About this file
This is Amendment No. 0005 to a federal construction solicitation for Heart Butte Dam Safety of Dams Modification in North Dakota. The amendment modifies eleven sections of the original solicitation specifications and extends the proposal deadline to June 17, 2026, at 1700 MDT. Key specification changes include revisions to Work Restrictions (Section 01 14 12), Roll-up Door requirements (Section 08 33 20), Removal and Control of Water/Dewatering (Section 31 03 33), Excavation of Deep Filter Trench and Shoring (Section 31 23 18), Embankment General (Section 31 24 10), Jet Grouting (Section 31 32 36), HDPE Pipe Drains (Section 33 46 36), Geologic Reports (Section 51 00 60), and Drawings (Section 52 00 00), plus drawing revision 203-D-60032. The amendment emphasizes that jet grouting test sections may proceed concurrently with soil reinforcement zone installation, temporary housing must be provided May 1, 2027 through October 31, 2029, and comprehensive dewatering and unwatering systems are required across four construction phases with 10-day evaluation periods and 30-day run times per phase.
The dewatering work encompasses furnishing and installing deep wells, temporary observation wells, pumps, manifold piping, discharge systems, sediment basins, electrical infrastructure, standby power systems, and unwatering features to maintain stable excavation conditions throughout the 42-month contract period. Contractor responsibilities include 24/7 operation and maintenance of dewatering systems with onsite dewatering specialists meeting 15 years minimum experience, monitoring groundwater levels, winterization procedures, well abandonment, and microbiological control. The amendment includes extensive Questions and Answers addressing contractor inquiries on dewatering maintenance requirements, well development standards, material specifications (including prohibition of bentonite chips and air use during jet grouting), equipment specifications, submittal requirements, and compensation provisions. The government provides preliminary design parameters for the dewatering system, and the Contractor Officer may direct supplementary systems installation if the primary system proves inadequate.

Answer: Refer to specifications Section 310333, Paragraphs 2.13 and 3.09 for microbiological control requirements and specification Section 510035 for well profile analysis. Section 310333, Paragraph 1.01 E. - Deep Wells Operation payment includes labor and equipment required to operate and maintain the deep wells.
Amendment No. 0005
50) Materials - Dewatering - With the dewatering in the 4 phases being possibly done as late as
2029, how does the owner want dewatering materials procured? Can materials be bought up front and billed for? If so, would purchase of materials be allowed to be stored at the contractors yard and show photos as proof of receipt? If materials are not bought up front, what mechanism allows for material escalation to be captured?
Answer: Refer to Section I – Contract Clauses, FAR Clause 52.232-5 – Payments Under Fixed-Price Construction Contracts, Paragraph (b)(2) and 52.216-4 – Economic Price Adjustment – Labor and Materials.
51) Will you please change the price schedule for option c – Care of reservoir releases during construction from Lump Sum to by the each? If the USBR cannot provide the information as to when and how many times during construction that the releases will take place, how can any contractor bid the items responsibly?
Answer: The CLINs in Optional Price Schedule C are included in the event of a large reservoir inflow event and impending spillway release during work within the conduit and spillway channel. Each of the Optional Price Schedule C CLINs are considered a one-time occurrence. Refer to specifications Section 310310 - Care of Reservoir Releases During Construction.
52) The temporary housing CLIN item is set up for 30 months. However, the specification states that the housing shall be in place before beginning work. The period of performance is 42 months. Please advise.
Answer: See revised specifications Section 01 14 12 - Work Restrictions.
53) Chemical grouting is set up for Lump Sum. Can USBR provide a maximum quantity of chemical grout such as the backfill grouting? Contractors would be taking on a large risk with grout loss without a maximum quantity.
Answer: A maximum quantity of chemical grout will not be provided. Refer to the informational drawings listed in specifications Section 520000 - Drawings and photographs within the conduit in specifications Section 510095 - Photographs.
54) Will a temporary septic system or well be acceptable for the Government housing?
Answer: No. Refer to specifications Section 01 52 20 – Temporary Housing.
55) For aggregates/soil placement, will a nuclear density gauge be allowed vs sand cone testing?
Significant delays could occur with awaiting results on the sand cones.
