About this file

This is a Domestic Partnership Act Certification form for Broward County, Florida, applicable to vendors responding to solicitations for goods and services valued over $100,000. The certification addresses compliance with Broward County Code of Ordinances Sections 16-150 through 16-165, which mandates that vendors provide benefits to registered domestic partners of employees on the same basis as benefits provided to employees' spouses. Vendors must complete and submit the form with their solicitation response, or within three business days of the County's request, or risk being deemed nonresponsive. For tiebreaker consideration purposes, vendors must submit the completed form at the time of solicitation submittal to remain eligible. The form requires vendors to certify their compliance status by selecting one of three primary options: current compliance, commitment to comply at contract award, or non-compliance with the requirement.

The certification form provides multiple exemptions for vendors unable to comply with the Domestic Partnership Act requirements. Eligible exemptions include employers with fewer than five employees, entities that do not provide spousal benefits, governmental entities, non-profit corporations, charitable organizations, religious organizations, and educational institutions. Additionally, vendors may claim exemption if they provide employees with a cash equivalent of benefits or if compliance would violate federal or state law, or conflict with terms of federal or state grants or contracts. Vendors claiming exemptions must provide appropriate documentation, including affidavits or explanations of applicable laws and regulations. The form was last updated on September 9, 2024, and applies to the Removal and Transportation of Deceased Persons contract for the Broward County Office of Medical Examiner and Trauma Services.
