About this opportunity

The Texas Department of Criminal Justice, Facilities Division is soliciting qualifications and proposals for Step 1 of a Construction Manager-at-Risk (CM@R) engagement to design and construct a Water Treatment Plant at the Memorial Unit in Rosharon, Texas, with proposals due November 23, 2026 and a pre-submittal conference and site visit scheduled for October 21, 2026 at 11:00 AM (registration deadline October 20 at 3:00 PM). This is a two-phase procurement: Step 1 evaluates and selects qualified respondents based on experience and qualifications; Step 2 requires selected respondents to submit CM@R pricing and proposals.

The project scope entails constructing a facility that separates potable from agricultural water systems and designates Brazoria Water Authority (BWA) as the sole source of drinking water for inmate, staff, and residential uses, plus potable water for agricultural operations. The Final Master Plan (20MB) establishes technical and operational framework; bidders must comply with Unit Rules and Regulations (Attachment K) governing water quality management, system operation, maintenance, and safety standards.

The anticipated project timeline spans 26 months: 7 months for pre-construction and design, 19 months for construction. The CM@R structure requires respondents to propose three fee components: a Pre-Construction Management Fee (negotiable not-to-exceed amount), a Construction Management Fee as a percentage of the Cost of Work using a $10,049,000 baseline, and monthly Construction General Conditions covering project management personnel, bonds, insurance, temporary facilities, background checks, health and safety, documentation, transportation, and cleaning.

Contractors must submit a Contractor's Qualification Form (Attachment C) detailing present and completed projects over the past five years with emphasis on comparable municipal, state, and federal construction work; key personnel experience; major equipment; and maximum bonding capacity. A Subcontracting Plan (Attachment D) with good-faith outreach to historically underutilized businesses (HUBs) and minority or women-owned enterprises (MWBEs) is required. All proposals must include a Non-Collusion Affidavit notarized under Texas antitrust laws, an Execution of Submittal certifying compliance with child support obligations, E-Verify participation, suspension and debarment status, and artificial intelligence disclosures. Davis-Bacon Act prevailing wage rates apply to all workers, with rates effective January–May 2026 (e.g., electricians $38.50/hour, pipefitters $42.09/hour). Paid sick leave of one hour per 30 hours worked (up to 56 hours annually) and a minimum wage of $13.65/hour through December 31, 2026 are mandated. All contractor employees must complete background questionnaires addressing criminal history, offender relationships, gang affiliations, and tattoo identification; falsification results in one-year disqualification. Contact Richard Daniel at Richard.Daniel@tdcj.texas.gov or (936) 437-3853, or Amanda Kramer at Amanda.Kramer@tdcj.texas.gov or (936) 437-3848 to register.
