We would like further clarification on the 51% self‐ perfomance of this project? This is a SB set‐aside and is anticipated to be over the $1.5 million threshold and according to the FAR 36.501 this clause should not be included. By making this exemption, it appears that the

NPS is restricting the competition.

(b) The contracting officer shall insert the clause at

52.236‐1, Performance of Work by the Contractor, in solicitations and contracts, except those awarded pursuant to subparts 19.5, 19.8, 19.13, 19.14, or 19.15 when a fixed‐price construction contract is contemplated and the contract amount is expected to exceed $1.5 million. The contracting officer may insert the clause in solicitations and contracts when a fixed‐ price construction contract is contemplated and the contract amount is expected to be $1.5 million or less.

This is not a correct interpretation of this clause. Since a fixed price contract is being contempated and the amount is greater than

$1.5M, this clause must be included. It is important to note that per FAR 36.501, subcontracted specialties such as plumbing, heating and electrical work are not to be included in the calculation of self performance.