Answer: Nuclear Method (ASTM D6938) and Sand Cone (ASTM D1556) are both required as described in specifications Section 312302, Table 312302A - Contractor Materials Testing and Frequency. Sand cone testing is required for placement of Zone 3
Filter Sand Material at a minimum of one test per 500 yd3 compacted in place or when compaction methods change. No sand cone testing is required in the deep filter trench.
Sand cone testing is required for placement of Zone 5 Stability Berm Fill at a minimum of one test per 1000 yd3 compacted in place or when compaction methods change. Refer to specifications Section 312302 – Compacting Earth Materials.
56) Clin # 58 – 12-inch diameter HDPE pipe test section and camera – The specs states that the camera shall be capable of accessing pipe installed on a 0.44 slope. Is there some punctuation missing for the unit or does this represent a 44% slope?
Answer: Refer to revised specifications Section 334636, Paragraph 2.04 A.2.
57) Can you confirm that the dewatering specialist must be onsite 24 hours a day. If so, the dewatering subcontractor must have 2 working 12 hours or 3 working 8 hours a day for better part of 3 years. Could operations and maintenance personnel work in lieu of dewatering specialist as long as specialist is available to be onsite within 2 hours. Reasoning behind question is to have other be onsite monitoring system at night and weekends, with the specialist being in town and available 24/7.
Answer: Refer to specifications Section 310333, Paragraph 1.07 V. for minimum personnel requirements. The Dewatering Specialist(s) and Dewatering Specialist Assistant(s) shall meet the qualifications described in specifications Section 310333, Paragraph 1.05.
58) Upon dewatering being installed you have a 30-day evaluation period. That we can account for with crew and equipment. The issue I think I see is how do you account for payment once the supplemental wells are installed. Are you adding the 30-day evaluation time into the LF for the supplemental wells. If you do, then both drilling and supplemental wells must carry a 30-day evaluation for something that could be substantially less. Does the owner want to carry a day rate for evaluation periods?
Answer: Payment for the supplementary dewatering system will be in accordance with the CLINs detailed in Optional Price Schedules D through G if supplementary deep wells and/or supplementary temporary observation wells are directed by CO. Payment for operation of the (primary) deep wells is CLIN 1-25 in the Price Schedule and is measured in months. See applicable contract clause(s) in Section H for discussion of variation in the estimated quantity of unit-priced items.
59) Is air allowed to be used while installing the “soil reinforcement zone”?
Amendment No. 0005
60) Is the soil reinforcement zone required to be installed prior to the jet grout test sections or only the jet grout production work?
Answer: No. Jet grouting test sections may be installed prior to or concurrent with installation of the soil reinforcement zone. Refer to revised specifications Section 011412
- Work Restrictions.
61) The instructions to submit via Kiteworks sound like we have a limited amount of time to upload all of our proposal documents. Can the Bureau please clarify how long the link will be open for us to submit our items? Ie, will we be able to upload the volumes over the course of several days?
Answer: Kiteworks links are active for 14-calendar days.
62) Section L-14 (e) says we can submit either via email or Kiteworks. In the event that Kiteworks has technical difficulties when submitting our final volumes, can the Bureau please confirm it is acceptable to email our volumes to the Contracting Officer (Mitchell Frost) instead?
Answer: Yes.
63) Please confirm the Bid Guarantee is its own, additional volume (Volume 5 is not listed on page L-13 but is on page L-27), and that there is no page limit to this volume. Please confirm that the Bid Guarantee does not need to be hand delivered.
Answer: See revised Section L - Instructions, Conditions, and Notices to Bidders.
64) Please confirm that an 11x17 page counts as 1 (one) page.
Answer: Yes.
65) The email sent to bidders alerting us of Amendment 4 states the new time that bids are due as 2pm MT. The Amendment 4 document says bids are due at 5pm MT. Can you please confirm bids are indeed due at 5pm MT on June 10?
Receipt of proposals has been extended to June 17, 2026, by 1700 MDT.
66) Are the dewatering systems to remain in place between work seasons/phases?
