SUMMARY OF CHANGES
AMENDMENT 0001
GENERAL REQUIREMENTS
SECTION 01 22 00.99 15 – Delete this section and replace with the like numbered section which includes the addition of paragraph GRADED A STONE.
CONTRACTOR QUESTIONS
1.) We looked at this breach for the levee district and access is not great by river for stationing 320 to 330 for the A stone. Your design crew might want to consider B stone, C stone, 600lb riprap, or etc that can easily be trucked to the site vs A stone.
Answer: Bid as specified.
2.) Section 01 22 00.99 15- 1.9. Please consider allowing the barge displacement method for stone measurement and payment. Graded stone A can be a 5000 lb stone, and no one wants to haul that size material in a truck due to potential damages to the truck bed, etc.
Answer: See revised section Measurement and Payment 01 22 00.
3.) Section 01 22 00.99 15 measurement and payment. Drawing c 104 has type 1 embankment from EMB t1-04r at 339 +50 to EMB t1-04r at 389+00 for approximately 5000 lf. What if, for example, only 4000 lf is repaired in that reach, is the payment 4000 lf or 5000 lf?
Answer: Reference specification section Measurement and Payment 01 22 00 – “Impervious Embankment Type 1”. Only completed work will be paid for.
Quantities shown on the plans and specs are estimated quantities and do not represent the final quantities.
4.) Please CLARIFY. This is a note from Matthew Neal: At the site visit today the levee district was under the impression that Borrow area 2 from the BCOE set was to be used by our contractor for impervious fill. I explained that the BCOE plans stated that borrow area 2 was pervious material only and therefore was not relevant to our contractor so it was removed. They said that their impression from the samples taken was that borrow area 2 contained impervious material and could be used. Can you double check the type of material that was found in borrow area 2?
The main concern they had was running out of impervious material from borrow area 4. They stated that they are still trying to locate additional impervious borrow for the repairs on the mainline levee.
Answer: Borrow area 4 is currently the only approved borrow source for impervious material that is near the main line breach repair.
5.) The contract documents references requirements to fill scour holes back to existing grade. Also, sheet C-303 references that the Levee District will be placing pervious embankment to existing grade. If the District is placing fill in these scour holes, what is the responsibility of the Contractor under this contract? If we are to place fill, how is it paid? Is it part of impervious embankment type 3?
Answer: The contractor will be responsible for all work excluding the pervious embankment. Referencing sheet C-303 the contractor is responsible for all impervious embankment (type III). Measurement and payment will be made under CLIN 0003 “Impervious Embankment Type III” and CLIN 0004 “Semi- Compacted Impervious Embankment”
Also, what bid item do we include the drainage ditch excavation shown on detail C4, sheet C-303?
Answer: CLIN 0004 “Semi- Compacted Impervious Embankment”
6.) Also, just to clarify, on bid item 0003, the total volume calculated is 141,800 CY, correct? If so, why can’t we simplify the bid form and just bid the one quantity?
Answer: Reference FAR Clause 52.211-18 “Variation in Estimated Quantity”
7.) What is the completion time on this project?
Answer: 210 days.
8.) What is the length of the project?
Answer: 210 days.
9.) Item 13. B. This calls out that an offer guarantee is not required. I believe that is incorrect but just to clarify, is an offer guarantee required or not required?
Answer: NO
10.) Changed Clauses:
CLAUSE REVISED:
52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 210 Calendar days after Notice to Proceed. The time stated for completion shall include final cleanup of the premises.
*The Contracting Officer shall specify either a number of days after the date the contractor receives the notice to proceed, or a calendar date.
(End of clause)
CLAUSE ADDED:
52.211-18 VARIATION IN ESTIMATED QUANTITY (APR 1984)
If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified
