8. PROPOSAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS

a. REQUIREMENT FOR SEPARATE TECHNICAL AND PRICE PROPOSALS.

DO NOT MIX CONTENTS OF VOLUME 1 (Technical) AND VOLUME 2 (Cost/Price) IN THE SAME

BINDER.

(1) Each offeror must submit a Technical Proposal and a Price Proposal. The Technical Proposal and the Price Proposal must be submitted as separate volumes. Both the Technical and Price Proposal shall be paginated (contain consecutive page numbers on each page).

(2) The outside cover of each separate volume (Vol 1 – Technical; Vol 2 – Price) must be clearly marked to indicate its contents and the identity of the Offeror. Additionally, identify the “original” Technical proposal and the “original” Cost/Price proposal on the outside cover.

(3) Both the Technical Proposal and the Price Proposal must be received by the closing date and time set for receipt of proposals.

(4) Pricing Schedule, Vol 2, shall be completed in full.

(5) Do not include any dollar amounts in the Technical Proposal that are taken from the Price Proposal.

(6) All information intended to be evaluated as part of the Technical Proposal must be submitted within the Technical Proposal. Do not cross-reference material in the Price Proposal, or vice versa. Also, do not include links to websites in your proposal. Technical Proposals will not be provided to the price team and Price Proposals will not be provided to the technical team. Therefore, information submitted in the wrong Volume could lead to the proposal being determined “unacceptable” if materially incomplete in any aspect.

(7) Do not attempt to modify the terms and conditions of the solicitation in either the technical or price proposal or add conditions or qualifications to your offer. Should the offeror include terms and conditions that conflict with the terms and conditions of the Solicitation, the offer may be determined "unacceptable" and thus ineligible for award. Any questions related to specific terms and conditions contained within the Solicitation should be resolved prior to submission of the offer. Notwithstanding the above, the offeror must clearly describe on the Proposal Cover Sheet submitted with the Price Proposal any modifications to the contractual and/or technical terms and conditions of the solicitation contained in the Offer.

(8) Failure to submit required documents or failure to properly complete documents may result in rejection of the offer without further evaluation. Therefore, offerors are urged to follow instructions carefully and to speak with the Contracting Officer if the offeror does not understand any part of the Solicitation.

b. DISCUSSIONS.

The Government intends to evaluate proposals and award a contract without discussions. However, the Government reserves the right to hold discussions if it determines that discussions are necessary. Therefore, proposals should be submitted on the most favorable terms that the offeror can submit to the Government.

c. GENERAL INSTRUCTIONS.

(1) Submit only the documents specifically required in this section. Do not submit excess information; do not include audio-visual materials, electronic media, etc.

(2) Use only 8 ½ by 11 inch paper or A4 paper for hard copy submissions, unless another paper size is specifically authorized elsewhere in this section for a particular submission. Do not use fold-outs (e.g., 11” x 14”) . Do not use a font size smaller than Arial or Times New Roman, 12, or an unusual font style such as script, or condensed print for any submission. All page margins must be at least one inch wide, but may include headers and footers. All pages must be numbered.

(3) The preferred method for assembling your proposal is to use three-ring binders; however, the use of pressboard or other report covers with compression or other type fasteners is acceptable. Do not use spring clamps or exceed the recommended capacity of the fastener or binder. Do not use plastic multi-hole/spiral binding systems, heat binding systems, or other systems which do not facilitate the ready insertion of additional pages. Do not include loose papers.

(4) References to “Confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can be provided to the Government as part of the offeror’s technical proposal. Offerors that include in their proposals information they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, must clearly mark their proposals in accordance with the instructions at FAR 52.215-1, “Instructions to Offerors— Competitive Acquisition,” paragraph (e), Restriction on disclosure and use of “data .”

(5) In the case of an offeror that is part of a large, multi-segmented business concern, provide information directly pertaining to the specific segment of the business concern (i.e., the division, group, unit, etc.) that will perform work under the prospective contract.

(6) For submissions with page limitations, the pages will be counted as follows: One side of the paper is one page; information on both the back and front of one sheet of paper will be counted as two pages. 15. PROPOSAL FORMAT – VOLUME 2

TAB 1 – FACTOR 4: COST/PRICE

5. VOLUME II – COST/PRICE

a. General

This volume shall consist of all information, required to support proposed costs and prices. Certified cost and pricing data are not currently required; however, the Government reserves the right to request such data prior to award.. There are no page limitations for this volume. The Offeror shall ensure that the information submitted in this volume is consistent with and fully supports the amounts set forth in the SF33 and continuation sheets.

i. Estimated phase-in costs shall be included separately in the Offerors cost proposal.

