About this file
This justification document outlines the use of a brand name item for the Joint Operations and Mission Planning Center project at Scott Air Force Base. The project involves construction of a new two-level facility totaling approximately 171,802 square feet to relocate personnel from substandard buildings. The HVAC controls and monitoring system selected is manufactured by Johnson Controls, as their proprietary software is compatible with and integrated into the base-wide system currently used across Scott Air Force Base. Using any other manufacturer's equipment would prevent the new facility from connecting to the existing monitoring system and require establishing a separate service contract. A Notice of Intent to Sole Source was posted on September 9, 2020, and no other sources have expressed interest to date. The construction contract will be awarded through full and open competition using FY21 Air Force MILCON funds.

JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Agency: U.S. Army Corps of Engineers (USACE), Louisville District, Post Office Box 59, Louisville, Kentucky 40201-0059.
2. Description of Action: This justification and approval (J&A) is being prepared for the use of a brand name item, Johnson Controls HVAC Control Software and associated equipment, in the firm fixed price construction contract for the Joint Operations and Mission Planning Center (JOMPC) project at Scott Air Force Base, Illinois. The government will not purchase the HVAC Control Software and equipment directly, but rather brand name specifications will be included in the design bid build solicitation that will lead to a new firm fixed price (FFP) construction contract. The construction contract is planned to be awarded under a full and open solicitation, using FY21 AF MILCON funding.
3. Description of Supplies/Services: The HVAC controls and monitoring system selected for use on the JOMPC project at Scott Air Force Base, Illinois is manufactured by Johnson Controls. The Johnson Controls Brand Name Proprietary Specifications will be included in the Design Bid Build Solicitation. Johnson Controls has offices and authorized sellers around the world and in the Scott AFB region. The estimated total cost for the equipment is approximately XXXXXX.
4. Authority Cited: 10 United States Code (U.S.C.) 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2) “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” This authority is applicable to brand name justifications in accordance with FAR 6.302-1(c)(1).
5. Reason for Authority Cited:
a) Background: The JOMPC project at Scott Air Force Base is a new construction project utilizing economical design and construction methods. The preliminary building concept design consists of a two-level structure built above grade that is primarily symmetrical and rectilinear in nature with a steel superstructure, reinforced concrete foundation walls and footings, insulated and reinforced concrete exterior walls with embedded thin brick masonry façade and an insulated standing seam metal roof. The project includes classified storage, communications infrastructure, air conditioning, space for uninterruptable power systems, emergency backup power generator, intrusion detection, fire detection / suppression, utilities, area lighting, general site improvements, pavement and all other required supporting facilities to result in a complete and usable facility. The building footprint is approximately 171,802 square feet. This facility will relocate personnel currently working in several substandard or failing facilities throughout the installation.
b) Justification: Scott Air Force Base, currently monitors their HVAC systems with Johnson Controls DDC equipment. The DDC controls are proprietary to Johnson Controls and the base maintains a service contract through Johnson Controls for the purposes of operating the base-wide system. This integration requires a compatible system to be installed and the Johnson Controls system is the only compatible component. If Johnson Controls system is not installed, this facility will not satisfy the user’s requirement to be integrated with the base-wide system. The installation would either have to monitor via two different programs or replace the entire system at significant cost.
c) Impact: If equipment other than the specified Johnson Controls DDC equipment is installed in this facility it will prevent the facility from connecting to the base-wide monitoring system. The facility would have to be monitored separately from the rest of Scott Air Force Base, which would require the establishment of a separate service contract at a significant cost to the government.
d) Alternatives: None viable to achieve a fully functioning system for the reasons noted above in paragraph 5. b) and c).
6. Efforts to Obtain Competition: Technical capabilities of various manufacturers were reviewed for compatibility to the current system. None of the various manufacturers’ equipment would ensure compatibility with the existing system which currently utilizes Johnson Controls HVAC Control Software exclusively.
A Notice of Intent to Sole Source was posted on 09 September 2020. To date, no other sources have written to express interest. If prior to issuance of the solicitation, responses are received expressing interest, the justification will be amended.
7. Actions to Increase Competition: Apart from the complete replacement of the current system in its entirety, competition will be limited. This is a finite requirement with no future needs, and therefore there are no actions to increase future competition.
8. Market Research: A technical review and evaluation was conducted of the system requirements for the JOMPC project. As discussed above in paragraph 6 above, only Johnson Controls HVAC Control Software will ensure compatibility with the existing systems.
A Notice of Intent to Sole Source was posted on 09 September 2020. To date, no other sources have written to express interest. If prior to issuance of the solicitation, responses are received expressing interest, the justification will be amended.
9. Interested Sources: A Notice of Intent to Sole Source was posted on 09 September 2020. To date, no other sources have written to express interest. If prior to issuance of the solicitation, responses are received expressing interest, the justification will be amended.
10. Other Factors: None
