SUMMARY OF CHANGES

SECTION 00010 - SOLICITATION CONTRACT FORM

The required response date/time has changed from 10-Jun-2020 02:00 PM to 15-Jun-2020 02:00 PM.

The following have been added by full text:

RFI - AMENDMENT 0005

Question 1: May key personnel not currently employed by the offerors be proposed to satisfy key personnel, provided a letter of intent is included?

ANSWER As stated in the solicitation: All Key Personnel must be employed directly by the Offerors. After contract award any substitution of key personnel shall be submitted to the Contracting Officer for concurrence.

Question 2: Are the SSHO and CQC required at the contract level or at the task order level? (i.e.. will the SSHO and CQC be permitted to oversee multiple projects at one time provided they can provide adequate oversight to all?)

ANSWER As stated in the solicitation: The [contract level] Key Personnel are the Project Manager, Site Superintendent, Contractor Quality Control Manager and Site Safety and Health Officer. Multiple key personnel may be proposed for each function to maintain sufficient staff to respond flexibly to task orders.

After contract award any substitution of key personnel shall be submitted to the Contracting Officer for concurrence.

Question 3: Will every task order require a separate dedicated Superintendent, SSHO, and CQC, or may a single team member serve in multiple functions upon approval of the Government?

ANSWER As stated in the solicitation: Personnel provided on a task order basis under awarded contracts must be consistent with key personnel proposed unless otherwise approved by the Contracting Officer.

During contract execution and for the Sample Task Order, the Contractor’s Key Personnel shall not be used for multiple roles without prior USACE approval. Multiple key personnel may be proposed for each function to maintain sufficient staff to respond flexibly to task orders. After contract award any substitution of key personnel shall be submitted to the Contracting Officer for concurrence.

Question 4: Technical Proposal Requirement, Section C,Management Approach, section C asks that the offered do the following; include any relationships with organizations qualified for work within the scope of this solicitation including the number of projects that you have completed together or partnering; a sufficient number of subcontractors should be proposed to demonstrate experience in the entire breadth of work defined in the scope of work. With the work spanning several states we want to clarify if you are asking for ‘teaming partners’ and ‘subcontractors’ for the ‘fake/unawarded SEED Task Order’ or if you are generally asking for ‘teaming partners’ and ‘subcontractors’ throughout all the states where this MATOC is located.

Will small business companies that perform GC/Prime work without ‘teaming partners’ and 'on their own merit' be considered more favorably due to their control of their own financial and human capital without the reliance on other more established firms?

ANSWER: Management Approach, section C is concerned with established relationships and contracting approach for the whole contract. Offerors will be evaluated according to the terms of the solicitation and may be more highly rated if they demonstrate an ability to handle the Contract without significant reliance on teaming partners.

Question 5: The price proposal breakdown for this project asks for ‘all breakdown of all labor, material, equipment, sub-bids and indirect costs, including mark-ups, of each sub task of the sample task order’. With this ‘sample task order bid’ with a $5-10MM and it being unawardable, is USACE expecting for us to have subcontractors price this task order during the COVID crisis? Is it possible for the offerors to execute the pricing through bid software and market knowledge to include equipment, labor, material rates tied to the task order location without requesting the immediate mark place to hard bid? We are trying to ease the burden of subcontractors providing large estimates on a sizable $5-10M unawardable contract.

ANSWER The Sample Task Order, which will not be awarded, is generally representative of Task Orders that will be solicited and awarded in the future. It is important Offerors propose on this sample task order as they would on future task orders. Offerors need to provide proposals that include actual, not estimated, subcontracted prices.

Question 6: On page 28 of the solicitation, under 52.215-1 Instructions to Offerors— Competitive Acquisition (JAN 2017), requirements are listed that conflict with the requirements included in Section 00100

– Bidding Schedule/Instructions to Bidders. Please advise, do the instructions in Section 00100 take precedence?

ANSWER The Government could not identify a conflict between W912WJ20R0005, Section 00100 and Clause 52.215-1. Electronic submission of documents is required by this solicitation.

Question 7: In reviewing the spec for Div. 2, it does not appear to be any Lead or Asbestos Reports. Do they exist given the amount of instructions pertaining to these items? Roofing is included as an item in the asbestos section but no asbestos roofing is shown to be removed.

Please clarify.

ANSWER The only hazardous material report currently available is the previously provided Asbestos Report (Amendment 0004). No other documentation on the presence or absence of hazardous materials is available.

Question 8: Is the crawl space shown on MD-100 considered a permitted confine space?

ANSWER Yes

Question 9: What is the overall height of the crawl spaces?

ANSWER Lowest height is 36". See DWG A-301

Question 10: What is the general condition of the crawl spaces?

ANSWER: The offeror should assume the crawl space is in suitable condition to access.

Question 11: Please differentiate which CLiN accounts are applicable for the building exterior insulation and roof insulation as it appears in both CLiN 0001 and CLiN 0005/CLiN 0006.

ANSWER Base Bid Items, Item Number 0001, "System and Energy Improvements": This item includes insulation to be added to Roof (Attic) to achieve an R-38 value and insulation (Spray Foam) to be added to exterior walls to achieve R21 Value. No work shall be carried under Optional Bid Items, Item Number 0005, "Roof Insulation (Option 0002)" or Optional Bid Items, Item Number 0006, "Insulated Exterior Walls (Option 0003)". Please see " WBS format for Sample Task Order_rev 5-28-2020"

Question 12: Please confirm the cost of asbestos abatement identified in Table 1 is accounted for in CLiN 002 Building Repair as it is NOT identified in the Measurement & Payment section under any of the Clines.

ANSWER Include asbestos abatement items in CLIN 0002 "Building Repairs and Improvements."

ANSWER The table cannot be provided, please disregard this reference.

Question 14: Section 02 83 13, Page 15 refers to an Attachment: Hazardous Materials Report (see below).

This attachment does not appear to be included in the document. Please provide.

ANSWER Please see Amendment 0004, Question 49.
