STATEMENT OF WORK

Mechanical Construction Indefinite Delivery Indefinite Quantity (IDIQ)

I. BACKGROUND INFORMATION

The U.S. Department of Commerce, National Institute of Standards and Technology (NIST) Gaithersburg, Maryland campus is a research and development facility with over 50 buildings located on a 578-acre campus. The majority of the buildings were constructed in the early to late 1960s. There are several buildings that were constructed from the 1990s to the present.

The majority of the buildings contain laboratory facilities with specialized environmental and utility systems, although there are also administrative and support buildings on campus.

The mission of the NIST Office of Facilities and Property Management (OFPM) is to safely and reliably manage and operate NIST facilities. This includes providing cost-effective and efficient services and infrastructure programs essential for NIST’s operations while ensuring maximum responsiveness to the needs of the NIST technical programs. The OFPM is responsible for facility activities and services including facilities planning and building design, construction, and renovation.

Utilities are typically distributed to the individual buildings by underground piping from an on-campus central utility plant (steam, chilled water, compressed air) or municipal utility (domestic water, natural gas, sanitary sewage). Some services (i.e. vacuum, nitrogen, helium, pure-water, hot water) are generated and distributed at the building level. Piping and associated equipment can date back to original building construction or be a more recent installation.

Building environmental control is typically provided by central air-handling units with a variety of systems used for individual space control. Those systems can include constant- or variable-volume air-handling units with hot deck/cold deck mixing boxes, reheat coils (hot-water, steam, electric), or variable-air-volume boxes (with or without reheat) for space control. Control is provided by a mixture of direct-digital controls (primarily Alerton, Andover, and Siemens) and pneumatic controls.

II. PURPOSE

The NIST OFPM requires mechanical construction products and services for NIST facilities in Gaithersburg, Maryland. NIST intends to acquire the construction products and services via a design-bid-build process.

- Design-bid-build means the traditional delivery method where design and construction are sequential and contracted for separately with two contracts and two contractors.

This acquisition is only for bid-build requirements. Architect-engineer services for design are not within the scope of this contract; NIST will provide design requirements for each task order (TO) that NIST solicits and awards under this contract.

PLACE OF PERFORMANCE

NIST campus in Gaithersburg, Montgomery County, Maryland

PERIOD OF PERFORMANCE

The contract period of performance is three years. Each TO will include its own specific period of performance.

III. SCOPE

The Contractor shall provide the necessary supervision, management, personnel, materials, and equipment to perform repairs, renovations, and alterations to facilities and utilities.

Representative bid-build scope of individual TOs may include:

• Demolition, repair, replacement, modification, or addition to hydronic, plumbing, refrigeration, and steam/condensate piping systems including associated equipment. This may include campus distribution systems as well as building-level systems.

• Demolition, repair, replacement, modification, or addition to air-conditioning/distribution and exhaust air systems and associated equipment. Work may include performing air and water balance of systems.

• Demolition, repair, replacement, modification, or addition to air-conditioning/distribution control systems including direct-digital, electric, and pneumatic systems.

• Demolition, repair, replacement, modification, or addition to utility metering and/or monitoring systems.

• Demolition, repair, replacement, modification, or addition to fire sprinkler systems

• Demolition, repair, replacement, modification, or addition to laboratory safety equipment such as safety showers and eye wash stations

• Maintenance activities for air-conditioning/distribution equipment, exhaust air equipment, hydronic equipment, plumbing equipment, and refrigeration equipment

• Demolition, repair, replacement, modification, or addition to electrical, communication, and fire detection/alarm systems when associated with work mentioned above

• Demolition, excavation, repair, replacement, modification, or addition to site and building structures when associated with work mentioned above

• Hazardous material abatement when associated with work mentioned above

• Permit applications to regulatory agencies including completing applications from inception

Contractor work will generally be performed in areas that are occupied by NIST employees and/or NIST associates and, accordingly, may involve phasing to maintain or limit disturbances to those occupants. Such restrictions will be identified in the scope of work for the individual TOs. Work shall be performed in accordance with the general requirements listed in the “Guidelines for OFPM Contractors.”

