About this opportunity
The State of Utah Department of Insurance is pursuing a non-competitive, sole-source procurement for Sircon for States software and accompanying modules to support insurance regulatory operations. The Division of Purchasing and General Services is conducting this procurement on behalf of the Department of Insurance, with a notice of intent to award published on April 23, 2026, and a deadline of May 1, 2026, for interested vendors to submit challenges to the sole-source determination. The procurement encompasses the Sircon for States subscription service, which includes integrated invoicing capabilities for licensee fees, document management systems, and regulatory compliance operations aligned with National Association of Insurance Commissioners standards. The Department of Insurance justifies the sole-source award based on the conclusion that Sircon for States is the only system capable of adequately supporting its legislatively approved fee schedule, which serves as the primary revenue source for the department, and that transitioning to an alternative system would create significant financial burden and operational disruption. The contract term is two years beginning June 11, 2026, with renewal options available. The procurement does not include specific bidders' conferences, site visits, or response conferences. Vendors may submit documentation during the public challenge period to contest the sole-source determination by demonstrating comparable or equivalent systems and services, provided such challenges include detailed explanations of capabilities and cost comparisons related to transitional expenses.
The procurement documentation indicates that all vendors must certify compliance with Utah Code 63G-27 regarding economic boycotts and boycotts of the State of Israel, with this certification required to be maintained throughout the contract term. The incumbent vendor for this procurement is Vertafore, which is the identified sole-source provider for the Sircon for States software. The estimated contract value is $519,000.00 with freight costs included on an F.O.B. Destination, Freight Prepaid basis. The pricing quote reflects annual subscription costs of $255,000 for the first contract year (June 11, 2026 to June 11, 2027) and $263,000 for the second year, with an alternative quote structure presenting costs of $255,000 and $264,000 for the respective years, reflecting modest annual increases of 3.5% to 3.7%. Interested parties may also submit business confidentiality claims using the provided GRAMA form if they wish to protect trade secrets and commercial financial information from public disclosure, though submission of such claims does not guarantee protected classification if the government receives records requests. The Division of Purchasing retains the authority to award the contract despite valid challenges if the justification is based on transitional costs or impracticability rather than sole-source availability.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
