Contract Summary: Bridge Replacement Project 0068-0217

This is a Special Provisions document issued by the Connecticut Department of Transportation (CTDOT) for a federally-funded bridge replacement project in partnership with the Town of Killingly, Connecticut. The project involves the replacement of Bridge No. 02599 on Route 101 over Alvia Chase Reservoir. The contractor must be prequalified in Group No. 8A (Box Culverts) to be eligible to bid. The contract allows 244 calendar days for completion, with liquidated damages assessed at $900.00 per calendar day for failure to meet the overall completion deadline. Additionally, milestone liquidated damages of $20,000.00 per day apply if critical activities listed in Article 1.03.09 are not completed by the specified Milestone Completion Date. The project requires a planned road closure and detour on Route 101 not to exceed 14 consecutive days, with the contractor permitted to halt traffic for up to 10 minutes during specified work windows between 9:00 AM and 3:00 PM. The contractor must notify local authorities, emergency services, and the Rhode Island Department of Transportation at least 14 days in advance of implementing detour or alternating one-way traffic operations. Utility relocation work is required, with coordination necessary among Eversource Energy, Frontier Communications, Level 3 Communications, and Atlantic Broadband (Breezeline), each with specified representatives and contact information.

The contract incorporates ConnDOT Form 819 (2024 Standard Specifications) as modified by these Special Provisions and is subject to federal wage determinations under the Davis-Bacon Act, with wage rates applicable to Connecticut highway construction in Windham County. All materials must comply with Buy America Act (BAA) and Build America, Buy America Act (BABA) requirements, with contractors required to submit a "Buy America Preference Source of Supply Self-Certification Form" for all iron, steel, manufactured products, and construction materials. The contractor must use AASHTOWare Project software for payroll submissions and payment verification, with all associated costs included in the general cost of work. The project includes an estimated 475 cubic yards of excavated soil designated as surplus "Controlled Material," which must be reused within project limits or placed in the designated Reuse Stockpile Area. All contractual submittals must be submitted through CTDOT's COMPASS (Construction Document Management System), and the contractor must provide GPS coordinates for all new signage. The contract is funded as Federal Aid Project No. 0101(114) and is subject to specific material testing requirements, utility coordination protocols, and environmental compliance measures outlined in detailed specifications for excavation, structure work, asphalt concrete, and incidental construction items.

NOTICE TO CONTRACTOR - UTILITY SPECIFICATIONS

The contractor is hereby notified that all utility specifications contained elsewhere herein shall be made a part of this contract, and that the contractor shall be bound to comply with all requirements of such specifications. The requirements and conditions set forth in the subject specifications shall be binding on the contractor just as any other specification would be.

NOTICE TO CONTRACTOR - UTILITY COORDINATION &

RELOCATION

The proposed temporary and/or permanent locations of the aerial and underground utility facilities are shown on the plans. The Contractor is required to coordinate the exact location and timing of all utility relocations with the individual utility owners, and to phase construction operations as required to accommodate all (temporary and/or permanent) utility relocations. In addition to field meetings and correspondence, this coordination may include staking of locations, excavation and temporary grading, tree trimming, providing access to existing and future utility locations, and/or other physical work as required to allow for utility relocation work. The Contractor shall engage in the necessary coordination of utility relocations and associated work at no additional cost to the

State.

The Contractor’s schedule of operations and construction phasing plans shall show the anticipated utility relocations in the sequence of construction. Project specific utility work schedule information has been provided by the respective utility companies and is included in “Notice to

Contractor – Utility Generated Schedule”.

The Contractor shall give notice to utility companies a minimum of 30 days prior to required work or services to the utility company. A list of utility companies and representatives is included in

Special Provisions Section 1.07.

The Contractor must coordinate with each utility owner and develop their own schedule of utility relocation work and time required to complete this work based upon their own operational plan and equipment.

NOTICE TO CONTRACTOR – UTILITY COMPANIES

It is understood that any references in the contract documents to Northeast Utilities, CL&P and/or

Yankee Gas are meant to refer to Eversource.

It is understood that any references in the contract documents to AT&T is meant to refer to Frontier

Communications.

NOTICE TO CONTRACTOR – PROTECTION OF EXISTING UTILITIES

Existing utilities shall be maintained during construction. The Contractor shall verify the location of underground and overhead utilities. Construction work within the vicinity of utilities shall be performed in accordance with current safety regulations.

Representatives of the various utility companies shall be allowed access to the work, by the

Contractor.

The Contractor shall be liable for all damages or claims received or sustained by any persons, corporations or property in consequence of damage to the existing utilities, their appurtenances, or other facilities caused directly or indirectly by the operations of the Contractor.

In order to notify utility companies the number 1-800-922-4455 (Call Before You Dig), in accordance with Sections 16-345 through 16-359 of the Public Utilities Regulatory Authority

(PURA) state statutes, must be called at least two (2) full working days prior to the start of excavation. This notification will enable the utility companies to mark out their facilities in the field.

