About this file

This is a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process issued by the Utah Department of Government Operations Division of Purchasing and General Services on behalf of the Utah Department of Workforce Services Vocational Rehabilitation (VR) program. The procurement concerns the purchase of a 2026 Toyota XSE Plus AWD vehicle (VIN: 5TDXSKFC1TS239712) with modifications including an electronic driving system (EMC driving controls) from Compassion Mobility per estimate #4005. The justification for sole-source procurement is based on federal law Client Informed Choice (34 CFR 261.52 and 34 CFR 361.45), which permits clients receiving vocational rehabilitation services to select vendors and services that meet their individual needs rather than default to the lowest bidder. The VR Counselor and client collaborated to obtain multiple bids from state-contracted vendors, with the client ultimately selecting Compassion Mobility after reviewing available options. The selection was based on Compassion Mobility's exclusive provision of EMC driving controls required by the client, the client's existing work relationship with the vendor's owner, vendor proximity, and compatibility with existing equipment. No specific response dates, due dates, or award dates are provided in this notice.

The total estimated contract value is $208,006.40, consisting of $193,583.36 in state portion (USOR) for modifications and $14,423.04 in client portion covering the vehicle chassis, tax, and registration, with no additional freight costs specified. The procurement requires approval from the Division of Purchasing in writing before contract execution. While multiple bids were obtained during the selection process, including one from United Access, the document does not specify contract term length or renewal options. The procurement adheres to Utah Vocational Rehabilitation policies and procedures, which mandate consultation with the DWS State Purchasing Agent and State Purchasing for items valued at or above $30,000. The document serves as formal public notice allowing interested and qualified vendors to contest the sole-source determination within the publication period by submitting detailed documentation demonstrating competing sources or capability to provide comparable or equivalent products.

Issuing Procurement Unit: Division of Purchasing

Conducting Procurement Unit: Utah Department of Workforce Services

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS

The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that:

• there is only one source for the procurement item;

• transitional costs are a significant consideration in selecting a procurement item; or

• the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit.

In the subsequent pages the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process.

Determination of Other Interested Vendors

If the procurement item identified in this notice is to be awarded as a sole source (only one source for the procurement item), then this notice will help determine if there are any other interested and qualified vendors that meet the specifications of this notice. Any such vendors must submit the following information:

• The name of the contesting person; and

• A detailed explanation of the contest, including documentation showing that there are other competing sources for the procurement item.

In addition, a vendor should include:

• Documentation that your firm can provide a comparable or better procurement item that meets or exceeds the specifications;

• Documentation that your firm can also provide the same proprietary procurement item or an equivalent procurement item; and

• If transitional costs are identified as the justification for this notice, submit a cost comparison of the identified transitional costs with your firm’s anticipated transitional costs.

Regardless of any prior communications with the Division of Purchasing or the State, all vendors interested in responding to this notice must submit a response to this posting containing complete responses to all of the information requested above.

DO NOT CONTACT THE CONDUCTING PROCUREMENT UNIT. Any questions regarding this notice, including obtaining additional information, can be obtained through the Division of Purchasing during the publication period. No action is required if you agree with this notice.

If the purpose of this notice is an intent to award a sole source, after the public notice period has passed, and the Division of Purchasing determines that there are other interested and qualified vendors that meet the specifications of this notice, then the Division of Purchasing will not award a contract pursuant to this notice. An award without competition may still be made even if there are other interested vendors when the basis for the award is due to transitional costs or impracticality as stated above.

If, after the public notice period has passed, no valid contests have been received, then the Division of Purchasing may award a contract to the identified vendor without engaging in a standard procurement process.

Read the entire form very carefully before responding to this notice.

It is anticipated that this procurement will result in a:

SECTION A: ONLY ONE SOURCE

1. What is unique about this procurement item to justify an award of contract without engaging in a standard procurement process? (Explain in detail why the service, product, etc. is only available from a single supplier.)

