About this file

This document is a justification and approval for using a brand name item without full and open competition for a construction contract. The U.S. Army Corps of Engineers Louisville District plans to award a firm fixed price construction contract using FY21 Air Force funding to build the Joint Operations and Mission Planning Center at Scott Air Force Base in Illinois. The contract will require use of Monaco Enterprises Incorporated proprietary fire monitoring system equipment and software currently utilized basewide at Scott AFB. No other systems are fully compatible with both the technical specifications and necessary software requirements to integrate with the existing system. Using another brand would delay emergency response and require additional training and service contracting costs. A notice of intent to sole source was posted on September 9, 2020 with no other sources expressing interest yet. The solicitation number for the construction contract is W912QR20R0004.

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: U.S. Army Corps of Engineers (USACE), Louisville District, Post Office Box 59, Louisville, Kentucky 40201-0059.

2. Description of Action: This justification and approval (J&A) is being prepared for the use of a brand name item, Monaco Enterprises Incorporated (MEI) fire monitoring system, in the firm fixed price construction contract for the Joint Operations and Mission Planning Center (JOMPC) at Scott Air Force Base, Illinois. The government will not purchase the fire monitoring system equipment directly, but rather brand name specifications will be included in the design bid build solicitation that will lead to a new firm fixed price (FFP) construction contract. The construction contract is planned to be awarded under a full and open solicitation, using FY21 Air Force MILCON funding.

3. Description of Supplies/Services: The fire monitoring products selected for use on the JOMPC project at Scott Air Force Base, Illinois are produced by MEI. The estimated total cost for the equipment is approximately XXXXXX.

4. Authority Cited: 10 United States Code (U.S.C.) 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2) “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” This authority is applicable to brand name justifications in accordance with FAR 6.302-1(c)(1).

5. Reason for Authority Cited:

a) Background: The JOMPC project at Scott Air Force Base is a new construction project utilizing economical design and construction methods. The preliminary building concept design consists of a two-level structure built above grade that is primarily symmetrical and rectilinear in nature with a steel superstructure, reinforced concrete foundation walls and footings, insulated and reinforced concrete exterior walls with embedded thin brick masonry façade and an insulated standing seam metal roof. The project includes classified storage, communications infrastructure, air conditioning, space for uninterruptable power systems, emergency backup power generator, intrusion detection, fire detection / suppression, utilities, area lighting, general site improvements, pavement and all other required supporting facilities to result in a complete and usable facility. The building footprint is approximately 171,802 square feet. This facility will relocate personnel currently working in several substandard or failing facilities throughout the installation.

b) Justification: MEI is the original manufacturer and service provider for the Fire, Security, and Life Safety Equipment and services currently in use at Scott AFB. These systems are primarily comprised of proprietary software developed by MEI and MEI licensed vendors, which is then licensed directly to our end users. MEI retains exclusive ownership of the software and does not authorize third parties to alter or add to MEI software or equipment.

Utilizing Monaco systems, which is primarily comprised of proprietary software developed by MEI and MEI licensed vendors as noted above, is necessary to maintain integrity with our base-wide fire alarm system. The equipment installed must be compatible with the existing Monaco D-21 system at Scott AFB. Currently, no other system is known to be fully compatible with both the technical specifications and the necessary software requirements.

c) Impact: In order for the JOMPC to connect with the existing Fire, Security, and Life Safety system at Scott AFB, the JOMPC system must be compatible with the equipment used on the rest of the base. Failure to establish adequate compatibility will result in delayed emergency response times. Additionally, Scott AFB utilizes a base-wide maintenance contract to maintain these systems and installing a new system would require additional training and the establishment of another service contract at a significant cost to the government.

d) Alternatives: None viable to achieve a fully functioning system for the reasons noted above in paragraph 5. b) and c).

6. Efforts to Obtain Competition: Technical capabilities of various manufacturers were reviewed for compatibility to the current system. None of the various manufacturers’ equipment are compatible with the existing system which currently utilizes Monaco Enterprises Incorporated (MEI) fire monitoring system equipment/software exclusively.

A Notice of Intent to Sole Source was posted on the beta.sam.gov website on 09 September 2020. To date, no other sources have written to express interest. If prior to issuance of the solicitation, responses are received expressing interest, the justification will be amended.

7. Actions to Increase Competition: Apart from the complete replacement of the current system in its entirety, competition will be limited. This is a finite requirement with no future needs, and therefore there are no actions to increase future competition.

8. Market Research: A technical review and evaluation was conducted of the system requirements for the JOMPC project. As discussed above, in paragraph 6, only Monaco Enterprises Incorporated (MEI) fire monitoring system equipment/software will ensure seamless compatibility with the existing system.
