About this opportunity
The Board of Commissioners of Charles County, Maryland is soliciting competitive bids through Invitation to Bid (ITB) #26-043 for pavement overlay and road maintenance construction services on an as-needed basis throughout the county. The procurement encompasses commercial pavement overlay and maintenance services including bituminous concrete surface and base applications with wedge and level work, thermoplastic and painted pavement markings with directional arrows, bituminous concrete patching, and milling operations up to three inches deep, covering an estimated 8.03 miles and approximately 15,760 tons of overlay material during the initial fiscal year (July 1, 2026 through June 30, 2027) with additional patching work totaling 2,165 tons. Qualified bidders must demonstrate a minimum of five years of active engagement in the pavement overlay and maintenance field with at least five completed representative projects, provide equipment inventory lists and source of supply letters with job mix formulas compliant with Maryland Department of Transportation standards (not exceeding 25% reclaimed asphalt product), submit superintendent resumes documenting minimum three years of experience, and provide certified lists of flaggers with current certifications. The contract will commence upon execution and run through September 30, 2027, with four optional one-year renewals at the County's sole discretion (renewal periods running November 1 through October 31). A non-mandatory pre-bid meeting is scheduled for May 21, 2026, at 9:00 a.m. via virtual teleconference, with bids due electronically through the County's eProcurement Portal by June 11, 2026, at 11:00 a.m., at which time bids will be opened. Award will be made to the lowest responsive and responsible bidder, and the County reserves the right to reject any or all bids.
This procurement includes a mandatory Minority and Women's Business Enterprise (MWBE) subcontractor participation goal of 14.95%, requiring contractors to demonstrate commitment to inclusive contracting practices. Bidders must submit a five percent bid bond, performance and labor/material payment bonds equal to 100% of task price for orders exceeding $100,000, vendor disclosure forms, non-collusion affidavits, and a Maintenance Bond covering the full one-year warranty period as an alternative to retainage. The contract requires full compliance with Maryland prevailing wage rates established by the Commissioner of Labor and Industry, with contractors obligated to submit certified quarterly payroll records; this requirement applies to projects exceeding $500,000. Work cannot commence until the contractor receives a County-issued Purchase Order and written Notice to Proceed from the Project Manager, and subcontracting is prohibited for asphalt placement work. Monthly invoicing will include five percent retainage held through the one-year warranty period, with unit prices to include all labor, materials, equipment, travel, fuel, maintenance of traffic, bonding, taxes, insurance, overhead, and profit; price adjustments will be applied monthly based on liquid asphalt index fluctuations when the index varies more than five percent from the Original Base Index. While specific award values are not stated in the solicitation documents, the scope of work estimated at 8.03 miles of overlay and 15,760 tons of material suggests a substantial contract value, with potential for significant revenue under the multi-year renewal structure if annual funding appropriations and program approvals are secured by Charles County Government.
