About this file

This is a Payment Bond document for Mt. San Antonio College, a California community college undertaking construction of a new four-story Technology and Health Building. The document establishes the bonding requirements that contractors must satisfy before beginning work on the project. The payment bond is required in an amount equal to 100 percent of the contract price and must be filed with the College's governing board prior to the contractor's commencement of work. The bond secures claims related to labor, materials, provisions, and supplies necessary for project performance, as well as employment-related withholdings required under California Unemployment Insurance Code Section 13020. The bond document provides that it must be executed in two identical counterparts and requires the contractor to affix a corporate seal, provide notarial acknowledgment of all surety signatures, and submit a Power of Attorney and Certificate of Authority for the surety. The surety must be an admitted surety insurer authorized by the California Department of Insurance.

The bond obligates the principal (contractor) and surety jointly and severally to pay all laborers, material suppliers, and other persons entitled to file claims under California Civil Code Section 9100 for any unpaid labor, materials, or services related to the contract performance. The surety waives notice of any changes, extensions, alterations, or additions to contract terms or specifications and agrees that such modifications will not affect its bond obligations. In the event of breach, the surety commits to paying reasonable attorney's fees as awarded and fixed by the court and included in any judgment rendered. The bond document requires bidders to use the College's form rather than a surety company's alternative form and mandates inclusion of the California agent's name, address, and telephone number on the executed document.
