About this file
This is a Florida Trench Safety Act Certification and Disclosure Statement required by Pasco County, Florida for bidders on the Ranch Road Sidewalk project from US 19 to Ponderosa Avenue. The document mandates that bidders acknowledge compliance with the Florida Trench Safety Act and the Federal excavation safety standards outlined in 29 CFR Part 1926.650, Subpart P, which serve as the interim State standard until Florida adopts or updates them. Bidders must commit to complying with all applicable excavation and trench safety standards and acknowledge sole responsibility for selecting geotechnical data and designing their trench safety systems based on available County information and other relevant sources.
Bidders are required to disclose the excavation and trench safety measures they will employ, including a detailed breakdown by safety measure type with quantities in linear feet or square yards, unit costs, and extended costs. The disclosed safety cost represents only the baseline for compliance purposes and does not limit the Contractor's obligation to expend additional funds necessary to meet trench safety requirements at no additional cost to the County. The County's acceptance of a bid containing this certification does not constitute evaluation or approval of the adequacy of the disclosed costs, nor does it relieve the Contractor of its sole responsibility to fully comply with applicable trench safety standards.

1. The bidder acknowledges the Florida Trench Safety Act and the requirements established herein.
2. The bidder further acknowledges that the aforementioned Act established the
Federal excavation safety standards set forth at 29 CFR Part 1926.650, Subpart P as the interim State standard until such time as the State of Florida, through its Department of Labor and Employment Security, or any successor agency, adopts, updates or reviews said interim standard. 3. The bidder, as Contractor, shall comply with all applicable excavation/trench safety standards.
4. The Contractor shall consider the geotechnical information available from the
County, its own sources and all other relevant information in its design of the trench safety system it will employ on the subject project. The Contractor acknowledges that it is solely responsible for the selection of the data on which it relies in designing said safety system, as well as for the system itself.
5. The amount the bidder has set forth in Item 7 of page BP-2 includes the following excavation/trench safety measures and the linear feet of trench excavated under each safety measure. These units, cost and the unit prices inferred shall be disclosed solely for the purpose of compliance with the procedural requirements of the aforementioned Act. No adjustment to the Contract Time or Price shall be made for any difference in the number of linear feet of trench excavation, except as may otherwise be provided in these Contract Documents.