Answer: Refer to specifications Section 310333, Paragraphs 1.08 F. and 1.10. E, and specifications Section 312410, Paragraph 3.05 B. Retain and protect deep wells from previous phases for operation during subsequent phases, as determined by COR. If dewatering and unwatering systems are operated during cold weather, use winterization techniques and development procedures. If the dewatering and unwatering system are not to be operated during winter, pumps and other systems may be removed at the Contractor’s discretion. Any items removed as a part of winterization must be reinstalled prior to restarting the system(s). During winter shutdown, protect earthfill zones placed from erosion, saturation, and contamination.
67) If the complete systems are not to stay in place what removal, care, and/or securement of different dewatering system components, e.g., pumps, discharge pipe, electrical, wells, is to be done between work seasons/phases?
Answer: Refer to the response to Question 66.
68) Are the 15 calendar days of operation before further excavating below 2010.0 in Phase III and Phase IV a part of/concurrent with the 30-day pre excavation run time period?
Answer: No. The Phase III and Phase IV 30-day run times are not concurrent with the 15-calendar days of operation before further excavating below elevation 2010.0. Refer to specifications Section 310333, Paragraphs 1.08 D. and E. The Government will provide written notification to the Contractor once the run time has completed; the CO may provide written direction to the Contractor to begin excavation prior to the completion of the run time.
69) Specification 31 03 33 - 22, Section 1.10, Subsection H, Number 1 states "Visible flowing seepage into the deep filter trench excavation is not acceptable." Does this include water that is being controlled through french drains / trenches to a sump pump or is it just referring to uncontrolled water in the bottom of the excavation that is not being actively sumped?
Subsection H indicates an understanding that the dewatering systems may not capture all of the water before it enters the trench and sumping will be necessary, but Number 1 confuses this matter by seemingly preventing the sumping of the remaining water.
Answer: Yes, we will allow water controlled through unwatering elements as decribed.
Refer to revised specifications Section 310333 - Removal and Control of Water and Section 312318 - Excavation of Deep Filter Trench and Shoring.
70) If the dewatering system is intended to remain in place between work phases, is the system intended to be operated for that duration as well?
Answer: Refer to the response to Question 66.
71) The specification (31 32 36 1.04.L) requires the Contractor to provide Core Box Storage Facility. Please clarify how long the storage facility will remain onsite.
Answer: See revised specifications Sections 011412 - Work Restrictions and 313236 - Jet Grouting.
Amendment No. 0005
72) Specs (31 32 36 3.13.7.b) state "Upon completion of core drilling, core logging will be performed by the Government." Please confirm that the Government will be logging the verification Cores, taking core runs photos and preparing a core log and the contractor is not required to prepare a log.
Answer: Refer to specifications Section 313236, Paragraph 3.13 F. for verification coring requirements. Photograph each core run, record survey coordinates for each coring location, place core in core box and clearly label with drill hole numbers and core sample depths. Core logging will be performed by the Government in accordance with specifications Section 313236, Paragraph 3.13 F.17.b.
73) The RFP documents do not include a geotechnical report nor boring logs and related lab tests. Please provide the available geotechnical information.
Answer: Refer to new specifications Section 510060 – Geologic Reports. Additional reports are available for viewing as listed in specifications Section 531000 - Geological Investigations, Paragraph 1.01 A.3. The following reports were included Amendment No. 0002:

74) (31 32 36 3.01.E) Please confirm if air at minimum pressure/flow can be used during jet grouting operations. If possible please provide the maximum allowed air pressure and flow.
Answer: No air use will be allowed.
75) The Roll-up door specification (08 33 20 2.02 A. 15.) requires 120 VAC power for the motor.
Where is the location of tie in for the electrical?
Answer: Refer to revised specifications Section 083320 - Roll-Up Door.
76) Section L-16 (2) SF 1442 specifies that the executed form from Section A should be used as the first page of Volume 1. Can the Bureau please specify if this page should be placed at the beginning of Volume 1, in the SF 1442 Section 2, or elsewhere in the volume?
Answer: The executed Section A form may be included in the beginning of Volume 1.
Amendment No. 0005
77) Section L-16 (2c) states that Section I- Contract Clauses should be included in this section.
Due to the length of this section and to provide a more succinct and streamlined review for the Bureau, may this Section I be omitted from Volume 1?
Answer: Yes. Section I may be omitted from Vol 1.
