About this file

This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman for use in conjunction with the State of Utah Division of Purchasing's RFP BW26-1 for Breath Alcohol Testing Devices and Presumptive Drug Tests. The form allows vendors submitting proposals to claim confidentiality protection for trade secrets and commercial financial information in accordance with Utah Code 63G-2-305 and 63G-2-309. Vendors must submit both redacted and non-redacted versions of their proposals, as the Division of Purchasing will not perform redactions on behalf of claimants. The confidentiality claim must include a concise statement of reasons supporting the claim and identify specific pages, paragraphs, and the nature of information requiring protection.

The form requires vendors to provide complete claimant information including company name, address, representative contact details, and specify which records submitted are subject to the confidentiality claim. Vendors must document the governmental entity receiving the submission, the reason for the claim, and detailed explanations for each section of their proposal requiring protection. The form includes designated fields for up to four separate confidentiality claims with corresponding page numbers, paragraphs, and specific reasons. Notably, submission of a confidentiality claim does not guarantee protected classification if the government receives a public records request under GRAMA, and vendors are directed to the Utah State Archives ombudsman office and relevant statutory references for additional guidance on the confidentiality claim process.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
