31Attachment 3 Deductions states that failure to provide required relief breaks will result in a payment reduction equal to the productive hourly rate, pro-rated for amount of relief not provided. Because this deduction would occur after the services had already been provided it would require the Government to accept voluntary, and personal, services and violate the Anti-deficiency Act. 32Section C.5.5 states that productive hours “do not include relief periods, meals, or other similar absences from assigned posts and duties.” However, break (i.e. relief periods) are considered compensable time under federal employment laws, and meals are only considered non-compensable time if the employee is fully relieved of duty for the meal period. Mealtimes for Security Guards are generally considered compensable because they are not fully relieved of duty and remain on premises, available to respond to emergencies, and/or monitor radio traffic during the mealtime. Would the Government please remove the statement that meals and relief periods are not productive hours?Removed reference from 5.5 regarding breaks.SOW revised.
33Section 8.6, page 30, states that “the contractor shall become solely responsible for the replacement costs of existing X-ray and magnetometer equipment” and that “Contractor shall provide all maintenance, repairs, upgrades of existing and future equipment to keep in an operable status. Replacement of equipment could include but not limited to damage, inoperability, upgrades, or end of life cycle with no additional cost to government.” In order for offerors to reasonably assess and price the potential costs associated with the X-ray and magnetometer equipment, can the Government please provide detailed information regarding the existing equipment, including:

• Make, model, and serial number(s)

• Dates of manufacture and installation

• Complete maintenance and repair histories

• Calibration and radiation testing records

• Remaining useful life

• Known issues, failures, or pending end of life conditionsAstrophysics Model XIS 100X manufactured Sep 2022 and installed Oct 2022. Astrophysics Model XIS 6545 manufatured in Sep 2022 and installed Oct 2022. Rapiscan Metor 6E030 purchased in 2015. We had some initials bougs to work out on the XIS 6545 but after a software update was completed in 2024, we had not experienced any issues. All annual testing has been completed with no issues. Test records will be provided to the contractor during phase in period. A remaining useful life cannot be accurately predicted, however the machines are in perfoect working order.N/A
34Can the Government please describe what happens to the contractor-owned X-ray and magnetometer equipment in the event the equipment owner is not successful on any future recompetes of the contract? Will the contractor-owner of the equipment be expected to remove the equipment from the EROS facilities?If the the contract company owns the machines, they will need to remove their property upon contract end from EROS facilities.N/A

36Section 7.1(a) requires individual guards to possess a “Security Guard Permit and Weapons Permit.” Our research shows that South Dakota does not issue a state-level “Security Guard Permit,” and firearm authorization is governed through concealed carry permitting rather than a guard-specific weapons permit. Can the Government please confirm whether the requirement for a “Security Guard Permit and Weapons Permit” may be satisfied through a valid South Dakota concealed carry permit (e.g., Enhanced Permit)?This requirement will be satisfied by ANY US states' enhanced concealed carry permitN/A

Can the Government please provide these man-hours?Q1 - Project Manager 8 hours daily M-F (40 hours weekly), Deputy PM 8 hours daily M-F (40 hours weekly) 3 shift supervisors 8 hours daily (24 hours daily) - 7 days per week (168 ours weekly). Totals out to 248 supervision hours weekly.
42Section 8.9, page 29, states that “The Contractor shall provide a fully equipped security vehicle for use in the performance of the duties identified in this SOW.” However, Attachment 5 Vendor Furnished Equipment shows vendors providing two vehicles. Can the Government please clarify the vehicle requirement?The contractor shall provide two vehicles. One for everyday use and a back up.Updated 8.4 of the SOW to include two vehicles.
43Wage Determination 2015-5369 Rev #27 states that “where uniform cleaning and maintenance is made the responsibility of the employee, all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount, or the furnishing of contrary affirmative proof as to the actual cost), reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However, in those instances where the uniforms furnished are made of "wash and wear" materials, may be routinely washed and dried with other personal garments, and do not require any special treatment such as dry cleaning, daily washing, or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract, by the contractor, by law, or by the nature of the work, there is no requirement that employees be reimbursed for uniform maintenance costs.” Can the Government please clarify if the standards of appearance described in Attachment 3 Deductions requires Contractors to pay the cleaning and maintenance allowance?This is up to the contractor on how they want to provide maintencae and care of uniforms. Attachment V (Vendor Furnished Equipment) states the Contractor shall supply 9mm pistols, all duty ammunition (JHP recommended), all range/qualification ammunition, and holsters and duty gear — one per employee. Section 6.1(a) of the SOW states "all Contractor-provided weapons used for qualifications shall be the employees' service pistol as approved by the CO and/or COR." Please clarify: are weapons contractor-owned and issued to employees, or are weapons personally owned by each employee and simply approved by the CO/COR? This distinction has a material impact on pricing.Weapons are owned by the contract company. Personal weapons ARE NOT allowed on site. This statement means that the qualification will be completed with the weapon assigned to the employee for daily use.N/A
Attachment V references 12-gauge shotguns "as required based on authorization." How many shotguns are currently authorized for use at the EROS site, and which posts or situations require their deployment? Should offerors price shotguns and shotgun ammunition as a line item in the proposal?There is currently one (1) shotgun in use on site. Offerors may bring as many as they think are necessary. The shotgun and ammunition should be on a separate line item.N/A
Who bears the cost of replacement duty ammunition consumed on a regular basis (non-qualification)? Guards are required to carry 30 rounds per shift per the Guard Post Orders.
