About this opportunity
The State of Utah, through the Department of Government Operations Division of Purchasing and General Services on behalf of the Department of Workforce Services Vocational Rehabilitation program, is issuing a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for MW26-15, a vehicle modification procurement. The procurement involves the purchase and modification of a 2026 Toyota Sienna Hybrid XSE AWD vehicle to include comprehensive electronic driving system modifications, specifically EMC J Series joystick controls and secondary controls systems. The deliverables include a Vantage Mobility AWD infloor wheelchair ramp conversion with lowered floor, power kneel, and power ramp functionality, EMC driving controls and systems, chair brackets, seat belt modifications, auxiliary power systems, and ancillary equipment, along with 150 hours of labor for EMC equipment installation and 20 hours of post-installation fitting and adjustments. The procurement is being conducted as a sole-source award justified under federal law Client Informed Choice (34 CFR 261.52 and 34 CFR 361.45), which permits vocational rehabilitation clients to select vendors meeting their individual needs. The intended vendor is Compassion Mobility LLC per estimate #4005. The public notice period opened on April 16, 2026, with a due date for challenges of April 23, 2026. Qualified vendors wishing to contest the sole-source determination must submit detailed documentation demonstrating alternative sources capable of providing comparable products or cost comparison analyses if transitional costs are cited as justification.
This procurement contains no specific set-aside designations for disadvantaged enterprises or restrictions on organizational types responding to the notice; however, the sole-source justification is predicated on the VR Counselor and client's collaborative selection process with state-contracted vendors, resulting in the selection of Compassion Mobility based on its exclusive provision of EMC driving controls, existing work relationships, vendor proximity, and equipment compatibility. All responding vendors must comply with Utah Code 63G-27 et seq. regarding anti-boycott certifications and certify non-engagement in economic boycotts or boycotts of the State of Israel. The total estimated contract value is $208,006.40, consisting of $193,583.36 in state portion funding for modifications and $14,423.04 in client portion covering the vehicle chassis, tax, and registration, with no additional freight costs specified beyond those embedded in the estimate. The estimate itemizes key components including the base vehicle at $50,455.00, the Vantage Mobility wheelchair ramp conversion at $41,000.00, and EMC controls and systems totaling approximately $84,000.00. Contract execution requires written approval from the Division of Purchasing, and supplemental funding may be available if the legislature provides additional appropriations.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
