included in the 1 page limit for Tab A Title Page.

We have a great deal of experience working on simliar projects as a prime contractor. However, as a small business, submitting projects completed within 200 miles of the region/pool is limiting. Would you consider extending the requirement to 500 miles?

Table 1 on page 6 states that Region 1 will include projects that may encompass “all areas within the CONUS,” while page 51 includes that there will be an “emphasis on supporting Redstone Arsenal and other projects throughout the CONUS.” Page 58 states that projects should “be located within 200 miles of the region/pool named.” Our impression gathered from Industry Day attendees was that Region 1 would not be required to have this experience to qualify. Please clarify for Region 1 whether each relevant project must be within 200 miles from Redstone Arsenal, or if projects further than 200 miles but within the CONUS will be considered for evaluation.

Our firm has been a dedicated Government Contractor for over 20 years. Typically, we receive project evaluations in the form of a CPARS. The Government has informed us several times that they do not appreciate when we request a project evaluation that is separate from the official CPARS evaluation provided. In most cases the Government has refused to provide any additional project evaluations which are in addition to the CPARS. If the Offeror has a completed and final CPARS evaluation form on file from the project Owner, may this be submitted in lieu of requesting a new Attachment 5 Past Performance Questionnaire?

RFP - L.15 (Table 2)

Section L.15 - Table 2 states Tabe D - Management plan shall not exceed 20 pages. This section per L.15.4.2.2 includes resumes for at least 5 key personnel. A typical resume is approximately 2 pages. This will utilize 12 of the 20 pages.

Please advise if the 6 required resumes can be excluded from the page count.

Section F.1.1.1 notes that the majority of workall shall be performed at Restone Arsenal, Huntsville AL but with requirement to be able to provide services to other areas within the CONUS. L.15.3 states the mininum requirement for relevant projects is to be located within 200 miles of the region/pool named.

Please confirm the 200 mile restriction does not apply to Region 1 as the place of performance includes CONUS.

Is the Government requesting the Offeror provide a listing of documents employees are required to sign that relate to security, NDA, and OCI or is the Government requesting the Offeror provide a listing of all documents employees sign overall (For example: payroll deductions, I-9 Forms, Insurance Forms, EEO, etc.)?

Additionally, is the Government requesting the Offeror provide samples of these documents or simply a listing of the documents?

For example, is the FBI looking for how our firm reassigning’s personnel once a contract is completed and a new project begins? Or is the FBI looking for how our firm reassigning’s personnel during an ongoing project?

M.3.3 FACTOR 3-SECURITY

M.3.3 provides the following note: “* Prime and subcontractor(s) must be eligible for a Top Secret (TS) facility Clearances at time of proposal submission. Failure to provide this information is an automatic rating of Fail for Security. Successful Offerors who receive an IDIQ award will be sponsored for a TS facility Clearance, which must be adjudicated within 12 months of award. Offerors who are not eligible for a TS facility clearance will not be eligible for an IDIQ award. Offerors who fail to receive a fully adjudicated TS facility clearance within 12 months of award may have their IDIQ terminated for default.” Please confirm that FBI intends to provide sponsorship for TS FCL to IDIQ Awardees. M.3.3 FACTOR 3-SECURITY

Number 18 in Attachment 10 “Corporate Performance Reference Information – Design Team” requests the Offeror to provide the firm names for a number of design disciplines if not self-performed. These self-perform disciplines are not typically applicable to a Prime Contractor team, but rather an A/E firm. Is there a separate form to be submitted for the Offeror’s (Construction) projects that outlines construction trades under this self-performance question?

Tab E Security states that “The Offeror shall submit a key management personnel list (KMPL) and Acquisition Risk Questionnaire (ARQ) for itself and each subcontractor offered in its proposal.” If the Offeror discusses a subcontractor relationship in narrative without presence of a formal teaming agreement/letter of commitment, must this security information be submitted for that subcontractor?

L15.3 Volume I – Tab C Past Performance L15.3 Volume I – Tab C Past Performance, under the “Teaming Arrangements and Joint Ventures” topic on pages 58-59 of the RFP states that, “Offerors representing the combining of two or more companies for the purpose of this RFP must describe the nature of the association; indicate whether the firms have experience working together in design-build and/or design-bid-build ventures, including how long and how many projects.” Is this narrative and information permissible and desired for submission under Volume I Tab C, or perhaps Volume II, Tab A?