Homeland Security Presidential Directive (HSPD)-12

The Contractor (and/or any subcontractor) and its employees who require physical access to NIST facilities or logical access to NIST IT networks or systems must comply with Homeland Security Presidential Directive (HSPD)-12, Policy for a Common Identification Standard for Federal Employees and Contractors; OMB M-05-24; OMB M- 19-17; FIPS 201, Personal Identity Verification (PIV) of Federal Employees and Contractors; NIST HSPD-12 policy; and Executive Order 13467, Part 1 §1.2.

The Contractor (and/or any subcontractor) must submit a roster by name, position, e-mail address, phone number and responsibility, of all staff working under this acquisition where the Contractor will develop, have the ability to access, or host and/or maintain a government information system(s).

The roster must be submitted to the COR and/or CO within 14 days of the effective date of this contract. Any revisions to the roster as a result of staffing changes must be submitted within 14 days of the change. The COR will notify the Contractor of the appropriate level of investigation required for each staff member. If the employee is filling a new position, the Contractor must provide a position description and the Government will determine the appropriate suitability level.

Position Sensitivity Designations Requirement All Contractor (and/or any subcontractor) employees must obtain a background investigation commensurate with their position sensitivity designation that complies with Parts 1400 and 731 of Title 5, Code of Federal Regulations (CFR).

The following position sensitivity designation levels apply to this solicitation/contact:

Non-Sensitive, Low Risk.

IV. GENERAL REQUIREMENTS

Government Furnished Property NIST will furnish applicable hazardous material information to the contractor on each TO. Any other Government furnished property, material, equipment, or information will be detailed on each TO.

Inspection & Acceptance In addition to the inspection and acceptance terms articulated in FAR clause 52.246-12 that allows the Government reserves the right to perform such performance tests and evaluations as defined below to verify specified system performance. Such tests and evaluations, if performed, shall be conducted within the environment that the system is to be operated. The Contractor has the right to be present during the tests and evaluations, if performed at the Contractor’s expense.

Performance Tests and Acceptance

A visual inspection of the equipment will be performed by the COR to identify surface defects or any form of indication that any equipment was damaged during transport to NIST.

The COR will test, inspect, and accept or reject the equipment within 10 days of the receipt of the equipment unless otherwise indicated above. The Government reserves the right to conduct quality assurance testing to confirm that a given instrument(s) meets the manufacturer’s and/or the Government’s performance specifications.

REQUIREMENTS FOR CONTRACTOR PERSONNEL

Safety: The Contractor employee must be responsible for knowing and complying with all installation safety prevention regulations. Such regulations include, but are not limited to, general safety, fire prevention, and waste disposal.

Security: NIST is a restricted campus. An identification badge is required for access for entry into buildings and is shown to the armed Security Police when entering the campus. All contract employees shall obtain badges for this contract. The badge type is a Facility Access Card (FAC)/ Personal Identification (PIV) Card. Contractor shall allow for up to 90 minutes to collect a badge (M-F 9AM to 12:00 PM). NIST will not provide escort services to the contractor during the performance of this contract.

Contractor travel: No contractor travel is required.

Special Material Requirements: None

Other Unique Requirements: Work will be performed in and around occupied areas performing scientific/research experiments where vibration, noise, outages of utilities, and disturbances to the physical environment may hinder the ability of the Government to perform required activities. As such, some tasks may involve phasing to maintain or limit disturbances to on-going operations. Any restriction will be identified in the scope of work for the individual TO.

Certain activities may have to be performed outside of normal business hours. In this event, overtime rates would be applicable. Work shall be performed in accordance with the general requirements listed in the “Guidelines for OFPM contractors and A/E Firms Performing Site Investigations and Fieldwork (Including Construction) at the National Institute of Standards and Technology, Gaithersburg, MD. The contractor shall submit a job-specific safety plan with Activity Hazard Analysis (AHA) for review and approval by NIST. A notice to proceed will be issued after safety plan approval.

STATEMENT OF WORK

AMLC - Replace Exhaust Scrubber

I. BACKGROUND INFORMATION

The U.S. Department of Commerce, National Institute of Standards and Technology (NIST), Center for Nanoscale Science and Technology (CNST) is replacing one Exhaust Scrubber System (ESS) that serves Building 215 on the NIST campus in Gaithersburg, Maryland.

II. PURPOSE

The ESS is at the end of its life cycle and needs replacement in kind. The ESS is currently available through the same manufacturer of the existing ESS. The Contractor shall provide mechanical construction services to remove and replace the existing ESS in kind. The form, fit, function, operating parameters, and capacities of the new ESS shall be the same as the existing ESS. Additionally, the construction services shall pose little or no impact to the 24 hour per day, seven days per week operation of Building 215. Any disruption shall be coordinated in advance with the Contracting Officer’s Representative (COR) for nights or weekends (off-hours).

