The solicitation number is DOL-MSH-14-R-00004; this solicitation is a request for proposals. This solicitation document and incorporated provisions and clauses are those in effect through FAC 2005-74. This acquisition will be full and open competition; the North American Industry Classification System (NAICS) code is 722310.

This procurement is for a foodservice contractor to operate the existing cafeteria in The Mine Safety and Health Administration (MSHA) Mine Academy facility located at 1301 Airport Road, Beaver, WV 25813; including and Catering Services for special events at the facility.


The contractor shall establish and operate in the food service facilities of MSHA for the purpose of dispensing food; nonalcoholic beverages and such other items as may be authorized by the MSHA Contracting Officer Representative (COR) in accordance with the terms and conditions of a contract award. The general food service facilities are on the ground floor and include a Kitchen, Serving Stations, and Dining Area. The minimum service hours included in the description outlined in the Statement of Work for food service facility. However, if the contractor wants to extend the service schedule to increase financial viability then a request for modifying the hours of days of service shall be submitted to the MSHA COR for approval. All hours may be adjusted by the contractor as necessary to accommodate the requirements of MSHA. Evening and/or service on Saturdays, luncheon meetings, and special functions, may be required periodically by the occupant Operating Administrations. The successful Contractor shall be fully responsible for providing and accomplishing the required services as outlined in this solicitation.


The anticipated contract shall be a combination Fixed Price/Cost Reimbursable contract. The successful contractor is expected to operate based on an Administrative Expenses, Profit and Loss structure based on the contractor maintaining a menu price structure in such a manner so as to result in the contractor realizing a reasonable profit or if incurring a loss, adjustments may be negotiated to permit a reasonable profit.


The Fixed Price/Cost Reimbursable contract shall be for a Two year Base Period of Performance with three (3) one year Option periods. At the end of the Base Year Period of Performance, the Contracting Officer at the recommendation of the Program Office shall notify the contractor in writing of its intent to exercise options as they become due at least 60 days before the current period of performance ends. In no event shall the contract period, as extended, exceed a period of 5 years 6 months from the beginning date of the original contract.

Contractor Use of Mandatory Sources of Supply or Services (Oct 2008)


(a) Certain supplies or services to be provided under this contract for use by the Government are required by law to be obtained from nonprofit agencies participating in the program operated by the Committee for Purchase From People Who Are Blind or Severely Disabled (the Committee) under the Javits-Wagner-O'Day Act (41 U.S.C. 48). Additionally, certain of these supplies are available from the Defense Logistics Agency (DLA), the General Services Administration (GSA), or the Department of Veterans Affairs (VA). The Contractor shall obtain mandatory supplies or services to be provided for Government use under this contract from the specific sources indicated in the contract schedule.


(b) The Contractor shall immediately notify the Contracting Officer if a mandatory source is unable to provide the supplies or services by the time required, or if the quality of supplies or services provided by the mandatory source is unsatisfactory. The Contractor shall not purchase the supplies or services from other sources until the Contracting Officer has notified the Contractor that the Committee or an AbilityOne central nonprofit agency has authorized purchase from other sources.


(c) Price and delivery information for the mandatory supplies is available from the Contracting Officer for the supplies obtained through the DLA/GSA/VA distribution facilities. For mandatory supplies or services that are not available from DLA/GSA/VA, price and delivery information is available from the appropriate central nonprofit agency. FACILITY SITE VISIT


Prospective Offerors are strongly encouraged to participate in and attend an on-site visit or tour of the MSHA Academy Cafeteria facility prior to the submission of their proposal. The requisite site visit shall provide each prospective Offeror an opportunity to familiarize themselves with the physical facility layouts and current food services operations of the Academy Cafeteria and as a vehicle to insure that their proposal maximally addresses the solicitation requirements.  The site visit is scheduled for Wednesday, July 23, 2014 from 7:00 am - 1:00pm.  Questions submitted by July 21, 2014 may be addressed during the site visit.  All questions and answers will be provided as an amendment to this solicitation.  Prospective Offerors wishing to attend site visit shall contact Diane Williams at Williams.Florine@dol.gov at least two days in advance for security clearance processing.