ii. The specific direct labor rates utilized to price the proposal must be identified in the cost proposal only. The proposal shall set forth a complete breakdown of the direct and indirect rates by category as directed on the bid sheet.

iii. For evaluation purposes only and in determining probable cost for options in the out-years, wage determination rates shall be determined and included by the Offeror. However, if the Offeror substantiates higher wage rates and justifies different escalation factors, those wage/escalation factors may be utilized. Direct labor rates shall identify the baseline for base year plus projected escalation for each option period. Computing composite labor rates shall be shown as well as the fiscal year in question. Offerors are advised that projected escalation must be applied to both exempt and non- exempt labor categories.

iv. Direct labor hours and rates shall be delineated by labor category by contract year for the Offeror and each subcontractor. The labor hour delineation must be directly traceable to the same information proposed in the Technical Volume.

v. Pursuant to the Service Contract Labor Standard, the determination by the Secretary of Labor as to the applicable minimum monetary wage and fringe benefits will be made part of any resulting contract. For evaluation purposes only, the Government has incorporated the applicable Area Wage Determinations. However, Davis Bacon Wage Determinations will also be incorporated to cover the construction labor crafts involved. The Offeror shall provide a crosswalk of the proposed labor categories against the Area Wage Determinations.

vi. The Offeror shall provide information regarding its cognizant DCAA office, to include point of contact, telephone number and email address. Cost reimbursable task orders will be awarded as a result of this contract. The successful contractor will be required to have a Defense Contract Audit Agency (DCAA) audit. The auditor initiates an audit when the Procuring Contracting Officer (PCO) or the Administrative Contracting Officer (ACO) submits a request to the cognizant DCAA office. The auditor will identify the type of data required of the contractor and review the proposal package for adequacy. DCAA will then contact a company representative and coordinate with the contractor to obtain a walk- through of the proposal to gain an understanding of the basis of the proposal and related supporting documentation. As a result of the DCAA audit, the contractor will have an approved accounting system. This system is required for a contractor to participate in a Federal Government cost reimbursable task order. The offeror shall provide a current audit/report/findings/letter and point of contact with phone number or email address from the offeror's Federal Government Cognizant Audit Agency or any commercially recognized auditing or accounting firm stating that the offeror's accounting system is adequate for cost reimbursable contracts, if available. If it has been over 12 months since the accounting system has been designated as adequate, the offeror shall also provide a statement that the accounting system has not changed since being approved. If the offeror cannot provide an audit/report/letter from a Federal Government Cognizant Audit Agency or any commercially recognized auditing or accounting firm stating that the offeror's accounting system is adequate, or if any aspect of the offeror's accounting system has changed since the system was determined adequate, notify Reid Drewes via email at reid.a.drewes@usace.army.mil as soon as possible (prior to proposal submission) to request a DCAA Accounting System Review. Submit a copy of the email request with your proposal. Award will not be made (Except for the Small Business Reserve) without an audit/report/letter from a Federal Government Cognizant Audit Agency or any commercially recognized auditing or accounting firm stating that the offeror's accounting system is adequate.

b. Section 1 – Fully Burden Labor Rates (Attachment 1) The Offeror shall submit the Fully Burden Labor rates pricing schedule in the proposal. The Labor rate pricing schedule lists professional discipline that could be envisioned being used for the project task order process under the SATOC.

Offerors will submit loaded labor rates for each of these disciplines. The loaded rates will include basic labor rate, payroll burden and fringes. The contractor will be requested to provide these loaded labor rates for the entire contract period.

The Government will review the rates proposed for reasonableness. These labor rates will become binding under the awarded contract and will be used by the contractor in the development of price proposals for individual task orders. The solicitation will advise Offerors that these rates will be binding, with the stipulation that contractors may offer lower than the binding rates within task order proposals, if they so desire.

c. Section 2 – Sample Project (Attachment 1)

All Offerors shall submit labor rates, materials, and other direct costs, labor overhead, general and administrative overhead and any other costs based on the sample of work provided in attachment 2. The sample project will be based upon radiological remediation operations at both the NORCO and SLDS St. Louis FUSRAP Sites that represents the type of work contemplated for the SATOC. For this exercise, the Offerors will be utilizing the proposed labor rates from their proposed bid schedule, referenced above, for home office and field office personnel. Labor rates, materials, other direct costs, labor overhead, general and administrative overhead and any other costs that may be associated with this project will be compared to the Independent Government Estimate (IGE) and evaluated to determine cost realism, reasonableness and distribution of costs relative to the work to be performed as outlined in the sample project. The Government may revise Offeror’s proposed costs, per the FAR, in order to determine a most probable cost to the Government.

