Amendment No. 2 Attach – Q-A-1

15-102-SOL-00009

1. Q- Are contractors/subcontractors are required to be licensed in the State of California?

A – Potential bidders should perform their due diligence in ascertaining contractor responsibilities for complying with FAR Clause 52.236-7 Permits and Responsibilities by reference in Section I.

52.236-7 Permits and Responsibilities (Nov 1991)

The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any Federal, State, and municipal laws, codes, and regulations applicable to the performance of the work. The Contractor shall also be responsible for all damages to persons or property that occur as a result of the Contractor’s fault or negligence. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract.

2. Q - Question regarding the use of “allowances” referred to in Section 01 79 00.

Bidder requested a dollar amount be provided.

A - Contractor is responsible to provide the services as stipulated in Section 01 79 00 and shall incorporate all associated costs in the lump sum bid. No separate allowance will be provided for this service.

Specification Section 01 79 00, Paragraphs 1.1.B and 1.1.C are hereby deleted.

3. Q- Question regarding a testing and inspection allowance referred to in Section 08 44 23?

A - Contractor is responsible to procure the services of an independent Government approved testing facility to perform all tests, inspections, and special inspections. Where the technical specification – Attachment C1 (FYHCC Specifications Volume 1) and Attachment C2 (FYHCC Specifications Volume 2) of the Solicitation state that the Owner, Government, or IHS will engage a special inspector for the performance of field tests, inspections, and test reports, replace ‘Owner’, ’Government,’ or ‘IHS’ with "Contractor."

4. Q-Request to provide list of Tribal and Indian Owned firms (subcontractors) which are eligible to bid this project.

A -Such a list is not maintained by IHS. Suggested resources include the TERO Office indicated in Section H.1 and the Small Business Administration.

5. Q-Request that Civil drawings be provided in CAD Format.

A - IHS will provide access to the CAD formatted drawings associated with this solicitation’s FBO page within 7 business days of this Amendment with the stipulation that the government shall not be held responsible if quantity takeoffs using CAD tools differ from those indicated in the Plans and Specifications.

6. Q- Question about responsibility to provide for factory-authorized service representative as a Contractor requirement, because items will be purchased by the Government and these services are normally included in the procurement.

A - This responsibility is the Contractor’s. The role of the Contractor-provided Equipment Coordinator is to organize all activities related to equipment receiving, staging, storage, coordination with other trades, etc. Also, it is understood that the Government Purchasing Officer will be in daily communication with the Equipment Coordinator.

7. Q- Apparent ambiguity between Section 08 33 00 and Sheet A510. Specifications indicate an integral frame for the counter doors whereas the drawing shows the counter shutter door installed on the face of the wall which is not integral with the frame.

A - Provide counter shutters in accordance with the details on A510, integral frame is not required.

The Government amends the Specifications Section 08 33 00, by striking the word “integral” from Paragraphs 2.2.A and 2.6.F.

8. Q- Request for confirmation regarding who (Owner or Contractor) is to perform specific Quality Control testing stipulated in various different specifications sections.

A - Refer to Answer to Question No. 3 of this Amendment.

9. Q- Bidder respectfully requests approval of steel shop drawings in Imperial units in lieu of metric.

A - This project is to remain in hard metric.

10. Q- Bidder noted that in the plans there was notation provided for a projector (PRJ0000). Projector screens are annotated in the specifications but no projectors.

Bidder asked if projectors will be owner supplied.

A- The use of the code “PRJ0000” is included in Volume B1 – Room-by-Room Report for Room E64, C05, E44, and E05A. In all four cases the coding is shown as “O/O” which indicates owner provided/owner installed.

This particular code is not included in the overall equipment list that is found in Section 11 70 00. This item is to be excluded in the bids inasmuch as it will not require Contractor involvement.

11. Q- Bidder noted on plan page A035, keynote 6 calls for entry mats in the courtyard.

However no details or specifications could be found regarding said entry mats.

A - Refer to the A101 series of floor plans and specification section 12 48 00 for information.

12. Q- Bidder pointed out that the Equipment and Furniture Data sheets list Montel shelving and mobile storage system as O/V and “shelving allowance”; requests how to bid on these items.

A- All items classified as “Owner Provided/Vendor Installed” will involve the General Contractor only in terms of coordination with other activities. Please incorporate into your bid accordingly.

15-102-SOL-00009

13. Q- Bidder inquired regarding the O/V and O/C items listed in the Equipment Manuals, asking if there will be a separate bid for these items.

A - The classification of “O/V’ and ‘O/C” items is to distinguish the method of coordination efforts by the Contractor’s Equipment Coordinator and should be integrated into the lump sum bid.

14. Q- Bidder requests names and contact information for Prime Contractors. Bidder also asks if a TERO compliance plan is required at the time of bid.

A – Contracting office does not maintain a list. Advise viewing the Interested Vendors List associated with the Solicitation on FBO and the Pre Bid Meeting Attendees Sign Up list provided on FBO.

TERO Compliance plan and contractor responsibilities under I.12 Indian Preference and I.13 Indian Preference Program are contractual requirements. No “plans” are required at time of bid.

15. Q- Any request or question about submitting a request to substitute materials or supplies as currently stated in the solicitation.

A- Bidders are directed to price the specification as currently written. Substitution requests will be entertained after contract award.