78) Section L-21, Factor 1B, bullets 4a and 4b specify that each “…shall not exceed 2 pages as defined in Part C of this provision.” We do not see a Part C specifying particular page counts by section. Can the Bureau please confirm whether this should be disregarded or if there are any particular page counts per item requested?
79) We respectfully request that the bid date be pushed 14 days from 6/10 to 6/24.
Answer: Receipt of proposals has been extended to June 17, 2026, by 1700 MDT.
80) We anticipate further development of critical questions arising after 5/22, especially with some of them not being answered as of 5/22. Will you consider also pushing the question deadline 14 days to 6/5?
81) We understand that jet erosion tests based on ASTM D5852 were performed on sandstone specimens from Borehole DH-18-2, and determined that the erodibility classifications to be “erodible” to “moderately resistant”
ASTM D5852 is typically used to evaluate the soil/rock erodibility over time, such as “A test timing sequence of 600, 1200, 1800, and 3600 seconds intervals is recommended for a total testing time of 7200 s.” However, because of the extended timing of the jet erosion test, this is typically not reproducible in actual field jet-grouting applications; therefore, ASTM D5852 is not used in the jet-grouting industry.
We reviewed the site boring logs in the jet grouting zones, and understands that the sandstone was classified as clayey sand (SC) with the clay contents above 9% and the natural moisture contents below its plastic limits and described as “hard” and “very stiff”. In the jet grouting industry, very stiff to hard clay is considered non-jet-groutable material.
From the rock properties point of view, the sandstone in the jet grouting zone is considered as uncemented rock, H6 and H7 rock hardness/strength. From the soil properties point of view, this sandstone is considered as very stiff to hard clays with typical shear strength in a range of 2000~4000 psf. Jet grouting cannot treat such very stiff to hard clays.
Jet Grout Specification Section 31 32 36, Paragraph 3.05.P. states that, subject to the results of the test program, modifications may be required, and the Contractor may be required to repeat the construction of the test section, at no cost to the Government. Please consider revising to “at the cost of the Government, if it is determined that the subsurface material is non-jet-groutable.”
Answer: Refer to revised specifications Section 313236 - Jet Grouting.
82) Jet Grout Specification Section 31 32 36, Paragraph 3.08.A.3.a.1, defines the degree of cementation using rock hardness/strength criteria and states that “rock that can be grooved or gouged easily by knife or sharp pick with light pressure, can be scratched with a fingernail, or breaks with light to moderate manual pressure will be treated as uncemented. Refer to H6 and H7 rock hardness/strength descriptions.”
The referenced hardness/strength criteria do not necessarily correlate with whether a material is practically jet-groutable or non-jet-groutable. As currently written, the specification places significant performance risk on the contractor for subsurface conditions that may not be achievable based solely on the defined distinction between cemented and uncemented material.
Please consider revising or removing this requirement and instead provide criteria defining erodible versus non-erodible soils/materials that are more directly applicable to jet grouting performance and constructability.
Answer: Refer to revised specifications Section 313236 - Jet Grouting.
83) Amendment 4 indicates that an Excel spreadsheet of the Section B Price Schedule has been provided. However, I am not seeing that file available in SAM. Please provide this document.
Answer: The excel spreadsheet will be provided with Amend 5.
84) The specifications state that a transformer will be mounted on a pad when the contractor arrives on site. Note 8 on page 4 states the anticipated location of the temporary transformer.
Is the contractor to assume that we will need to route and install overhead/underground electric lines from this location @ Control Point #9?
Answer: Refer to revised specifications Section 015100 included with Amendment 0002 and revised Drawing 203-D-60004 included with Amendment 0003. Temporary Electrical Utility Infrastructure is the responsibility of the Contractor and is included as CLIN 1-1a in the revised Price Schedule in Amendment 0003.
Amendment No. 0005
85) Once the preliminary project information was released by the government’s contractor had conversations with jet grouting firms and expressed the concern that jet grouting treatment of the sandstone for a continuous cut-off wall as required by the specifications cannot be guaranteed.
Is the government able to revise Section M of the solicitation from Alternate I clause the Alternate II in order to evaluate and ask questions about Alternative Technical Concepts?
