About this file

This file is a Business Request for GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form provided by Salt Lake City Corporation Purchasing & Contracts Management Division for use in connection with the Request for Proposals SLCI27002 for Security Guard Services at Salt Lake City Department of Airport. The form allows contractors or private providers to identify protected records or information they wish to shield from public disclosure, specifically trade secrets and commercial financial information that could result in unfair competitive injury if revealed. Claimants must submit the form concurrently with the information they seek to protect and provide a concise statement of reasons supporting the confidentiality claim, including details such as the company name, representative contact information, and specific identification of which pages and paragraphs require protection.

Under Utah Code provisions 63G-2-305 and 63G-2-309, trade secrets are protected upon submission of a confidentiality claim, while commercial financial information receives protection if disclosure could reasonably cause competitive harm and the claimant has filed the required claim. The form includes fields for claimants to identify multiple pages and paragraphs requiring protection along with corresponding reasons for each claim. Importantly, the form explicitly notes that submission of a confidentiality claim does not guarantee protected classification if the government receives a records request; claimants may optionally provide a redacted public version of protected records alongside their claim.

Business Request for GRAMA Business Confidentiality Claim For use by contractors or private providers to identify protected records or information

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