VR policies & procedures were followed to ensure that the need is both necessary and reasonable. Required approvals were obtained at the appropriate management levels as set forth in VR policy. Federal law, Client informed Choice (34 CFR 261.52 and 34 CFR 361.45), allows clients the right to choose goods and services that they feel will meet their needs and not solely at the lowest price.

2. Could the procurement item be reasonably modified to allow for competition?

In collaboration with the client, Vocational Rehabilitation Counselor (VRC), and UCAT multiple bids has been acquired through various state contracted vendors who was able to provide the services that meets the client’s needs. Opportunities for competition among vendors were provided. Through the client’s right of Informed Choice the client is allowed to make the decision of which vendor would meet their needs best.

3. Explain the market research performed.

The VRC & UCAT collected bids from multiple vendors and presented the various options to the client. Upon the client reviewing all options through their rights of informed choice selected CM as the service provider to render the service of the vehicle and its modifications. The client indicates the services presented by CM best meets their needs towards their education, employment, and/or independent living & objectives. Factors included in this decision are listed below.

> CM was the only vendor that installs EMC driving controls that the client, requires as part of his driving system.

> Client has a standing work relationship with the owner “Robert” of CM through previous purchases of adaptive equipment.

> Vendor proximity to client’s home > Compatibility with existing items

4. What research have you conducted to ensure the requested procurement item is not available on an existing state cooperative contract?

VR policies & procedures were followed to ensure that the need is both necessary and reasonable. Required approvals were obtained at the appropriate management levels as set forth in VR policy. Federal law, Client informed Choice (34 CFR 261.52 and 34 CFR 361.45), allows clients the right to choose goods and services that they feel will meet their needs and not solely at the lowest price.

It should be noted that the VRC conducted extensive research & planning in making sure VR’s policy and procedures were appropriately applied throughout this process. That said, VR’s policy for items at & above $30,000.00 requires assistance from the DWS State Purchasing Agent & State Purchasing. Below I have included language from VR’s policy pertaining to this process.

● Counselor prepares a CSR, once approved items is added to IPE with language “specific vendor to be determined by bid process” **

○ Consult Appendix 12 A for approval levels

○ Bids not required at this step of the process, any preliminary bids collected should be included in documentation, however

● Counselor prepares auth to “Biddable item” using temporary vendor

#RH0082

○ Counselor prepares written detail of all details of items to be purchased including estimated shipping costs, handling and suggested vendors

● District purchasing expert assists in sending the bid information and authorization to DWS Purchasing Agent **

● Information for Purchasing Agent should include:

○ Clearly defined written criteria and specifications of items to be purchased

○ A lower bid may be rejected if specifications are not met

● DWS Purchasing agent will then forward the bid info to State Purchasing (typically an RQS in Finet)

○ RQS refers to Requisitions, used to request goods or services and get approval (becomes a purchase order)

○ May include state bid system or review of quotes/bids previously obtained

● VR Counselor notified of bid outcome and to confirm whether lowest bid is acceptable **

○ If lowest bid is not acceptable, written justification as to why is required and documented in the client's record/case file

● Bid is awarded and State Purchasing will issue a purchase order to the vendor, with a copy to the DWS Purchasing Agent

○ DWS Purchasing Agent will send a copy to the Counselor

● Upon receipt of items Counselor will: **

○ Review specifications in order to verify its accurate

○ Finalizes the authorization form

○ Forwards authorization and state purchase order to district purchasing expert-this should be a coordinated effort between the Counselor & District Purchasing expert

● Counselor and Client sign USOR 53, signing and dating all copies and document paperwork in Aware

● When a bill is received, OS prepares for payment and lists “per State Purchasing” in comments section for Payment in Aware

● Payment along with all written document: bids, State Purchase Order and justification

5. If there is only one source for the procurement item, list the names of other similar vendors contacted, contact person, and a summary of their response.

Compassion Mobility provided the attached quote; United Access provided quote # 85386 (not attached). The Client reviewed both quotes before making their “34 CFR 261.52 and 34 CFR 361.45 Client informed Choice”.