SECTION M - EVALUATION FACTORS FOR AWARD

SECTION M

SECTION M

1. ELIGIBILITY FOR CONTRACT AWARD

In accordance with the FAR, no contract shall be entered into unless the Contracting Officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the contracting officer makes an affirmative determination of responsibility. To be determined responsible, a prospective Contractor must meet the general standards in FAR Part 9 and any special standards set forth in the solicitation.

2. BASIS FOR AWARD

The award will be made on the best overall (i.e. best value) proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the FOUR (4) evaluation factors:

Evaluation of the Price Proposals: Price will be evaluated and considered but will not be combined with other aspects of the proposal evaluation. The Government may conduct a price reasonableness analysis; using any combination of techniques outlined in FAR 15.404-1. During the process offerors may have to provide additional information supporting their Contract Line Item Number (CLIN), element, or total price. If it is determined that an offeror purposely submitted unbalanced pricing they will no longer be considered for award.

4. EVALUATION OF THE TECHNICAL PROPOSALS

Technical Rating Evaluation Processes. The technical rating reflects the degree to which the proposed approach meets or does not meet the minimum performance or capability requirements through an assessment of the strengths, weaknesses, deficiencies, and risks of a proposal.

Definition of Tradeoff Ratings. The combined technical/risk rating includes consideration of risk in conjunction with the strengths, weaknesses, and deficiencies in determining technical ratings. Combined technical/risk evaluations shall utilize the combined technical/risk ratings listed in Table 1 (on page 102.).

Adequacy of Response. The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the RFP.

a. Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The proposal will be evaluated to determine the extent to which successful performance is contingent upon proven devices and techniques. The proposal will be evaluated to determine the extent to which the offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.

FACTOR 1 – TECHNICAL CAPABILITIES

Technical Capabilities: The Offeror shall present technical approach to the components identified in the SOW. The Offeror must demonstrate the capability to perform environmental compliance and remediation services relating to FUSRAP and HTRW or similar work with radioactive contamination. The Technical Capabilities factor is further divided into the following subfactors:

Subfactor (1A) – Field Engineering: The government will evaluate the offerors capability and viability for successful execution of this project given the offerors technical capabilities presented for this subfactor specifically in the areas of performing environmental investigations, remedial design of work plans, capability to successfully execute subsurface borings, GIS and documents relating to FUSRAP and HTRW or similar work.

Subfactor (2A) – Remediation Work: The government will evaluate the offerors capability and viability for successful execution of this project given the offerors technical capabilities presented for this subfactor specifically in the areas of performing construction remedial action operations including deep excavation, backfilling, site restoration, decontamination as well as waste management and water control as it relates to the FUSRAP and HTRW or similar work.

Subfactor 1 Field Engineering is of equal importance to Subfactor 2 Remedial Work.

Evaluation of the Offeror’s proposal shall address each sub factor as it applies to the SOW. During evaluations of each proposal, the Government will assign each sub factor an adjectival rating and write a narrative evaluation reflecting the identified findings. If a sub factor is unacceptable the whole factor is unacceptable.

The Technical Factor Ratings, excerpted below focus on the strengths, deficiencies, weaknesses, risks and uncertainties of the Offeror's proposal. The color rating depicts how well the Offeror’s proposal meets the Technical sub factor requirements.

FACTOR 2 – MANAGEMENT APPROACH is divided into the following subfactors:

Subfactor (1B) – Technical Staff Approach: The Offeror shall discuss the availability, competence and professional qualifications of construction, engineering and other technical abilities of key personnel with at least five years of experience related to environmental response actions associated with investigation, design, removal, and construction activities involving sites contaminated with radiological waste. Emphasis should be placed on personnel experience related to this type of remedial work.

The Offeror shall provide information on his management organization (including subcontractors) and staff. Offerors shall provide a narrative of how the effort required by the RFP will be assigned for performance within the Offeror’s corporate entity and among the proposed subcontractors. The information provided for the prime Offeror and each proposed major subcontractor must include the entire company name, company address, CAGE Code, DUNS Number and type of work to be performed by citing the applicable Government SOW subparagraph number. The proposal should provide a diagrammed organizational chart showing staff and subcontractor’s relationships and lines of authority.

Subfactor (2B) – Cost Control: In this Subfactor, the Offeror shall provide information on Cost Reimbursable Contract Management, scheduling, and cost control. The Offer shall provide an approach to control management cost and offer a competitive overhead rate. This will include every level of management for all companies involved.

(Subfactor 1 Technical Staff Approach is of equal importance to Subfactor 2 Cost Control.)

Evaluation of the Offeror’s proposal shall address each sub factor as it applies to the SOW. During evaluations of each proposal, the Government will assign each sub factor an adjectival rating and write a narrative evaluation reflecting the identified findings.
