About this file

This is a GRAMA Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the Easement Management System (RR27-102) RFP conducted by the State of Utah Division of Purchasing and the Veteran & Military Affairs department. The form serves as a template for vendors submitting proposals to protect trade secrets and commercial financial information from public disclosure under Utah's Government Records Access and Management Act (GRAMA). Claimants must submit both redacted and non-redacted versions of their proposals, with the confidentiality claim specifying which pages, paragraphs, and information qualify for protection along with concise reasoning for each claim. The RFP seeks creation of an Easement Management System according to the Scope of Work (Attachment C) and anticipates a single contract award to the highest-scoring responsive and responsible vendor through a three-stage evaluation process.

The evaluation methodology consists of an Initial Review stage eliminating non-responsive proposals, a Technical Proposal Evaluation stage assessing six criteria (Company History, Product Features, Monitoring & Compliance, Acquisition & Funding, Project Management, and Ongoing Maintenance & Support) worth 600 total points with a minimum threshold of 420 points for advancement, and a Demonstrations stage worth 200 additional points for qualified offerors. Vendors failing to submit both redacted and non-redacted proposal versions will not receive redaction assistance from the Division of Purchasing. Making a confidentiality claim does not guarantee protected classification if the government receives records requests, as protection depends on meeting statutory requirements under Utah Code sections 63G-2-305 and 63G-2-309 demonstrating that disclosure could result in unfair competitive injury or involve legitimate trade secrets.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
