About this file

This document is a Business Request for GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form issued by the Utah State Archives and the Office of the Government Records Ombudsman. The form provides a mechanism for businesses to request confidential treatment of certain submitted documents under Utah state law, specifically Utah Code §§ 63G-2-305(1) and 63G-2-305(2), which allow protection of trade secrets and commercial financial information that could potentially result in unfair competitive injury.

The form requires detailed information from the claimant, including company name, address, representative details, and a concise statement explaining the reasons for the confidentiality claim. Importantly, the document stipulates that claimants must submit both redacted and non-redacted versions of their proposal, with the entire proposal prohibited from being fully redacted. The Division of Purchasing will not redact documents on behalf of claimants who fail to upload a redacted copy. The form also includes a critical disclaimer that making a confidentiality claim does not guarantee protected classification if the government receives a records request.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