Contractors are cautioned that it is their responsibility to verify locations, conditions, and field dimensions of all existing features, as actual conditions may differ from the information shown on the plans or contained elsewhere in the specifications.

The Contractor shall notify the Engineer prior to the start of work and shall be responsible for all coordination with the Department. The Contractor shall allow the Engineer complete access to the work.

Any damage to any existing private and public utility, as a result of the Contractors operations, shall be repaired to the utility and Engineer's satisfaction at no cost to the State, the Town or the

Utilities, including all materials, labor, etc., required to complete the repairs.

During the excavation for the proposed improvements, the cover over the existing underground

Utilities will be reduced. Therefore, the Contractor shall have the location of the underground

Utilities marked out prior to and following the excavation. The Contractor's attention is directed to the requirements of Article 1.07.13-Contractor's Responsibility for Adjacent Property, Facilities and Services.

Prior to opening an excavation, effort shall be made to determine whether underground installations, i.e., sewer, fuel, electric line, etc., will be encountered and, if so, where such underground installations are located. When the excavation approaches the estimated location of such installation, the exact location shall be determined by careful probing or hand digging, and when it is uncovered, proper supports shall be provided for the existing installation. Utility companies shall be contacted and advised of proposed work prior to the start of actual excavation.

The Contractor shall perform all work in such a manner that will protect each Utility Company's facilities from damage. This may include excavation by hand methods as well as modified compaction methods when working close to underground Utilities. The Contractor is responsible for coordinating their work with each utility sufficiently in advance of the work so that the utility can schedule their work crews.

This material is defined by

CTDOT as a “Controlled Material.” Controlled Material is soil generated from a CTDOT Project which, due to known or potential contamination, must have its destination controlled by the Department, but may be reused for similar purposes on CTDOT projects or within CTDOT right-of-way.

Accordingly, all excavated soils generated from Project No. 0068-0217 shall be reused within the Project limits to the greatest extent practicable, placed within the CTDOT right-of way as directed by the Engineer or deposited at the designated Reuse Stockpile Area shown in the Plans. As much as possible, excavated soil suitable for immediate reuse shall be managed at the point of origin for use as backfill. When direct reuse at the point of origin is not feasible, the soil - excluding existing pavement structure (asphalt and subbase), rock, ledge, boulders and concrete shall be transported to the Reuse Stockpile Area in accordance with the special provision for Section 2.02, 2.03 in this Contract and Disposal of Controlled Material, and as directed by the

Engineer.

0068-0217 SECTION 1.06

SECTION 1.06 - CONTROL OF MATERIALS

Replace Section 1.06 in its entirety with the following:

SECTION 1.06

CONTROL OF MATERIALS

1.06.01—Source of Supply and Material Quality

1.06.02—Samples and Test

1.06.03—Storage

1.06.04—Defective Materials

1.06.05—Shipping Material

1.06.06—Vacant

1.06.07—Certified Test Reports and Materials Certificates

1.06.08—Warranties, Guarantees and Instruction Sheets

1.06.01—Source of Supply and Material Quality:

1. Source of Supply: A source of supply is defined as the original manufacturer of material(s) used within a project. A source of supply may fabricate material(s) such as precast concrete structures or hot mix asphalt from components originally manufactured by others. A broker, distributor, or subcontractor using the material(s) must not be identified as a source of supply.

The Contractor must notify the Engineer of the proposed source of supply for each of the materials listed on the Anticipated Source of Material (CON-083) Form within 30 days after bid opening. Should it become necessary for the Contractor to obtain material from sources other than those indicated in the submitted Anticipated Source of Material

(CON-083) Form, the Contractor shall notify the Engineer and resubmit this document to the Department no later than seven (7) days prior to use of the material. The Engineer reserves the right to request additional information regarding such sources.

Contractor of its non-conformance and that source of supply shall no longer be used for said application.

a. Buy America Act (BAA): The BAA requires that all permanently incorporated steel and iron used in the construction of the Project must have been produced and fabricated in the United States. It is the intent of this specification to require that all manufacturing processes for all steel and iron materials and products to be used for the Project, from initial melting stage through the application of coating of steel and iron, occur within the United States, with the following exceptions:

1. The Contractor may request, in accordance with 635.410(b)(4) of Title 23 CFR, approval to include a minimal amount of foreign steel in the Project construction.

This amount is defined as 0.1% of the total Contract cost or $2,500.00, whichever is greater. The cost of the foreign steel or iron is defined as its Contract value when delivered to the Project site.

2. Additionally, the FHWA has granted a nationwide waiver of the requirements of

23 CFR 635.410, Buy America Act requirements, for the production of pig iron and processed, pelletized, and reduced iron ore.
