About this file

This is a Business Confidentiality Claim Form from the Utah State Archives' Office of the Government Records Ombudsman, applicable to the State of Utah Division of Purchasing's Request for Proposal (RFP) for Water Leak Detection Systems and Installation Services. The form serves as a template for vendors submitting proposals to assert confidentiality protections under Utah Code 63G-2-305 and 63G-2-309 for trade secrets and commercial financial information that could result in unfair competitive injury if disclosed. Vendors submitting proposals must provide both redacted and non-redacted versions of their complete proposal documentation, with at least a portion of the proposal remaining unredacted. The RFP process allows for multiple awards and spans a five-year contract term with vendor pricing guaranteed for one year.

The confidentiality claim form requires vendors to submit detailed company information, identify specific pages and paragraphs subject to protection, provide concise statements supporting the confidentiality claim, and receive acknowledgment from the governmental entity. Vendors achieving a combined score of at least 70 percent across 700 technical points and 300 cost points become eligible for the statewide cooperative contract, with a minimum technical score of 490 points required to advance to cost evaluation. An administrative fee of 0.25 percent applies to the contract. The Division of Purchasing will not redact proposals on behalf of claimants who fail to submit redacted versions, and making a confidentiality claim does not guarantee protected classification if the government receives subsequent records requests.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
