About this file
This permitting assessment form evaluates permitting requirements for a design-build project to rehabilitate water, wastewater, and stormwater utility systems at Fort Wadsworth in New York. The project involves replacing or rehabilitating underground infrastructure, which may require archeological consultation under ARPA as well as dewatering permits depending on excavation volumes near water. Coordination will also be needed with the New York City Department of Environmental Protection regarding sewer connection, water main, and meter permits. As the project is located on federal land, permits for work in navigable waters from the Coast Guard and zoning approvals are not anticipated, though traffic control plans will require National Park Service approval. The design-build entity must determine any additional temporary utility needs and address stormwater management, noise abatement, and air pollution during construction in accordance with specification requirements.

Notes on Jurisdictional Assessment: This PAF assesses the Base Bid project as described in the Program of Requirements. The DBE is required to update this assessment during design and at each design phase. The selection of any of the options will also require updates to this PAF. The potential permitting ramifications for the options are discussed to the extent feasible in Basis of Decision sections in this
PAF.

Not part of project Water Quality Certification (required if project has federal permit)
Basis of Decision: Project activities are not anticipated to occur in navigable waterways, but if the DBE determines that work in navigable waters is required, then a USCG permit/approval may be required.
No impacts to waterways or wetlands are anticipated, therefore no Clean Water Act Section 404 or 401 permits are required. There is no known mine lands within the project area. The project is located entirely on federal lands, so zoning approvals are not required.
Not part of project Zoning - Not normally required on NPS land
6NYCRR Part 661 May be required for work within 150 feet of a protected wetland in
NYC.
Tidal Wetland Permit
Not part of project Listed Species Incidental Take: Marine Mammals (NPS typically avoids incidental take) Listed Species Incidental Take: Terrestrial (NPS typically avoids incidental take)
Not part of project Protected/Critical Habitat (NPS typically avoids incidental take) Not part of project Waters of the US and Wetlands (or other Special Aquatic Sites) Not part of project Floodplain (Construction in)
Law, regulation, etc. Permit Type: Requirements, Actions, Etc.:
Basis of Decision: Project activities are not anticipated to occur in waterways or floodplains and therefore would not result in incidental take to listed fish species or marine mammals. No protected or critical habitat is located within the project area based on documentation received from USFWS. Project is located entirely on federal land, so no CZMA permits are required. USFWS has determined that the project would have no effect on the northern long-eared bat and may affect-not likely to adversely affect piping plover, therefore no incidental take of terrestrial species is anticipated. Work is not anticipated in floodplains, but if the DBE determines that work in floodplains is required then a FEMA Floodplain permit may be required. Work is not anticipated to occur in tidal wetlands or the area 150 feet inland from tidal wetlands; however, the tidal wetlands boundaries and 150 foot inland buffer must be shown on the plans. Construction activities within tidal wetlands and/or the 150 foot inland buffer would require authorization from the NYS DEC.

Basis of Decision: Permanent stormwater management facilities are not anticipated because an increase in impervious surface is not anticipated as a result of the project. However, if not already obtained, a NPDES or state SPDES permit may be required for existing infrastructure.
Basis of Decision: Consultation with and permitting through New York City Department of Environmental Protection (NYC DEP) will be required related to a sewer connection for replacement of the sewer infrastructure, particularly at connections to the DEP system.

Not part of project Work in Navigable Waters - Aids to Navigation
Law, regulation, etc. Permit Type: Requirements, Actions, Etc.:
Basis of Decision: Project does not include communication towers or roadway design. Work in navigable waters is not part of the base project. If the DBE determines that work in navigable waters is required, then coordination with the USCG will be necessary. Other permits that may need to be considered during design: Consultation with and permitting through the New York City Department of Environmental Protection (NYC DEP) will be required related to an internal water main permit for replacement of water infrastructure, particularly at connections to the DEP system, including meters and backflow preventers.
Basis of Decision: The following surveys have not been conducted based on known conditions at the site: hazardous materials and unexploded ordinances. Should the DBE be made aware of potential hazardous materials, they should notify NPS immediately. As a contract modification, the DBE will be responsible for proper disposal of hazardous materials, if encountered.

NPDES / SPDESCWA-Section 401 / Article 17 - Water Pollution Contro Construction SWPPP/UPPP
Basis of Decision: The project includes excavation to replace or rehabilitate underground infrastructure. Depending on the contractual arrangement, archegological consultant for the DBE may need an ARPA permit. Depending on volume, permits related to dewatering of excavations, particularly near the water, may be required for withdrawal and discharge. Work near the Verrazzano-Narrows Bridge should be reviewed by the Metropolitan Transportation Authority (MTA) Bridges & Tunnels. Work near other utilities should be reviewed by utility owners.
Basis of Decision: The project purpose is the replace or rehabilitate water, wastewater and stormwater utility systems. Temporary utilities may be required to provide water and wastewater services during construction. The Design-build entity will need to define temporary utility needs during design phases of the project.
