About this file

This is a Confidential and Proprietary Information Declaration Form for use by contractors submitting proposals to Salt Lake City Corporation's Purchasing & Contracts Management Division. The form is designed to allow bidders responding to Request for Proposals SLCI26094 for Tree Pruning and Tree Removal Services to claim confidentiality protection for trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309. Contractors must complete the form by providing their company information, identifying the specific pages and paragraphs of their proposal that contain protected information, and including a concise statement of reasons supporting each confidentiality claim. The form requires submission concurrent with the proposal materials to be effective, and bidders are encouraged to provide both confidential and redacted public versions of claimed materials. Proposals are due May 12, 2026, and all proposals become City property subject to Utah's Government Records Access and Management Act (GRAMA) unless successfully claimed as confidential.

The confidentiality claim does not guarantee protected classification status if the government receives records requests, as the determination remains subject to applicable Utah law and the governmental entity's review. Contractors should note that submitting a confidentiality claim requires clear documentation of the business rationale for protection, such as unfair competitive injury that could result from public disclosure of commercial financial information or disclosure of trade secrets. The form serves as the mechanism for bidders to assert their rights under state law while participating in the competitive procurement process for arboricultural services. No specific budget information, pricing terms, or award details are disclosed within this document, which focuses exclusively on the procedures for claiming confidentiality protection during the proposal submission process.

Business Request for GRAMA Business Confidentiality Claim For use by contractors or private providers to identify protected records or information

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
