About this file

This document is Attachment C: Agency Terms for solicitation EV00000958, issued by the Oklahoma Office of Management and Enterprise Services (OMES) Central Purchasing division on behalf of the Department of Public Safety (DPS). The solicitation seeks qualified instructors to provide four FEMA NIMS ICS All Hazards Position Specific Unit Leader Courses. DPS's emergency response training is funded through a Public Health Emergency Preparedness (PHEP) Cooperative Agreement grant administered via interagency agreement with the Oklahoma State Department of Health (OSDH). Any subcontractors selected must receive written approval from OSDH prior to contract award and execution. The resulting contract may be designated for use as a statewide contract under Oklahoma Statutes 74 O.S. § 85.5(G)(3).

Payment to the supplier shall be made upon submission of proper invoices following delivery and acceptance of services in accordance with 74 O.S. § 85.44B. Invoices must include the supplier's name, address, FEI number, invoice date, period covered, purchase order number, detailed service descriptions, and any contractually required documentation. For time-based compensation, suppliers and approved subcontractors must maintain Personnel Activity Reports (PARs) on all employees charged to the contract, completed per Federal Cost Principles in 2 CFR Part 200.430. All invoices require supplier signature and attestation that the invoice accurately represents services provided. The contract establishes an independent contractor relationship; the supplier is not an employee of DPS and receives no employee benefits or workers' compensation. The supplier must notify the DPS contract monitor of any change in the contractor relationship, which triggers automatic contract termination.
