About this file

This is a GRAMA (Government Records Management Act) Business Confidentiality Claim form issued by the Office of the Government Records Ombudsman under the Utah State Archives. The form is designed for use by businesses and contractors submitting proposals or information to governmental entities in Utah who wish to protect trade secrets and commercial financial information from public disclosure. The claimant must submit both redacted and non-redacted versions of their proposal, with the entire proposal unable to be redacted. The form requires detailed claimant information including company name, address, representative contact details, and a concise statement of reasons supporting the confidentiality claim. The claim must identify specific pages and paragraphs for which protection is sought and the reasoning for each redaction request. This particular form is associated with the state of Utah's procurement process for a Sircon for States contract opportunity.

The confidentiality claim process is governed by Utah Code 63G-2-305 and 63G-2-309, which allow trade secrets and commercial financial information to be protected if disclosure could reasonably result in unfair competitive injury. However, submission of a confidentiality claim does not guarantee that the information will receive protected classification if the government receives a records request. The Division of Purchasing will not redact proposals on behalf of claimants who fail to provide a properly redacted version of their submission. All claims must include the date submitted and be signed by an authorized company representative.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