PLACE OF PERFORMANCE

Building 215 on NIST campus in Gaithersburg, Maryland

Regular Business Hours Regular business hours are Monday through Friday, 8:30 AM to 5:00 PM Eastern Time, excluding Federal holidays and other days of NIST closure.

PERIOD OF PERFORMANCE

The period of performance for this TO is 300 days after the contracting officer (CO) issues a written notice to proceed to the contractor.

For planning purposes, the contractor shall assume that the CO will issue a notice to proceed within 30 days of TO award after NIST review of the following.

III. MINIMUM REQUIREMENTS

ESS and related services:

Duall Division Exhaust Air Scrubber, Model F105-123S HF The ESS to be supplied and installed by the contractor includes the following sub-systems:

o Steel Support Frame o Horizontal Scrubber o Recirculation Pumps (Qty-2) o Scrubber Control Panel o 300-gallon Chemical Mixing Tank o Piping and valves between the Chemical Mixing Tank and the Exhaust Scrubber

• The minimum specifications for the new ESS are indicated in Attachment 5.

The ESS installation shall be in accordance with the latest codes and standards, to include requirements of The Environmental Protection Agency (EPA) and OSHA.

The contractor shall provide the following rigging services:

o Existing and new ESS o Existing and new steel support frames o Existing and new 300-gallon chemical mixing tank

The Contractor shall be responsible for removing all crating and packaging of all new components.

The Contractor shall properly dispose of the existing ESS including the existing 55-gallon chemical tank. This tank is located at the roof access area.

NIST will be responsible for dispose and renew of any chemicals for the existing and new systems.

New electrical power conduit, cabling and circuit breakers shall be provided from the main power panel of the ESS and freeze protection.

Existing ductwork shall remain up to the point of connection to the Exhaust Scrubber.

The contractor shall provide any ductwork transitions that the installation may require for a complete operational system.

No roof modifications are permitted.

The contractor shall closely coordinate construction activities with the COR and be done in a manner to result in minimal downtime and impact to CNST laboratory capabilities.

Training on how to properly operate and maintain the ESS shall be supplied by the

Contractor. The training plan shall be submitted for government approval 30 days prior to the planned performance of the training.

All contractor personnel, including sub-contractors, shall obtain Green NIST PIV badge with a higher security review for out of hours access.

The contractor shall provide weekly status/update meetings with the COR and other NIST stakeholders that are invited by the COR.

Contractor Safety Plan NIST is committed to maintaining a work environment that safeguards the public and the environment, as well as personnel and property.

The Contractor shall:

Provide a detailed, site-specific Safety Plan to the contracting officer within 10 days after task order award that describes how the contractor will maintain a safe work environment and comply with applicable Occupational Safety and Health Administration (OSHA) standards, as well as with applicable state and local laws, standards, and codes.

The Safety Plan shall specify how the company’s policies and practices will comply with each of the applicable standards, laws, and codes.

The contracting officer will provide written comments regarding the plan to the contractor within seven days of receipt and will require the contractor to submit a revised safety plan within seven days after that to the contracting officer for their review.

This cycle may be repeated, if necessary, until the contracting officer determines the safety plan to be acceptable.

Safety-Related Equipment

The Contractor shall:

Provide all safety-related equipment required to perform the work under this award, including personal protective equipment (PPE) and other equipment that is required or appropriate to protect contractor personnel and other personnel on the NIST campus.

Contractor-provided personal protective equipment shall include, at a minimum, hard hats, safety shoes, safety glasses (prescription or standard), respiratory protection (powered air purifying respirator or full-face mask respirator), high visibility clothing and gloves that meet applicable OSHA standards for PPE.

Training

The Contractor shall:

Provide safety-related training required by applicable OSHA, state and local regulations or standards to affected contractor personnel (including subcontractor personnel) that perform work under this award. Such training may include, for example, training for proper use of PPE, respirator use, fall protection, crane operation, forklift operation;

electrical safety, or other safety-related topics.

Maintain records of safety training provided to contractor personnel (including subcontractor personnel) that perform work on this award. The contractor shall make those records available to the contracting officer, contracting officer’s representative for the award, or other authorized personnel within 7 days of receipt of their written request, and annually thereafter or upon request.

