About this opportunity
Pennsylvania's Governor's Office of General Counsel (OGC) is requesting proposals from law firms for out-of-state lien enforcement services on behalf of the Pennsylvania Department of Revenue, with questions due November 17, 2026 and proposals due December 4, 2026 at 4:00 p.m. Eligibility turns on minimum qualifications rather than a set-aside or preference program.
The firm must enforce collection of out-of-state tax debt using advanced location services, debtor contact by letter and telephone, judgment lien filing in other states, case activity documentation, and legal action to resolve accounts. The Department does not guarantee a minimum case volume but anticipates referring 5 to 10 cases per month.
Minimum qualifications require prior collections experience and prior legal enforcement experience, each supported by three references including at least one governmental engagement, plus demonstrated legal enforcement across multiple states. The firm must keep a managing attorney on staff in Pennsylvania with at least ten years of collections experience and five years of governmental legal enforcement experience. Key personnel changes require Commonwealth approval. Firms must provide audited financials for the past three years, disclose litigation and administrative proceedings from the preceding five to ten years and debtor and consumer complaints from the preceding three years, maintain Pennsylvania tax compliance, and comply with IRS Publication 1075. Proposals must fully describe AI and automated technology use and ensure Commonwealth data is not used for vendor AI development or training.
Compensation is a contingent fee based solely on collections. The Commonwealth incurs no direct costs and reimburses only out-of-state sheriff fees required for judgment execution. No fees are paid on recalls, offsets (including Treasury Offset Program payments), or directs received within seven days of referral. The contract term is three years from the effective date, with the Commonwealth holding an option to renew for up to two additional years in single-year increments. The Commonwealth reserves the right to make limited multiple awards and to negotiate fair and reasonable compensation.
Technical factors are weighted at 80 percent and cost at 25 percent. Proposals scoring below 80 percent of available technical points are deemed non-responsible and ineligible for cost evaluation.
Answers to questions will be posted by November 19, 2026.
Opportunity text
This request for proposals ("RFP") provides sufficient information to enable interested law firms ("Firms") to prepare and submit proposals for the Governor's Office of General Counsel's ("OGC") consideration to satisfy a need for Out of State Lien Enforcement Services for the Pennsylvania Department of Revenue ("Department").This RFP is issued pursuant to Executive Order 2015-2 dated January 20, 2015, and in accordance with Section 518 of the Commonwealth Procurement Code, 62 P.S. § 518 and Part III Chapter 8 of the DGS Procurement Handbook. The Issuing Office is seeking proposals, on behalf of the Department, to procure the services of an Offeror to enforce collection of out of state tax debt. Traditional collection tools such as dunning notices, telephone calls, levy, and referral to a third-party collection agency have limited expectation of resolution. States are increasingly reliant on taxes reported and paid by out of state taxpayers. As an example, Pennsylvania customers make purchases online from out of state sellers. The state tax debt associated with out of state taxpayers should increase in a corresponding way. The need for out of state lien enforcement services remains paramount for protecting the Commonwealth's best interests. Additional detail is provided in Part IV of this RFP.
