About this file
This is a Confidential and Proprietary Information Declaration Form issued by Salt Lake City Corporation's Purchasing & Contracts Management Division for use in conjunction with the Request for Bid SLCI27036 for a landfill gas blower/flare system equipment procurement. The form enables contractors and private providers to identify and protect records or information they wish to claim as confidential under Utah Code provisions governing trade secrets and commercial financial information. Contractors submitting bids or proposals may use this form to declare specific pages, paragraphs, or sections of their submissions as confidential, provided they include a concise statement explaining the basis for the confidentiality claim and submit the form alongside their protected materials.
Confidentiality claims are permitted under Utah Code 63G-2-305 for trade secrets and for commercial financial information where disclosure could reasonably result in unfair competitive injury. Claimants must complete all required fields including company information, contact details, identification of the specific records requiring protection, and detailed reasoning supporting the confidentiality request. Contractors may optionally provide a redacted public copy of claimed confidential records. The form explicitly notes that submitting a confidentiality claim does not guarantee protected classification if the governmental entity receives subsequent records requests, placing the burden on the claimant to substantiate the claim's validity under applicable Utah public records law.
