About this opportunity
The Colorado Division of Reclamation, Mining and Safety (DRMS) issued a sealed bid solicitation for the Bullion King Mine Waste Reclamation Project (Bid Number PKA-15-746), a comprehensive mine waste remediation initiative located 11 miles from Silverton, Colorado at 12,400 feet elevation. The project aims to reduce heavy metal and acid contamination impacting Mineral Creek, a tributary to the Animas River, through extensive earthmoving, liner installation, and site restoration work. The scope of work encompasses 21 bid items including mobilization and demobilization, road access improvements, construction of approximately 500 linear feet of run-on channels for stormwater management, excavation and placement of approximately 3,000 cubic yards of mine waste materials, regrading of approximately 6,000 cubic yards of existing waste to slopes no steeper than 3H:1V, installation of an 8-mil geotextile layer and 45-mil polypropylene liner system across approximately 30,000 square feet, placement of chemical barrier materials (quick lime kiln dust and fly ash), and revegetation of approximately 2 acres using hand-broadcast seeding and excelsior mulch. Bidders must submit a bid bond equal to five percent of the total bid price, a completed bid form with manual signature, equipment list, qualifications summary with three references demonstrating experience with mine waste excavation, acidic mine discharge handling, earthen material screening at elevations exceeding 10,000 feet in remote locations, and geomembrane/geotextile liner installation, as well as chemical analyses of proposed cement kiln dust and fly ash sources. The original bid submittal deadline of February 23, 2015 was extended to April 7, 2015 at 4:00 p.m., with bid opening scheduled for April 8, 2015 at 10:00 a.m.; bids were to be submitted electronically through Colorado Vendor Self Service or as sealed single copies to the Division office at 1313 Sherman Street, Suite 215, Denver, Colorado 80203. A mandatory pre-bid meeting and site showing was held on October 8, 2014 at 10:00 a.m. at the Silverton Visitors Center, with attendance required for bid consideration. Construction is scheduled between July 6, 2015 and August 31, 2015, with a maximum completion time of 57 calendar days after Notice to Proceed, and liquidated damages are assessed at $400 per day for schedule overruns.
The project carries no set-asides restricting bidder eligibility; however, successful bidders must comply with Davis-Bacon Act wage rate requirements and Colorado labor requirements mandating 80 percent Colorado labor utilization. The successful bidder must complete a Minority/Women Business Enterprise Participation Report and execute a Notice to Proceed before commencing work. Award will be made to the lowest responsive and responsible bidder meeting all qualifications and requirements, with contract performance monitored through Colorado's statewide Contract Management System. The project is funded through federal Clean Water Act grant money (CFDA #66.460) awarded to the Animas River Stakeholders Group under the Bullion King 319 Non-Point Source Grant, supplemented with matching funds from Colorado Mineral Severance Tax, indicating the contract value likely exceeds $150,000 given the extensive scope of work and retainage terms specified for contracts at or above that threshold. Performance and payment bonds equal to 100 percent of the original contract price are required within ten days of award notification; retainage will be withheld at 5 percent for contracts of $150,000 or greater, or 10 percent for contracts between $50,000 and $149,999.99, until project completion and advertisement. The contractor must obtain 10,000 square feet of CoolPro RPP45 liner already owned by the Division from Grand Junction, Colorado, and purchase an additional 20,000 square feet to meet the project requirement, and must source limestone crusher fines meeting at least 85 percent calcium carbonate equivalent from Colorado Lime and excelsior mulch from Western Excelsior, with contact information provided for material procurement.
