About this file

This document contains a justification for using other than full and open competition to procure ten Syntech Fuelmaster fuel systems for the Brown Field Border Patrol Station project. The U.S. Army Corps of Engineers will issue a competitive request for proposal for the construction of the station, with an estimated value between $25-100 million. The project includes detention facilities for 130 detainees and support structures. The justification cites the need for compatibility with other stations' fuel management systems already using Syntech Fuelmaster, to prevent certification issues and ensure readiness. Market research found no alternative fully compatible systems. The procurement will follow all applicable laws and regulations.

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: The contracting agency responsible for this procurement action is the U.S. Army

Corps of Engineers, South Pacific Division, Los Angeles District (CESPL), Los Angeles, CA.

2. Description of Action:

a. Syntech Fuelmaster, Syntec FM Live ( Fueling System for Border Patrol Vehicles )

A new competitive firm fixed price request for proposal (RFP) Design Bid Build construction contract which includes “brand name only” products consisting of ten (10) new Syntech Fuelmaster, Syntec FM Live brand name only components that will be awarded using Department of Homeland Security (DHS) Customs and Border Protection (CBP) funding.

3. Description of the Supplies/Services: The new competitive firm fixed price RFP design bid build construction project, Brown Field Border Patrol Station, Dulzura, San Diego County, CA, includes the following “Brand Name" component(s) below:

a. Syntech Fuelmaster, Syntec FM Live

The Syntech Fuelmaster, Syntec FM Live fuel system is required by the CBP for their ground vehicle fuel management system (hardware and software) for automated fuel management and inventory control. The requirements include installing ten (10) new Syntech Fuelmaster, Syntec FM Live brand name only components that will be awarded to be compatible with the other San Diego Sector Border Patrol Stations. The current estimated material cost of the brand name components listed above is approximately $15,000.

The unit prices for the materials being purchased under this contract are part of the software data base contained in the Micro-Computer Aided Cost Estimating System (MCACES). The individual unit costs contained in the MCACES data base for these materials are from a vendor or supplier market survey conducted by the contractor that developed MCACES software.

4. Authority Cited: 10 U.S.C. 2304(c)(1) and FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited:

a. Syntech Fuelmaster, Syntec FM Live

All Border Patrol vehicles are equipped with sensors that only work with the Syntech Fuelmaster, Syntec FM Live fueling system. The installed equipment on this project must be compatible to all other San Diego Sector Border Patrol Stations fuel management and inventory control systems.

Having the specified manufacturer will eliminate the problems in the field, prevent certification failure and assure mission readiness. The use of, maintenance of, repair of and training required for use these brand name specific systems is so that a border patrol agent from one station will be able to readily use any of the other border patrol stations facilities within the San Diego Sector so it is necessary to keep the systems the same for all the Border Patrol Agents of the San Diego Sector for familiarity purposes. With multiple brand names, the end user would need to be trained on how to use each of the different systems that serve the same purpose.

The CBP spare parts inventory will remain manageable with all systems of the same brand name.

Also, without use of these specific brand name items, for every different system specified, a different operation and maintenance manual is required including trouble shooting each of the different systems as well as the training required on proper operation of the various systems; the result is extra costs for the purchase of each different system. Using the Syntech Fuelmaster, Syntec FM Live fueling system will alleviate compatibility issues caused by using different or multiple brand name systems and this will result in a fully functioning station compatible with the other stations in the San Diego Sector Customs and Border Protection to meet mission requirements. Having the same name brand on the fueling systems would be the most cost effective.

6. Efforts to Obtain Competition: The Solicitation being issued will be an un-restricted competitive RFP.

The brand name components represent a small portion of the overall construction project that is being competed. The current working estimate for the competitive construction contract is

Use of alternative products and systems would be counterproductive in that they are not fully compatible with the base standards, and would increase future cost of maintenance, use of energy, training and human labor hours, offsetting any savings gained by use of such control system.

7. Actions to Increase Competition: See Paragraph 6 above.

8. Market Research: There are no known alternative systems that are fully compatible with these systems based on lessons learned and expert judgment by subject matter experts and experience of the Customs Border Protection (CBP).

9. Interested Sources: Notice of Intent that was not required.
