About this opportunity

The State of Utah Division of Purchasing is conducting a Request for Proposal (RFP) for Breath Alcohol Testing Devices and Presumptive Drug Tests, seeking to establish a five-year cooperative contract with multiple potential vendors. The procurement encompasses four specific product categories: Evidential Breath Alcohol Testing (BAT) devices, Portable Breath Alcohol Testing (PBT) devices, Toxicology Drug Tests, and Colorimetric/Surface Drug Tests. Vendors must provide new equipment with comprehensive training, maintenance, and support services, and must comply with specific technical requirements such as adherence to Utah Administrative Rule R714-500 and National Highway Traffic Safety Administration standards. The evaluation process is rigorous, with a total possible score of 1,000 points, consisting of 70% technical criteria (700 points) and 30% cost evaluation (300 points). Vendors must achieve a minimum technical score of 455 points and a total RFP score of 650 points to be considered for award. The RFP was posted on December 6, 2025, with proposals due by December 23, 2025, and all questions must be submitted through the U3P platform during the designated question and answer period.

The contract is available to a wide range of eligible users, including state departments, public entities, institutions, agencies, political subdivisions, nonprofit organizations, and federal agencies. There are no specific set-aside designations or restrictions on respondent types mentioned in the documents. Vendors must guarantee pricing for a minimum of 12 months or provide a percentage discount valid for the contract's lifetime. An administrative fee of 0.25% will be applied to all net purchases under the contract. While specific budget ranges are not explicitly stated, historical spending data indicates annual purchases ranging from approximately $1,500 to $540,000, primarily by the Department of Public Safety and Corrections, with additional purchases from cities, counties, and schools. Contractors must maintain comprehensive insurance coverage, including workers' compensation and commercial general liability, and comply with all applicable federal and state laws. The contract will include provisions for intellectual property protections, confidentiality obligations, and remedies for nonconformance.
