About this file
This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in conjunction with the State of Utah Division of Purchasing's Request for Proposals (RFP) for Disaster Management and Recovery Consultants. The RFP seeks to establish a statewide cooperative contract with an anticipated term of five years, with vendor pricing guaranteed for a minimum of one year. The procurement may result in multiple awards based on a structured evaluation methodology. Vendors must submit both redacted and non-redacted versions of their proposals; failure to provide a redacted copy will result in the Division of Purchasing declining to redact proposals on behalf of the claimant.
The evaluation process allocates 700 technical points and 300 cost points, with vendors required to achieve a minimum of 70 percent of technical criteria points (490 points) to advance to cost evaluation. The vendor submitting the most competitive average hourly rate receives 100 percent of available cost points, with all other vendors receiving proportional points calculated through a specified formula. Vendors may claim trade secrets and commercial financial information as confidential under Utah Code sections 63G-2-305 and 63G-2-309, provided they submit a concise statement of reasons supporting the claim and demonstrate that disclosure could reasonably result in unfair competitive injury. The confidentiality claim does not guarantee protected classification if the government receives a records request. The contract carries no administrative fee.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
