About this file

This is a Standards of Conduct Declaration form (Form AG-010) required by the State of Hawaii for contractors bidding on state contracts, specifically for the furnish and installation of ADA-compliant automatic door systems at the Hilo Courthouse for the Third Circuit Court under the Judiciary of the State of Hawaii.

The declaration requires the contractor to certify under penalty of perjury compliance with Hawaii Revised Statutes Chapter 84 (Code of Ethics). The contractor must confirm that: (1) it is not a legislator or employee, nor does a legislator or employee hold a controlling interest in the business; (2) it has not been personally represented or assisted by an agency employee from the contracting agency within the preceding two years who participated in the relevant matter; (3) it has not been assisted or represented by a legislator or employee for compensation to obtain the contract and will not be assisted in performance if such individual was involved in contract development or award; and (4) it has not been represented on contract-related matters within the past twelve months by any individual who was an agency employee or legislator and participated in those matters. The state reserves the right to void any contract entered into in violation of Chapter 84, and may recover any fees, compensation, gifts, or profits received as a result of such violations. If the contractor indicates it is a legislator or employee with a controlling interest and the contract exceeds $10,000, the contract must be awarded through competitive sealed bidding or proposal procedures, or the agency must post notice of intent to award and file with the State Ethics Commission.
