About this file

This document is Appendix D of a Request for Proposals issued by Pennsylvania's Governor's Office of General Counsel on behalf of the Department of Revenue, serving as a Statement of Qualifications, Conflicts Disclosure, and Technical Questionnaire for law firms seeking to provide Out of State Lien Enforcement Services. The engagement requires law firms to submit comprehensive proposals demonstrating their qualifications to enforce collection of out-of-state tax debt through traditional collection tools and legal enforcement mechanisms. Prospective vendors must provide detailed information including staff resumes, identification of key personnel (specifically a managing attorney), proposed subcontractors, organizational financials, conflict of interest disclosures, and a comprehensive narrative describing their understanding of the engagement and plan of action. The contract will require a managerial-level attorney on staff in Pennsylvania and adherence to the Commonwealth's tax confidentiality and security requirements.

Minimum qualifications mandate that law firms demonstrate prior collections experience with three references including at least one governmental collections engagement, prior legal enforcement experience with three references including at least one governmental legal enforcement engagement, and demonstrated experience performing legal enforcement in multiple states. The managing attorney must possess a minimum of ten years of collections experience and five years of governmental legal enforcement experience. Firms must disclose any litigation, administrative proceedings, indictments, or convictions within the preceding five to ten years, provide audited financials for the past three years, confirm compliance with Pennsylvania tax requirements and the OGC Conflict Waiver Policy, and maintain professional liability insurance in an amount customary for their size and practice area. Notably, firms must fully describe their use of artificial intelligence and automated technologies in legal service delivery, including identifying specific tools and detailing protections ensuring Commonwealth data is not used for vendor AI development or training.