Require contractor personnel (including subcontractors) to attend all required NIST-specific health or safety training that is required by the award.

Health Hazard Assessments and Medical Evaluations

The Contractor shall:

Provide required health hazard exposure assessments, medical evaluations and screenings, and exposure monitoring required by applicable OSHA requirements.

Ensure PII information is protected.

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of (to be specified, if applicable, in a TO) for each calendar day of delay until the work is completed or accepted.

G.1 1352.201-70 CONTRACTING OFFICER?s AUTHORITY (APR 2010)

The Contracting Officer is the only person authorized to make or approve any changes in any of the requirements of this contract, and, notwithstanding any provisions contained elsewhere in this contract, the said authority remains solely in the Contracting Officer. In the event the contractor makes any changes at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract terms and conditions, including price.

G.2 1352.201-72 CONTRACTING OFFICER`S REPRESENTATIVE (COR) (APR 2010)

(b) The responsibilities and limitations of the COR are as follows:

(1) The COR is responsible for the technical aspects of the contract and serves as technical liaison with the contractor. The COR is also responsible for the final inspection and acceptance of all deliverables and such other responsibilities as may be specified in the contract.

(2) The COR is not authorized to make any commitments or otherwise obligate the Government or authorize any changes which affect the contract price, terms or conditions. Any contractor request for changes shall be referred to the Contracting Officer directly or through the COR. No such changes shall be made without the express written prior authorization of the Contracting Officer. The Contracting Officer may designate assistant or alternate COR(s) to act for the COR by naming such assistant/alternate(s) in writing and transmitting a copy of such designation to the contractor.

G.3 1352.216-76 PLACEMENT OF ORDERS (APR 2010)

(a) The contractor shall provide goods and/or services under this contract only as directed in orders issued by authorized individuals. In accordance with FAR 16.505, each order will include:

(1) Date of order;

(2) Contract number and order number;

(3) Item number and description, quantity, and unit price or estimated cost or fee;

(4) Delivery or performance date;

(5) Place of delivery or performance (including consignee);

(6) Packaging, packing, and shipping instructions, if any;

(7) Accounting and appropriation data;

(8) Method of payment and payment office, if not specified in the contract;

(9) Any other pertinent information.

G.5 52.232-99 DEV PROVIDING ACCELERATED PAYMENT TO SMALL BUSINESS CONTRACTORS (AUG 2012) This clause implements the temporary policy provided by OMB Policy Memorandum M-12-16, Providing Prompt Payment to Small Business Subcontractors, dated July 11, 2012.

(a) Upon receipt of accelerated payments from the Government, the contractor is required to make accelerated payments to small business subcontractors to the maximum extent practicable after receipt of a proper invoice and all proper documentation from the small business subcontractor.

(b) Include the substance of this clause, including paragraph (b), in all subcontracts will small business concerns.

(c) The acceleration of payments under this clause does not provide any new rights under the Prompt Payment Act.

G.6 NIST LOCAL-40 BILLING INSTRUCTIONS FOR DELIVERY/TASK ORDERS

(a) NIST prefers electronic Invoice/Voucher submissions and they should be emailed to

(b) Each Delivery/Task Order Invoice or Voucher submitted shall include the following: (1) Contract Number; identified in Block 2 of the OF347. (2) Delivery/Task Order number identified in Block 3 of the OF347. (3) Contractor Name and Address. (4) Date of Invoice. (5) Invoice Number. (6) Amount of Invoice and Cumulative Amount Invoiced to-date. (7) Contract Line Item Number (CLIN).

(8) Description, Quantity, Unit of Measure, Unit Price, and Extended Price of Supplies/Services Delivered. (9) Prompt Payment Discount Terms, if Offered. (10) Any other information or documentation required by the contract.

(c) In the event electronic submissions are not used, the Contractor shall submit an original invoice or voucher in accordance with paragraph (b) above to the address identified in Block 21 of the OF347.

This site includes information about campus access and security information; identification requirements; parking information and more.

Contractor personnel are required to check the appropriate campus operating status and personnel requirements at https://www.nist.gov/campus-status daily prior to arriving on site. All personnel must adhere to the requirements set forth in the operating status.

Unless otherwise stated in the contract terms and conditions, normal days of business operation are Monday through Friday, excluding Federal Holidays.
