About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the use of Johnson Controls HVAC Control Software and associated equipment in a firm fixed price construction contract for the Renovate Materials Analysis Lab F/20071 project at Wright-Patterson Air Force Base (WPAFB) in Ohio.
The J&A explains that the Johnson Controls HVAC control system is required to integrate with the existing base-wide Energy Management Control System (EMCS) at WPAFB, which uses proprietary Johnson Controls software. No other manufacturer's products can interface with the existing EMCS without significant additional cost. The project will be funded with FY24 Research, Development, Test and Evaluation (RDT&E) funding. A Notice of Intent to Sole Source will be posted on October 21, 2024, and the contract will be awarded via a Design/Bid/Build solicitation.

JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Agency: U.S. Army Corps of Engineers (USACE), Louisville District, Post Office Box 59, Louisville, Kentucky 40201-0059.
2. Description of Action: This justification and approval (J&A) is being prepared for the use of a brand name, Johnson Controls HVAC Control Software and associated equipment, in the firm fixed price construction contract for Renovate Materials Analysis Lab F/20071 project at Wright-Patterson Air Force Base (WPAFB), Ohio. The government will not purchase the HVAC Control Software and equipment directly, but rather brand name specifications will be included in the design bid build solicitation that will lead to a new firm fixed price (FFP) construction contract. The construction contract will be funded by the Air Force using FY24 Research, Development, Test and Evaluation (RDT&E) funding.
3. Description of Supplies/Services: The HVAC controls and monitoring system selected for use at WPAFB will be manufactured by Johnson Controls. The salient characteristics of the software and equipment will be included in the Design Bid Build Solicitation. Johnson Controls have offices and authorized sellers around the world and in the WPAFB region. The estimated total cost for the equipment is approximately
4. Authority Cited: The statutory authority permitting sole sourcing for this acquisition is 10
United States Code 3204(a)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2), “Only one responsible source and no other supplies or services will satisfy agency requirements.” The authority is applicable to brand name justifications in accordance with FAR 6.302-1(c)(1).
5. Reason for Authority Cited: As described in FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source and no other types of supplies or services will satisfy the agency requirements, full and open competition need not be provided for.
a) Background: The F/20071 at WPAFB is a renovation project that will connect to existing facilities. This project will be designed to tie-in to existing building systems so that there is only one (1) HVAC control system serving the entire facility. The Renovate Materials Analysis Lab F/20071 Project at Wright- Patterson Air Force Base (WPAFB) includes utilizing existing DDC controls. Work includes HVAC optimization to balance air flows, and modifications to structural supports as necessary.
b) Justification: WPAFB CE shop currently monitors their HVAC systems Base-wide with an Energy Management Control System (EMCS). The current configuration of that system is for F/20071 is limited to Johnson Controls (BACnet) supervisory and control system. The EMCS controls the operations of HVAC equipment throughout the Base.
The Base’s Installation Facility Standard dictates that any new Direct Digital Controls (DDC) must provide 100% interface with facility and the Talon Controls system without the use of third-party interface hardware/software. Due to the proprietary nature of the EMCS, no other manufacturer’s products can connect to and function with the existing control system. If a Johnson Controls system is not installed, this facility will not satisfy the user’s requirement to be integrated with the base-wide system. The installation would

either have to monitor via two different programs or replace the entire system at significant cost.
c) Impact: If equipment other than the specified Johnson Controls DDC equipment is installed in this facility it will prevent the facility from connecting to the base-wide monitoring system. The facility would have to be monitored separately from the rest of WPAFB, which would require the establishment of a separate service contract at a significant cost to the government.
d) Alternatives: None viable to achieve a fully functioning system for the reasons noted above in paragraph 5. b) and c).
6. Efforts to Obtain Competition: Technical capabilities of various manufacturers were reviewed for compatibility to the current system. None of the various manufacturers’ equipment would ensure compatibility with the existing system which currently utilizes Johnson Controls HVAC Control Software.
7. Actions to Increase Competition: Apart from the complete replacement of the current system in its entirety, competition will be limited. This is a finite requirement with no future needs, and therefore there are no actions to increase future competition.
8. Market Research: A technical review and evaluation was conducted of the system requirements for the building 20071 Renovation project. As discussed above in paragraph 6 above, only Johnson Controls HVAC Control Software will ensure compatibility with the existing systems.
A Notice of Intent to Sole Source will be posted on 21 October 2024. To date, no other sources have written to express interest. If prior to issuance of the solicitation, responses are received expressing interest, the justification will be amended.
9. Interested Sources: A Notice of Intent to Sole Source will be on 21 October 2024 To date, no other sources have written to express interest. If prior to issuance of the solicitation, responses are received expressing interest, the justification will be amended.
10. Other Factors: None
11. Technical Certification: I certify that the supporting data under my cognizance, which are included in the Justification and Approval, are accurate and complete to the best of my knowledge and belief.
