About this file

This is Amendment 0003 to a federal solicitation (W912WJ26RA007) issued by the U.S. Army Corps of Engineers, New England District (W2SD ENDIST), through the KO Contracting Division in Concord, Massachusetts. The amendment, effective January 26, 2026, provides government responses to six Requests for Information (RFIs) submitted by offerors regarding the Request for Proposals (RFP). The solicitation involves a Multiple Award Task Order Contract (MATOC) for construction services and is designated as a Small Business Set-Aside.

The RFI responses clarify key evaluation and submission requirements. Regarding Buy American clauses, the government confirmed that the applicable clause will be determined by the dollar amount of each individual task order in accordance with FAR Part 25 thresholds in effect at RFP issuance. For past performance submissions, the government will accept experience from offerors who previously participated as joint venture partners, even when submitting as individual offerors, provided they clearly articulate their specific work performed. The government clarified that subcontractor trade designations (rather than names) are sufficient, and that offerors may discretionarily determine what constitutes "specialized design and construction features" to highlight. Additionally, the government will accept Volume 1 proposals in PDF format in addition to native file formats to accommodate formatting issues. Lastly, for joint ventures without entity-level experience, particularly those in Small Business Mentor-Protégé relationships, past performance experience must be submitted for both joint venture partners in accordance with 13 CFR Section 125.8(e).

SUMMARY OF CHANGES

Section 00 00 00 - Procurement and Contracting Requirements

The following changes have been made:

Miscellaneous text in this section has been modified to:

Amendment 0003 RFIs

1. RFP Section 00 72 00 contains Buy American clauses 52.225-9 "Buy American- Construction Materials" and 52.225-11 "Buy American-Construction Materials under Trade Agreements". As this solicitation is a Small Business Set-Aside please advise which Buy American clause will apply to task orders issued under this MATOC contract.

GOVERNMENT RESPONSE: The dollar amount of each task order will determine which clause applies, in accordance with FAR Part 25 thresholds for each that are in effect at the time of RFP issuance.

2. Reference "Evaluation of Offers", paragraph C, 8.0 "Volume I - Factor 1 - Past Performance", this paragraph includes discussion relative to past performance of other entities allowed for use. This paragraph does not discuss the Offeror's use of their past experience from participation in a prior JV in which the Offeror was a JV partner. Will prior JV experience be accepted from an Offeror submitting a proposal as an individual Offeror?

GOVERNMENT RESPONSE: Yes, the Government will accept past performance submissions where an Offeror performed as part of a joint venture, even when they are Such submissions should clearly articulate the work performed and all other elements required in the solicitation by the Offeror as part of the prior joint venture.

3. Reference "Evaluation of Offers", paragraph C, 8.1 "Volume I - Factor 1 - Past Performance", Past Performance Narratives, 5 bullet states to provide: "th Total contract award value and final cost of construction (if Prime) and the value of the work specifically performed by the prime and each relevant team subcontractor involved in the project". Please clarify what is meant by "each relevant team subcontractor".

not offering as joint venture.

- If the Prime contractor did not have a formal teaming agreement with any subcontractors are subcontract values to be listed?

- Are subcontractor names to be listed or is the subcontract trade designation to be listed?

GOVERNMENT RESPONSE: The Government's intent is to evaluate the magnitude of work performed by prime contractors versus subcontractors. Offerors should clearly articulate the value of work performed by subcontractors to allow this analysis by the Government. Subcontractor trade designation is sufficient in the Offeror's proposal.

4. Reference "Evaluation of Offers", paragraph C, 8.1 "Volume I - Factor 1 - Past Performance", Past Performance Narratives, 7 bullet states to provide: "Specialized th design and construction features of the project". Please clarify what is meant by "specialized design and construction features".

GOVERNMENT RESPONSE: The Government's intent is to afford Offerors the opportunity to highlight any design, and construction features they deem noteworthy or worth presenting to the Government. What constitutes a specialized design and construction features is at the Offeror's discretion.

5. The RFP states that all proposal electronic files shall be submitted in their native formats (e.g., .docx, .xlsx, .ppt) and uploaded electronically to the PIEE website. However, it is common when submitting docx files for formatting to change between systems, which can affect the appearance and integrity of Volume I. To ensure the proposal is reviewed exactly as intended, would the Government please consider accepting Volume 1 in PDF formant

GOVERNMENT RESPONSE: The Government will accept PDF formats for Volume 1 submissions to alleviate formatting issues generated during file conversion. Offerors shall still submit native file formats for all files, in addition to the PDF formats being allowed via this RFI response.

6. Per Attachment _C_EVALUATION_OF_OFFERS __ Sections_L_M_, Section 8.1: "If the JV does not have experience, projects shall be submitted for each JV partner." Per the Small Business Association, for JV members under a Mentor/Protege relationship, experience for either JV member counts as experience for the Small Business JV. Under this stipulation, please confirm that experience from both JV members is not required.

GOVERNMENT RESPONSE: Per the Code of Federal Regulations, 13 CFR (S) 125.8 (e), when evaluating a joint venture, the government must consider work done and qualifications held individually by each partner to the joint venture. In accordance with this regulation and the solicitation's terms, past performance experience must be submitted for both firms in the joint venture if the JV entity does not have experience.
